Virginia to Cease Honoring Concealed-Carry Permits from 25 States

in 2nd Amendment – R2KBA, Current Events, Max Slowik, This Week

Virginia Attorney General Mark R. Herring announced a new policy revoking concealed-carry reciprocity with 25 states this week on the basis that the other states’ permitting processes are less restrictive.

The change will go into effect on Feb. 1. Michigan, Oklahoma, Texas, Utah and West Virginia concealed-carry permit holders will still be honored. Herring’s office said that the other 25 states “lacked adequate disqualifiers to deny a permit to someone who would be barred from obtaining a permit in Virginia.”

“While you are here, you are subject to the commonwealth’s gun laws,” said Herring.

Virginia residents will also be affected by the policy as many of the 25 states, e.g. Florida, Louisiana, North Dakota, Pennsylvania, South Carolina and Wyoming require mutual reciprocity agreements. These states will no longer recognize Virginian concealed-carry permits.

The move is in-line with Gov. Terry McAuliffe’s pro-gun control administration and one of the Center for American Progress’ 28 ways to increase gun control in the face of an unwavering Congress. Earlier this year McAuliffe signed an executive order barring concealed-carry in state facilities.

“This has been where the gun violence prevention movement is going,” said Chelsea Parsons, a vice president of Center for American Progress. “In much the same way President Obama said I’m not going to wait for Congress anymore, the same can be said for leaders at the state level to really use their authority to take strong meaningful steps on this issue.” Parsons co-authored the report detailing new ways to increase gun control at the state and local level.

Meanwhile, the National Rifle Association was quick to condemn the decision. “Plain and simple, Mark Herring is putting politics above public safety,” said NRA-ILA executive director Chris Cox. “This decision is both dangerous and shameful. The Attorney General knows that permit holders are among the safest groups of citizens in the Commonwealth and the country. At a time when people are scared and desperately need the ability to defend themselves, Herring has chosen the path of making self-defense harder.”

“Those affected by this reckless political decision are law-abiding citizens—not dangerous criminals. Attorney General Herring is putting lives at risk by removing the constitutional right of law-abiding citizens to defend themselves in the Commonwealth,” said Cox. “The National Rifle Association will fight this decision in every arena possible. Further, this reaffirms our commitment to enact national right to carry reciprocity legislation in Congress.”

The NRA’s position was joined by Virginia House Speaker William J. Howell (R) who said that “Mark Herring consistently seeks to interpret and apply the law of the commonwealth through the lens of his own personal, political opinions,” Virginia House Speaker William J. Howell (R-Stafford) said. “He is damaging the integrity of the office he holds.”

When the policy goes into affect, concealed-carry permits issued from Alaska, Arizona, Arkansas, Delaware, Florida, Idaho, Indiana, Kansas, Kentucky, Louisiana, Minnesota, Mississippi, Montana, Nebraska, New Mexico, North Carolina, North Dakota, Ohio, Pennsylvania, South Carolina, South Dakota, Tennessee, Washington, Wisconsin and Wyoming will no longer be honored.

At least for now, Virginia still issues concealed-carry permits to non-residents.

    Have a CCP in South Carolina. Also have one for Utah which was acquired via a local gun shop who had an instructor authorized/certified to teach Utah’s CCW course. So ha ha to VA. I would suspect any VA resident who would be traveling around the country has already gotten a Utah CWP; if not, it is time to do so.

    This whole thing with requiring a permit to carry a firearm is unconstitutional. How does “…shall not be infringed” doesn’t requiring you to ask permission violate? If you have to ask permission it’s not a right. If they can tell you if you can carry it or not then your right is not a right at all, they’ve turned it into a privilege just like driving a car is.
    The second amendment reads “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”
    Requiring a permit is an infringement. Forbidding certain types of weapons is an infringement. Barring weapons from certain areas is an infringement. Telling you how you can carry is and infringement. The Second Amendment IS my concealed carry permit and it does not grant you the right, it recognizes the God given right to self defense.

    I feel sorry for the folks from Virginia. If they now get caught carrying “concealed” in the other States with which Virginia no longer shares reciprocity, the citizens of Virginia will become felons. If a Virginian “conceal carries” say, in Florida, the concealed carry laws of Virginia will no longer be recognized in Florida, and effectively, the concealed weapons carrier will be in felonious possession of a firearm, subject to all the laws the State of Florida that come with carrying a concealed weapon illegally. This could easily result in jail time, large fines, legal fees, and other retaliation by the offended State.

    In my opinion, Terry McAliffe has just thrown all of the citizens of Virginia under the proverbial bus by his reckless refusal to recognize reciprocity with all other States which currently offer to recognize Virginia’s CCP.

    But then, what have we come to expect from liberal loons?

