A Texas homeowner shot a man after he broke into his house in search of a woman he believed was being held hostage.
Robert Smith bursted into a Corpus Chrisi home early Monday morning. Smith encountered the homeowner and accused him of holding a woman against her will. In the ensuing struggle, the homeowner shot Smith in the leg.
The situation escalated when Smith lunged at the homeowner, grabbing him by the throat. The homeowner was armed with a gun and fired several warning shots into the air. When that didn’t deter Smith, he shot the home invader in the leg.
It’s unclear why Smith was under the impression the homeowner was holding a woman captive, but sources say it’s possible he is mentally ill.
Smith was arrested and with aggravated assault. The homeowner was not charged with a crime.
The homeowner illegally fired warning shots, INTO THE AIR where they can rain hell down upon unsuspecting innocents..
If you fear for your life, you use lethal force. If you have time to fire warning shots, you’re not in fear for your life…
I think he did the right thing trying to keeping from killing this man. Also if you shoot into the air the bullets come down with a terminal velocity that isn’t leather to humans. Especially after going through a felling and roof. If you shoot at an angle then sure they can easily stay lethal, but I don’t think this is the case here. I think it was brace and selfless of him to grant the man warning shots. Easily could have negated to need to shoot him.
Being hit in the head with a bullet, probably at least a 9mm 115 gr. at terminal velocity (~ 200 MPH) isn’t something anyone wants, especially if it is one of your children. Personally my warning shots would be at the intruders feet so I could easily level up for the coup de grace. No danger to others.
The threshold for use of a firearm is the reasonable fear that one’s self or another will suffer grievous bodily harm at the hands of an assailant. Guy’s lucky it wasn’t me, he’d have two holes in center mass to think about before his hands made it all the way to my neck.
Never fire a warning shot, he could’ve hurt or killed the homeowner. The intruder was in his house, attacked him, chocking him, end of story.
