If you think you can walk into a gun store, point at a firearm, swipe your card, and walk out like you’re grabbing a pack of gum, you’ve been misled.
That’s the blunt message from Colion Noir, who recently pushed back against the long-running narrative that buying a gun in America is “too easy.”
Noir highlighted a viral clip from a first-time buyer who described her experience purchasing a firearm as one of the hardest processes she’s gone through. She compares it to boarding a domestic flight. That’s not exactly the “walk in and arm yourself instantly” fantasy critics often describe.
For Noir, the bigger issue isn’t whether the system has background checks. It does. It’s who those barriers actually affect.
At a federally licensed dealer, buyers fill out ATF Form 4473, provide government-issued ID, and undergo an instant background check through the federal system. The result is an approval, denial, or delay. It’s structured. It’s regulated. And it applies to law-abiding citizens.
Meanwhile, criminals (by definition) don’t use the system. They don’t fill out paperwork. They don’t submit to background checks. And, they steal firearms, buy them illegally, or obtain them through underground channels.

That’s the disconnect Noir points to.
“If criminals already bypass the system,” he argues, “who are new restrictions really aimed at?”
He also questioned the logic behind waiting periods. Once someone has passed a background check and is legally cleared to purchase a firearm, why force an additional delay? Noir suggests that individuals planning criminal acts are unlikely to be deterred by a few extra days.
Beyond policy mechanics, Noir brought the conversation back to first principles. Specifically, the constitutional foundation of the right to keep and bear arms. Gun ownership, he notes, is optional. No one is required to own a firearm. But restricting access for those who choose to exercise that right raises larger constitutional concerns.
His closing point was direct: the “militia” referenced in the Second Amendment isn’t some distant government unit.
“It was always you,” Noir said, reinforcing the idea that personal responsibility and preparedness are central to the American tradition of gun ownership.

Here the Far Right just threw mud right in their own faces. They do not admit that most criminals buy “second hand” guns both from friends and from flea markets and gun shows with no paperwork. Most “do not” use stolen guns. Another source was building their own ghost guns with no serial numbers or paperwork something the Far Right Fanatics scream is their God given right because they do not care how many criminals or mass murderers use them. Two Chicago studies found that the average crime gun “was not stolen” but were second hand guns that had been sold and re-sold many times.

As far as “Federal Law” (not various State Laws” it takes only minutes to run the background check unless something turns up about your past history. So yes, it’s often almost as fast as swiping your credit card. The real truth is that the “background check” is not thorough enough and people often slip through the cracks that should not. The current background check is “too fast”. Implementing the 1934 NFA background check would be far more thorough and accurate if it was done for all firearms not just full auto but for all second hand guns and new guns.
Below is just a brief study on how many ghost guns are used in mass murders.
A PARTIAL LIST OF LUNATICS AND CRIMINALS WHO BUILT GHOST GUNS AND USED THEM IN CRIME OR MASS MURDERS.
Are ghost guns frequently used in violent crime?????????????????????????
Yes, ghost guns are increasing being used in shootings across the country.
In July 2020, an individual who was prohibited from possessing guns allegedly murdered two people in Pennsylvania using a homemade 9mm handgun.9
In November 2019, a 16-year-old shot five of his classmates at Saugus High School in California—two of them fatally—using a homemade handgun, before fatally shooting himself.10
In August 2019, a shooter used a homemade gun kit to build a .223-caliber firearm that he later used to fire 41 shots in 32 seconds in a bar in Dayton, Ohio, shooting 26 people and killing nine.11
In 2017, in Northern California, a man prohibited from possessing firearms ordered kits to build AR-15-style rifles. On November 13, he initiated a series of shootings that began with fatally shooting his wife at home, followed by a rampage the next day during which he fired at multiple people in several different locations, including an elementary school, killing five people and injuring dozens more.12
In 2013, a shooter opened fire in Santa Monica, California, shooting 100 rounds, killing five people, and injuring several others at a community college using a homemade AR-15 rifle. Reporting indicates the shooter had previously tried to purchase a firearm from a licensed gun dealer and failed a background check, potentially indicating why he opted to order parts to build a gun instead.13
Law enforcement officials around the country are sounding the alarm about the dramatic increase in the recovery of ghost guns at crime scenes in their communities. ATF reported that approximately 10,000 ghost guns were recovered across the country in 2019.14 Ghost guns have also been illegally trafficked to Mexico.15 In addition:
In 2019, Washington, D.C., police recovered 115 ghost guns, a 360 percent increase from 2018, when they recovered 25 ghost guns, and a 3,733 percent increase from 2017, when only three such firearms were recovered.16
In 2019, ATF reported recovering 117 ghost guns in Maryland with almost 25 percent recovered from Baltimore alone. Ghost gun recoveries in the state then tripled in 2020.17
According to law enforcement in Philadelphia, ghost gun recoveries in that city rose 152 percent from 2019 to 2020.18
The special agent in charge of the ATF Los Angeles Field Division reported in January 2021 that 41 percent of the division’s cases involve ghost guns, and a May 2019 statewide analysis in California found that 30 percent of all guns recovered in connection with a crime in the state did not have serial numbers.19
In addition, an investigation by The Trace found that ghost guns are increasingly becoming the weapon of choice for violent white supremacists and anti-government extremists.20
In conclusion the ATF is a law unto itself and as in the past it rules at 8:00 AM and it is then a new “regulation” (disingenuous term for new law) is now the law of the land at 5:00 PM.
