‘Shall Not Be Infringed Act’ Proposes Sweeping Repeal of Gun Control Laws

In a bold move to dismantle gun control measures, Congresswoman Lauren Boebert has presented the Shall Not Be Infringed Act. This proposal seeks to repeal the firearm regulations implemented by the 117th Congress, asserting that these measures violate the Second Amendment.

Boebert has never shied away from her staunch support of the Second Amendment, firmly stating, “No amount of gun control will ever eliminate evil in our society.”

The Congresswoman referred to cities like Chicago and New York, contending that stricter gun laws have turned these locations into “criminal safe havens.” She criticized advocates for police defunding who simultaneously push for stringent gun control, arguing that this leaves everyday Americans defenseless.

The bill has garnered support from other members of Congress. Congressman Byron Donalds condemned the previous legislative agenda of Nancy Pelosi, which he perceived as unconstitutional in its approach to curbing Second Amendment rights. Expressing his support for the Shall Not Be Infringed Act, Donalds described the move as a “legislative fight for American freedom”.

Boebert’s proposed bill, H.R. 3212, aims to repeal provisions from the Bipartisan Safer Communities Act, the 2023 Appropriations Omnibus, the Violence Against Women Reauthorization Act of 2023, and the 2023 NDAA. The detailed repeal provisions include the reversal of laws that, in Boebert’s view, disarm law-abiding citizens, criminalize private gun sellers, and impose undue waiting periods for rifle purchases.

The bill also proposes to cut the Bureau of Alcohol, Tobacco, Firearms and Explosives’ (ATF) budget increase, defund the Department of Education’s efforts to mandate so-called safe storage, and reverse decisions that “weaponize” the Veterans Affairs (VA) against veterans. Here’s a snapshot of the changes:

Changes to the Bipartisan Safer Communities Act:

  • Repealing a program bribing states to pass red flag laws.
  • Repealing the decision to criminalize private transfers by reclassifying private sellers as gun dealers.
  • Repealing the federal waiting period for some adults to purchase rifles.
  • Repealing laws that disarm adults for mere misdemeanors.

Changes to the 2023 Appropriations Omnibus bill:

  • Cutting the ATF’s 14.1% budget increase.
  • Cutting $14.4 million for the ATF to maintain its illegal gun registry.
  • Cutting $700+ million in bribes for states to pass red flag laws.
  • Reversing the decision to weaponize the VA to attack veterans with gun confiscation.
  • Defunding the Department of Education’s efforts to mandate so-called safe storage.
  • Defunding VA and HHS programs that track where veterans are storing their guns.
  • Defunding programs that discourage women from exercising their Second Amendment rights.
  • Defunding research that labels conservative gun owners as dangerous right-wing radicals.

Changes to the Violence Against Women Reauthorization Act of 2023:

  • Repealing the law that directs law enforcement to criminally investigate people who fail firearm background checks, even though 90% of the time the system falsely denies a law-abiding citizen their right to bear arms.
  • Defunding a program that enables the ATF to deputize local police to enforce federal gun laws.

Changes to the 2023 NDAA

  • Repeal provisions creating a firearm storage provision that could be used to later justify a nationwide mandatory so-called safe-storage program.

The Shall Not Be Infringed Act has received the backing of Gun Owners of America (GOA) and the National Association for Gun Rights.

Aidan Johnston, Federal Affairs Director of GOA, emphasized the importance of the bill, asserting that Congress has no authority to restrict the Second Amendment. Hunter King, Director of Federal Affairs for the National Association for Gun Rights, praised the bill as a corrective measure to the damage done by Democrats and Republicans In Name Only (RINOs).

Cosponsors of the legislation include various representatives, including Rep. Mary Miller, Rep. Troy Nehls, Rep. Ralph Norman, Rep. Andy Ogles, and Rep. Byron Donalds, among others.

    Nothing like this ever gets presented when the Republicans have control of both houses and the Presidency. Most Rhinos are as bad as democrats when it comes to the true meaning of the Constitution. They talk a good game game to get elected. After Parkland, Florida voted in a law that had nothing to do with the actual Parkland incident. When I asked my REPUBLICAN representative why he voted for it, he said that they had to do something or it would look like they didn’t care. The press controlled that vote. Don’t get your hope up that anything will change. When you have to constantly pay legal fees to challenge unconstitutional laws, it is no longer a true right.

