A late-night break-in in west Mobile ended with an alleged intruder dead and a homeowner waiting to learn whether prosecutors believe the shooting was justified.
According to FOX 10 News, Mobile police responded to the 8300 block of Calgary Drive shortly after 9 p.m. Monday. The neighborhood sits just off Leroy Stevens Road.
Officers found 37-year-old David Lee Jr. dead from a gunshot wound inside the home.
Investigators say Lee broke a window and unlawfully entered the residence. Police say the male homeowner then shot and killed him.
The homeowner’s name has not been released. Police also have not provided details about what happened between the forced entry and the gunfire.
Neighbors told FOX 10 they did not hear the shots. One neighbor said it was sad that someone died but believed the homeowner did what was necessary to protect his family.
The Mobile Police Department has turned the case over to the Mobile County District Attorney’s Office for review. No charges had been filed as of the latest report.

On the surface, the known facts appear pretty straightforward: Police say a man smashed a window, entered an occupied home without permission and was shot by the homeowner.
Unless investigators uncover something that changes that timeline, this could end up being another example of an armed homeowner stopping a threat inside his own residence.
For now, the case remains under review and the homeowner has not been charged.