No Judge Conservative or Liberal will declare the ATF ruling illegal or Unconstitutional because ghost guns are a danger to the people of the country and even the much ballyhooed Scalia decision with the usual double talk and smoke and mirrors declared “The Courts had the right to regulate firearms” (slick disingenuous term for ban or restrict firearms).
In conclusion your right to own a weapon rests with the rulings of the courts, not the Constitution, and history has proven this reality like it or not.
No sane person would want ghost guns legal and no other civilized nation tolerates them. And I might add neither do they tolerate selling second hand guns with no paperwork either.
dacian, there was a rather high profile shooting in December 2024 in NYC with a 3D printed firearm that should be included in your list of ghost gun violence. You should really brush up on your history. Or find a more recent article to ctrl+v.
To Blue Dog
You cannot see the forest for the trees. My intention was not to document every mass murder because there are just too many of them, rather my intention was to show that sane gun laws are often not about taking anyone guns but rather preventing the wrong people from having them. This of course is way over the head of the Far Right that suffer from advanced paranoia and believe that there should be zero gun control laws and that all gun laws are only meant to disarm them. I suppose it is naive of me to think that anyone could convince mentally ill people of anything no matter how many examples you give them to prove your point and show them reality because for them reality just does not exist.
Your attempt to make a point was in reality no point at all.
BD, that’s Mark Smith, USSC Bar, Professor among many other notable accomplishment he has the 4 boxes diner on YouTube, podcasts etc.
So it’s the professor’s fault that dacian sometimes includes non-ghost gun anecdotes in his copy pasta rants? Should I file corrections directly with Mark Smith rather than this sock puppet?
Soap Box would be the 4th Mark Smith’s box. I must not have understood the rest of the exchange.
BTW, disappointed that the chatter box is missing.
snicker ;^)
Should an unstable person, who made these following hateful statements be allowed to possess firearms?
Yes ( ) No (X)
” The Germans got what they described when they finally surrendered. I personally would have starved them all to death, they were monsters not human beings.” -dacian
“the Celts forever remained a group of ignorant Hillbillies” -dacian
“And yes the Romans were superior to the Dacians” -dacian
“As far as my post being racist. Yes and no,.” -dacian
“… The Celts were the Hillbillies compared to the much more educated Romans. Again the Celts could not even read or write because they had no written language. And the churches you mention was just a bunch of deflection and historical inaccuracy because all of that came far later in History. It did not occur during the events and time period I described. And I might add it was not the Celts who built the churches you spoke of but by a mix of races that included Irish, Anglo Saxons, and Nordic tribes i,.e. the Vikings who converted to Christianity. The invasions and mixings of races in Britain is long and very complex. You seem to try and simply the later mix of both cultural and religious history later in time to try and exonerate the Celts history which has nothing to do with the time period I was describing.” -dacian
“You sidestepped my original Post and that was the Celts had no written language, built no monuments or magnificent churches or governmental buildings, made no progress in medicine, or science, or math, produced no sculptures or paintings, or art, just to name a few. Compared to Rome they were indeed a tribe of uneducated of Hillbillies. And they were constantly at war with each other that is why they were so easily conquered by the Romans who had the better weapons, tactics, and training and organization. Roman soldiers even had social security funds to retire on while the Celts simply regarded a soldier to old to fight as of no longer any value.” -dacian
““Kane, I can report with great pleasure that in less than another 20 years Laino’s will dominate the Legislature and Judicial makeup of the U.S. and you will then be a minority. I will then be laughing and howling at the Moon.” -dacian
‘Remember this, “The truth will always come back to haunt you” and only too late will you realize it when your neck comes under the Jackboot of the ICE Goon Squad. In the 60’s we had a better word for them and it was “The Pigs”. In the end back in those days History proved us right and it will prove us right again today as well because History is on our side. ” -dacian
“SOROS WILL GO DOWN AS THE MOST GENEROUS MAN IN HISTORY AND HAS DONATED MORE FOR EDUCATION THAN ANY LIVING OR PAST PERSON.” -dacian
“Babbit was attempting to help Herr Drumpf take over the U.S. Government by force and establish a Drumpf dictatorship for life.” -dacian