    There should be a law where any person who authors, sponsors, supports, votes for or signs in to law any bill that is contrary to the 2nd amendment or any other amendment goes to jail for a minimum of 20 years for the first offense, 30 years for the 2nd and life for a third. I guess that means Dianne NotsoFinestein would be in prison rather that the senate where she is rotting away. Come to think of it most of the democrat party’s reps, senators, governors, mayors and presidents would be behind bars.

      I’m not 100% sure, but wouldn’t voting anything against the Constitution or Bill of Rights be: 1) contrary to there Oath of Office & 2) an act of Treason? (Which already is punishable by death)

    Under both federal and state law, we are required to maintain Militia defined in the statutes and commanded by the U.S. Constitution.
    Militia is defined as able-bodied men capable of bearing arms that they themselves must provide and maintain in good working order. This is not a voluntary force, but rather compulsory service.
    We cannot win this struggle to revoke gun control without enforcing the Lawful power of “the Militia of the several States;” called forth under Article I, § 8, Cl. 15.
    We must look at ourselves honestly, and admit that there are few who are willing to serve, and fewer still who know and understand the Law regarding this subject. The anti-gun crowd will continue to move forward because there is no lawful stop-gap presented by the pro-liberty side. Instead, we rely on “theory” that can be changed depending on the makeup of the legislatures and the courts.

    You know, I could take her a lot more seriously were she not dating that chode from Nickelback. I will try not to make any more personal attacks beyond that. But think about it – Nickelback.

    Anyway, this is both dangerous and reckless. We’re at a point where we are seeing more mass shootings than days of the year and your solution is… to cut funding for the VA? To strip law enforcement of the tools to track known terrorist groups? To discourage cooperation between the ATF and local law agencies? I mean, this is some backwards thinking.

      In simplest terms, the creation of any institution, such as the FBI, violates the principle and the Law as it is set down in Article I, § 8, Cl. 15. None of the alphabet agencies can therefore claim any law enforcement powers. However, in this day-and-age, even those who claim to be patriots, or more perplexing still, attorney’s, who have supposedly studied law, are not willing to point out this glaring violation.
      “The right of the citizens to keep and bear arms has justly been considered, as the palladium of the liberties of a republic; since it offers a strong moral check against the usurpations and arbitrary power of rulers…And yet, though this truth would seem so clear…among the American people, there is a growing indifference to any system of militia discipline, and a strong disposition, from a sense of its burdens, to be rid of all regulations. How it is practicable to keep the people duly armed without some organization it is difficult to see. There is certainly no small danger that indifference may lead to disgust, and disgust to contempt; and thus gradually undermine all the protection intended by this clause of our national bill of rights.” – Joseph Story, Commentaries on the Constitution.
      Justice Story wrote the Commentaries in 1833. He notes, even back then, after having fought a war for Independence, and another to secure the nation just Eighteen Years later, the people were already abandoning their powers as if they were some great burdens to be arbitrarily discarded for convenience’s sake.

      Wow, your ‘interpretation’ of that article shows a great lack of comprehension on your part.
      It doesn’t ‘defund’ the “VA”, it defunds a PROGRAM they shouldn’t even have.
      What’s backwards is your commentary, and your apparent trust in certain agencies that have PROVEN they can’t BE trusted.
      There are local Law agencies and States that are already saying they won’t work with the ATF, that’s how bad their reputation has become.

      Laws only apply to people who obey them. Do you believe that a person who is prepared to kill people draws the line at getting an illegal firearm?
      Secondly, if you read about what powers the federal government was given, you would see that the only federal agency given the authority to enforce laws outside of DC is the IRS. Every other federal agency operating in the United States is pure government overreach.
      The FBI was snuck in back when law enforcement had problems communicating with law enforcement from other states. The FBI’s job was to track criminals that crossed state lines period. The agency was created without any vote and against the will of the majority screaming government overreach. The ATF was spun off of the IRS during prohibition because taxes were not being paid on the alcohol. Now they are an independent federal agency creating laws that never went through congress.

    A true American patriot, and a great American as well. Thank you congresswoman Lauren Boeburt, and the other cosponsors. Gun control is a failed socialist agenda. Its a great list of changes that would go along way to make America safer, but what are the chances of getting it passed with this congress and president? might have to wait until the next election and judging by the last election the repubs need a new strategy. Biden should be a lame duck but hes not. i think it was bc scotus struck down roevwade before the midterms, the country didnt like that so the dems held on. or maybe it was something else. i dont watch much news anymore. hope Tucker finds a way back.