    Something to keep in mind when travelling in VA. If you happen to have a CCW license and you and/or a member of your family are injured or killed in the state, they are wide open for a civil lawsuit for effectively taking away your Second Amendment rights to protect yourself and/or your family merely because you don’t have a VA CCW permit. The last time I looked we were all Americans and entitled to ALL the protections outlined in the US Constitution.

There are very few places where this right is restricted. This right is not confined to residents of The Commonwealth.       Yes! By all means. Virginia is an open carry state. If you are legally entitled to possess, it is your right to openly carry. There are very few restrictions on this ability. Outside of NoVA, we Virginians jealously guard our rights. Please do not mistake the rest of us for the slime which oozes from DC into Northern Virginia.     Can you say “Heil Herring!” (Hail Hitler!), “Heil, mein Führer!” (Hail, my leader!), or “Sieg heil!” (Hail victory!). It was adopted in the 1930s by the Nazi Party to signal obedience to the party’s leader – Adolf Hitler – and to glorify the German nation (and later the German war effort). This Attorney General along with President Obamas’, Attorney General Loretta Lynch, and OSTP Director John Holdren are all out of step and changing the legality of reciprocity does nothing to improve the FBI already in place background check.

Just imagine all the tax dollars the BATFE would loose if all gun owners cut out doing business with them! The Great State of Florida does Not issue concealed carry permits to any of the mentioned individuals who are recently convicted of DUI, dishonorably discharged military veterans, ANYONE convicted of domestic violence, anyone who uses illegal drugs, anyone judged mentally deficient etc. So can anyone explain to me how our state’s CCW regulations are any different? Something is WRONG and it stinks of liberal hogwash from here! VOTE these idiots out of office in EVERY state and our country will eventually get back to what our Founding Fathers intended.

How safe are honest (and now disarmed) Virginia residents when the Virginia plates on their car tells criminals in other states that the idiot Virginia Attorney General Mark R. Herring assures them the occupants are unarmed and easy pickings? How does this not infringe upon our right to keep and bear arms? This action is a prime example of why we NEED a National carry permit.
    I am wondering – how many out of state permit holders have come into Virginia and caused a problem? I am sure that has not been an issue. The real issue is that the people of Virginia elected this idiot. I sure hope they open their eyes before the next election. This action has done absolutely nothing to make them safer. I wonder how much of Bloomberg’s billions will now go into Herrings reelection campaign?

Hitler used some of the same rhetoric as Herring is now using when he banned citizen ownership of firearms in Germany. “Traitors” like this politician should be barred from ever holding public office.     I am ashamed to have been born and raised in Roanoke, Va. For years the big deal was to stop travelers with radar detectors and ticket them and steal their radar detector. Now they can’t steal them but can still stop and harass a traveler. Now I can’t carry my legally licensed firearm in Va. Every state that has lost legal carry privileges by their residents should issue a no travel alert to Va. I am glad I live in Florida now. Va.should spend their time catching the real criminals and not hassle law abiding citizens.

    Whereas we law abiding members of society as well as CCL holders from states no longer recognized by Virginia, suggest that our National headquarters for the N R A be moved out of Virginia. Since I will now be considered a criminal if I try to carry my concealed weapon in Virgina I think it only fitting that we stop providing any benefits derived from the location of our NRA headquarters to said state. I think it is time to start carring the ” no legal guns no money ” cards and start showing to these business owners how it is hurting them. Personally I will not be spending money in Virginia.

      I strongly agree with this sentiment. Move the NRA out of Virginia they do not need my money in any form (I am only a Life Member), and BOYCOTT Virginia on all travels, I know will. Its to bad because we had just went to Williamsburg for the first time for a week last October for a Family reunion since it was midway for all of us. I guess we will use somewhere else from now on……………. Shame on you Virginia for your actions, they are cowardly.

      Perhaps it’s better to have NRA HQ in VA where it can deal directly with the local politicians involved! Being already there, NRA lawyers and activists don’t need to travel far to find both the problem and the cause of the problem! They’re also in a great position to recruit more VA citizens into the organization, AND to organize citizen groups to show up in the state capital to voice their opinions re: 2nd Amendment rights. Having your own “army” in the midst of the enemy’s home territory is really a great advantage!

      Moving the NRA Headquarters, and the other facilities in Virginia (there are several others), would be a spectacular statement, on that I agree. It is, however, a very costly and less cost effective idea when you look at the costs. It would take a long time to accomplish. It is better that we support our supporters in the that state (perhaps by donating the monies we do not spend there). They can make the efforts to change the political landscape in a much more effective way. Besides, the AG and Gov would just spin the departure of the NRA as “driving the NRA from the Commonwealth”. The number of lives it would uproot when you consider the employees and families is a very high cost. Perhaps someday it would be justified but I don’t think it is now.