‘If you owned a “secret device” called a TV set you would have seen a special on MSNBC that went way back to pre-Colonial America and revealed “gun laws” that were on the books back then and also traced gun laws all the way up to modern times. This is where I got the information about a law in one of our big cities that banned the keeping of loaded guns in the home because of all the child deaths. Now of course you being from the Far Right will scream “I do not believe any historical facts because they do not jive with my preconceived notions on how life was like in Pre-Colonial America”.’ -dacian
” I explained that unless the local police department requests behavioral analysis or FBI Laboratory assistance, the FBI has no authority to interfere in a local murder investigation.” -dacian
“50. Avoided Scandal
Became the first president since Dwight Eisenhower to serve two terms with no serious personal or political scandal.” -dacian
“…The Second Amendment was not ratified until 1791. I suggest you read Carol Anderson’s book “The Second” which proves that 2A was written because of a fear of a slave revolt in the U.S. because Haitian Slave owners were fleeing Haiti and bringing some of the Slaves with them to the U.S.” -dacian
“And no he did not receive the Congressional medal of honor but he should have.” -dacian
On that last point, dacian thinks that Capital PO Lt Michael Byrd, a non-military member should receive the Congressional Medal of Honor for shooting the unarmed well decorated AF veteran Ashli Babbit in the face while she was climbing through a widow. dacian did NOT understand that for this criminal shooting Byrd was awarded the Congressional Gold Medal for civilians by the fake POTUS (genuine POS), and the Congressional Medal Honor is only awarded to military members.
addendum:
“And your bad mouthing higher education??? One of the first things that students are taught is that prejudice, bigotry, and racism, and xenophobia are morally wrong, something many of them did not obviously learn in their warped Right Wing Christian Hypocrite Churches. Students are also taught how to think critically.” -dacian
lololololol
Kane you are a living example of the continuation of Hitler and the Nazi’s. You march lockstep with their warped racist ideology. To deny the hypocrisy of the Far Right Churches proves you live in your own bubble world of the past glories of marching boots on cobblestone streets and shouts of “White Power”.
It’s you who advocates mass murder, NOT me. Want the proof again. Post the best evidence to support all the accusations you made against me. It’s you who want to make gunowner ship a tightly control government rationed privilege. I just applied your own control standards to your own online personality.
I am at least 7/8 Gaelic Celt, not an Anglo Saxon. I don’t want their crimes on my soul. You make all sorts of accusation against me without any support. Fine, people like dilute important issues with baseless claims, that’s on dacian.
“To deny the hypocrisy of the Far Right Churches proves you live in your own bubble world of the past glories of marching boots on cobblestone streets and shouts of “White Power”. This is a vague rant without any basis, but I don’t care if you carry on.
I fear God, I condemn the murder innocent people, I condemn all war crimes. Can you condemn the Soviet war crime policy raping women and little girls from the age of 8 years old to 80-year-old?
I am at least 7/8 Gaelic Celt, not an Anglo Saxon. I don’t want their crimes on my soul.
How about the details of your grand education free from “White privilege” Mister fake morality.
dacian claims that he “got my first .22 rifle, pistol, and 16 gauge shotgun in 1962.” Which made him about 14 years old with a firearm and this is also his claim to being knowledgeable gun owner. Although he will also claim that firearms are easier to get than a “hamburger” without explaining the hypocrisy between his claim of being a 14 year old gun owner and his wanting to make gun ownership more restrictive.
Then dacian is an advocate for a book, “The Second,” by Carol Anderson where this author claims that the 2A “was designed to empower white (sic) Americans while suppressing the rights of Black individuals.” So, by his own reasoning, dacian, grew up marinated in White privilege. What amends has he made to Black America for exercising his 2A rights???????????????????????????
Then dacian throws around a multitude of insults about education but when asked what his educational qualifications were, he goes silent.
I’d direct Carol Anderson to the quote of a noted Republican “the ballot box, the jury box, and the cartridge box.”
My my my, what our times have made of me.
dacian, you claim to be educated. Let’s consider your quote on the Germans who illegally lost their POW protections under DDE and became DEF. You support the starvation policy of DDE, now consider Patton’s words after the war.
