A deadly shooting inside one of Michigan’s busiest shopping malls is raising major questions about self-defense, concealed carry, and what happens when violence erupts in a crowded public place.
According to FOX 2 Detroit and WXYZ-TV Detroit Channel 7, authorities have released the suspected shooter (a Michigan Concealed Pistol License (CPL) holder) while the investigation continues, signaling prosecutors are taking a careful look at whether the shooting was legally justified.
The incident unfolded Saturday evening at Great Lakes Crossing Outlets in Auburn Hills.
Police say the violence began with an altercation inside a mall bathroom involving a 22-year-old Detroit man and a 20-year-old Pontiac man. Investigators say the confrontation didn’t end there.

According to police, the 20-year-old and another individual later confronted and attacked the Detroit man near the food court. During that encounter, the 22-year-old pulled a handgun and fired multiple rounds.
The Pontiac man, later identified by family as KeShawn Emory, was killed. A 19-year-old woman who was not part of the fight was also struck by gunfire and is expected to survive, according to local reports.
The CPL holder was initially detained but has since been released as detectives continue investigating the case.

Mall Policy vs. Self-Defense Law
One question that’s already surfaced is whether Great Lakes Crossing’s posted no-weapons policy changes the legal analysis.
According to FOX 2 Detroit, defense attorney Neil Rockind said it likely doesn’t if prosecutors determine the shooting met Michigan’s legal standard for self-defense.
“The issues are whether or not you honestly believe you had to use it, and was it reasonable,” Rockind said. “It doesn’t matter if you took a gun when you weren’t supposed to. You still have the self-defense argument.”
In other words, violating a mall’s private policy could potentially lead to other consequences. But it does not automatically eliminate a person’s ability to claim self-defense under Michigan law.
A Mall Isn’t a Gun-Free Zone
WXYZ also spoke with former law enforcement officer and firearms instructor William Kucyk, owner of Action Impact Firearms Training Center.
He noted that malls are often mistakenly referred to as “gun-free zones.”
“A mall is not a gun-free zone,” Kucyk said.
However, he cautioned that simply possessing a CPL doesn’t automatically justify using deadly force.
If you’re going to carry a gun, you need to know before you can shoot another human being,” Kucyk explained. “You need to be facing an immediate risk of life-threatening injury or death.”
That’s ultimately the question investigators will have to answer.
Investigation Continues
Police have not announced whether charges will be filed against the shooter.
The case remains under review by prosecutors, who must determine whether the evidence supports a lawful claim of self-defense or whether criminal charges are warranted.
The shooting comes just over a week after another deadly shooting at Dearborn’s Fairlane Town Center, adding to growing concerns about violence in Michigan shopping malls.

It’s too bad that “laser tag” style walk-through defensive practice rooms (like the cops use) are not available to the public. Any combat training at all would teach them to be aware of what is behind the threat, how to position oneself to gain a shooting angle that avoids collateral injury. Sometimes just dropping to the floor will achieve a good angle, shooting upward at the threat. Moving left or right can do that, but leaves you a as a big, standing target (At least you are a moving target). Using your imagination while standing or moving through a crowd can be good “practice” mentally. “What would I do if someone started shooting people right here, right now.” Any practice at all with your weapon will give you more of a feel of direction of fire. That’s one of the reason Mall’s have fallen out of fashion and few people frequent them any more and most are closing they doors. They are infested with ‘hood-rats’ and you can’t enjoy your day without looking over your shoulder and worry about getting shot by some dreadlock-wearing POS that could care less about a human life.

The short video shows some but NOT all factors. Two against one, with two guys kicking and punching as the one guy takes his lumps while steadily protecting his firearm and hoping he does NOT get clocked. Then the tide swings to the one guy who deploys and gun. Now it’s a legal fight with one dead.
One thing is certain, standing around during a fight has it’s risks.
If my prior experience in Michigan holds true, this person will likely be charged with murder and arrested. It seems in Michigan if you levy a claim of self-defense you will have to prove that in a court of law. This person is going to need a very qualified lawyer who knows about such things and top notch consulting experts who understand and have considerable experience in such matters. The typical PI is not going to cut the mustard here, there is only one good firm in Michigan I can think of, they’ve helped secure numerous acquittals in recent years. Good luck moving forward….
If you claim self defense in any state, you’ll need to prove it in court, should you go to trial.
Not necessarily true. In fact, in my first hand experience, I can tell you that is exactly what may not happen. You can fully expect a police investigation however, in such compelling circumstances which tend to favor a claim of self-defense, you would have law enforcement file a warrant request and the prosecutor decline the request on the basis of compelling evidence of an excusable use of force in self-defense.
On the other hand, in Michigan, even in very obvious self-defense cases, prosecutors seem to like prosecuting such cases forcing you essentially to prove your innocence.
Which is why I specifically included the phrase: should you go to trial. 😉

If you took abandoned cars or vehicles seized from criminals, and drugs and weapons seized each day or week you could then make them avavailable for use betwwe 3am to 5 am on closed expressway loops.
Anyone that wants to get on can have a vehicle, drugs, gun etc (?) and could get on the expressway. The exits would be blocked off. At 5:01 the snowplows could line up side by side and push everything to an off load point. In Philly that could be near the art museum where the highway crosses the Schuylkill River. They could have barges on the river and they could push everything off onto the barges. Then the barges could be towed out to sea and everything could be dumped to make artificial reefs.

Typical with todays black youth. Violence is all they know. That’s what happens when you allow the streets to raise your children for you. From outward appearances, yes – self defense. Even though he has a CCL, it is still carrying illegally if signs were posted banning weapons, at least in my state.