      I would endorse relocation of future NRA expansions, projects and logistic and fulfillment services to more gun friendly locations. Expansion of operations in Virginia should be carefully considered against alternative sites, and weigh in all the factors like taxes and political climate, as well as suitability to purpose. I am sure that is part of every one of these discussions.

      If there were grounds to file suit against the Gov and AG then the NRA should pursue it. The problem is that not every action has litigation as a beneficial option. The NRA doesn’t want to miss any opportunity to file suit where it has a possible positive outcome, but they have no desire to expend resources in grandstanding efforts the have little likelihood of success.

      The best Idea I have seen is the recall. The proper solution is to address the perpetrator of the action, as with guns, and that is the politicians. Address the “criminal” not his tools. The citizens of the Commonwealth can initiate this action, the NRA can provide resources and support, but the voters have to do it. I would happily join in the effort with my vote, but I am in Florida and I am sure I can’t vote in Virginia…but without Voter ID maybe….just kidding.

    First Off, I would like to apologize for these Idiots in Richmond, And Idiots they are. When 2016 Begins and the General Assembly returns to Richmond These 2 clowns we have in a position of power will be put in their place. There are from what I have read via our VCDL ( Virginia Citizens Defense League ) a couple bills to make Reciprocity complete with each State. Next Election this Commonwealth will be solidly GOP.

    Dear Va Governor and AG,
    In view of your new pro gun control measure, I did a detaied study of criminals and terrorists that would be disarmed by this new restriction disqualifying the majority of out of State CWPs. That unsuprising numbere is ZERO.
    Was there a crime wave comitted by out of State CCP holders? A mass murder by one? Surely there was a existing problem that drove this solution. No? This just feel good gun grabber action that you don’t think will cost you votes? Guess again: All those States you just dropped will in turn cancel reciprocity with VA residents AND THEY VOTE.

    You have just provided the ony reason I need to sell my Summer house in Virginia Beach. You may get a few vacation cancelations as word spreads of you restriction.

    So what new Laws have been made to deter drugs, crime and terrorism this year? Ahh………… NONE!

      Wil ,you are on the money ,We all need to start boycotting these states and people that trample over our 2A rights . Money talks and as a group we all need to come together and ban these people and places .If we as a gun community would start sticking to our guns so to speak in mass we cab make a difference ,but it takes us all .The motivation and persistance has to continue until they break not us .Molan Labe .

        You are correct, I will no longer stop in Virginia on my way up North or on my return, I will make sure I gas up and snack and pee just before entering that state from either end, Their are plenty of Floridians that go thru that state on way up North and I encourage them to not patronize Virginia.
        In fact I think I will post on Facebook and other media and ask every else to also post…Boycott Virginia.
        That guy must be a Liberal, you would think liberal means you would be allowed to do things
        The only people being safe in that state now are the thugs and they must love this law..

My own detailed study reached the same conclusion; with the addition that the willful intentional violation of the 2nd Amendment by this governor’s and AG’s criminal manipulation of the 10th Amendment also presents probable cause for indictment. Not to mention a State charge for malicious endangerment of a Citizen’s life by illegally prohibiting or restricting their right of armed self defense for the motive of their own personal gain and political profiteering.

      Most Demcrats are anti gun lovers, I’am making the proposal for everyone to change their political affiliation to Republican. I have been a Democrat for over 40 years and I’am embarrassed by their stupidty . Most Repubicans are pro gun and we need to get more of them in office. This is easy to do and will shock the Democrat party.

      I agree with you about the travel, though I am from Texas and at the moment it does not affect me. I NEVER travel in a state that will not allow me to protect myself. Many times I have driven hundreds of miles around a state that did not honor my Texas CCP. I have a couple of friends who want me to visit them next year. One in Washington and the other in California. I had to turn then down because I can not travel in their state with my firearm. Both do not recognize Texas’ CCP.

      This appears to be nothing more than extortion for the pupose of enriching the state. I have a Mississippi permit which would meet all the requirement listed in the application.

      In reading some of the provisions and exceptions to the Virginia Commonwealth concealed carry law, I wonder if anyone has mentioned to the public that there is a specific exclusion listed?
      It specifically states therein that “Any attorney for the Commonwealth or assistant attorney for the Commonwealth, wherever such attorney may travel in the Commonwealth.” and carry a weapon concealed. Why would this group need to carry “concealed”. Oh yeah……………..”SELF PROTECTION AND DEFENSE”.
      They should be ashamed of how they lie to the public! To them, it’s only about “CONTROL” and nothing else.
      I carry to protect myself and my family. I shall continue to do so. I just don’t care to visit the Kingdom of Virginia.