”Everyone believes that the Displaced Person is a human being, which he is not, and this applies particularly to the Jews who are lower than animals.” -General George Patton
Now remember what you said;
” The Germans got what they described when they finally surrendered. I personally would have starved them all to death, they were monsters not human beings.” -dacian
Why do you believe that you are any better than the Germans that suffered during and after WWI and WWII. At least they lived through the struggles that made them hate, you have lived your whole live marinated in what YOU can only describe as “WHITE privilege.”
How could someone like you have served in the military and then claim that Capital LEO Lt. Byrd should have been awarded the Congressional Medal of Honor?
By your own words, you had a privileged childhood. I got nothing close to the gifts you got as a child; you probably never missed a meal in your life. You show no benefits of having been educated. You cannot pass judgement on anyone, not Patton, not the Germans or the Jews. Nothing you say or write has any real value.
Let us recall the words of dacian.
‘”The truth will always come back to haunt you” and only too late will you realize it when your neck comes under the Jackboot of the ICE Goon Squad. In the 60’s we had a better word for them and it was “The Pigs”. In the end back in those days History proved us right and it will prove us right again today as well because History is on our side.”‘ -dacian
Keep sharpening your pencil dacian. I have family members that were CPD LEOs going back to well before prohibition. What my stepfather and his brother both as CPD have seen things over the years that would destroy most people. You call people like that the “The Pigs.”
You can bet your last dollar that if a little girl that you care about was missing, you would call “The Pigs” and you would want them to shake down everyone they could, including the illegal immigrants. This phony love of the illegal immigrant would evaporate before the first 911 call was over.
More pearls from dacian…
“Jethro you are a star “poster boy” in regards on how our educational system has failed kids like you. Those like you who do not go on to college never learn how to think critically and fall easy prey to….” -dacian
He’s not a great poster child for more funding for the humanities, is he?
I find it interesting that dacian laments the nationwide loss of interest and funding for the humanities in higher education, but that shift is because for what, 15, 20 years now, the identity politics folks have been pushing STEM, especially towards girls and young women to address an imbalance in the field. They pushed STEM so much that the humanities stopped generating money – grants or student butts in seats – and most universities have become temples to Mammon, hedge funds with school almost vestigially attached. Like a pimp having to drop his bottom earner from his stable, so too are many of these universities trimming the humanities for more technical fields. It really is a shame, though, because humanities make for interesting hobbies – languages, archaeology, anthropolgy.
Do the DEI studies fall under the umbrella of the humanities? That is a pretty robust field of study right now but remember, he who weds himself to the philosophy of his own generation becomes a widower in the next.
quote—————–Do the DEI studies fall under the umbrella of the humanities? That is a pretty robust field of study right now but remember, he who weds himself to the philosophy of his own generation becomes a widower in the next.————quote
Robust field right now???? Where have you been since the 1960’s living under a rock. Really!!!!
The Trump administration and his sycophants and lackey’s the Supreme Court have been doing everything possible to destroy diversity, equity, and inclusion as it was the primary goal of Joseph Goebbels, a much worshiped saint of the Far Right..
Diversity, equity, and inclusion (DEI) are organizational frameworks that seek to promote the fair treatment and full participation of all people, particularly groups who have historically been underrepresented, marginalized, or subject to discrimination based on identity or disability.[1] These three notions (diversity, equity, and inclusion) together represent “three closely linked values”, which organizations seek to institutionalize through DEI frameworks
Quote — Where have you been since the 1960’s living under a rock. Really!!!! —
I’ve been in the real world. Not academia. And, I’ve been where apostrophes are the possessive’s adornment, not for the plurals. 😉
You oughta at least format your copy pasta a little bit. Including the [1] is just tacky. Take some pride in your work, dacian. I’m not mad, just disappointed. You are capable of better work than this!
Am I the only far-right lunatic with pronouns in my username that you argue with or are there others?
The high school (OPRF) I graduated from many years ago has stopped teaching honor classes for freshmen because those classes supposedly discriminate against Black and Mexican students. Would love to learn how dacian managed to achieve such a high-level education without discriminating against disadvantaged classmates? Can’t wait till that day.
As I understand, alumnus Hemmingway has been removed from the curriculum because of ‘toxic masculinity.’ They were so proud of that elite lefty and his mediocre books, until the winds of their fake morality shifted and now, he is a pariah. It was fine that he bragged in detail of committing war crimes and post war crimes, like dacian, the school board is just opposed to certain war crimes, and they have no probs with others but do not offend their gelatinous sensibilities.
That’s another reason why I despise current academia.
Well at least we agree on something,
yeah the commie left has a problem with blaming the law abiding with the actions of criminals.
