A school board member and failed state house candidate in Pennsylvania found herself in hot water earlier this week after she vowed in a Facebook post to shoot anyone who approached her without wearing a mask.
She also called non-mask-wearers “bioterrorists” and compared them to someone pointing a gun at her.
Dr. Jennifer Rager-Kay is a Selinsgrove Area School Board member and a former Democratic candidate for a state house seat in Pennsylvania. In a now-deleted Facebook post, she commented under an image of an anti-lockdown protest in Pennsylvania’s capital:
“I find it interesting that the largest group of the participants in the anti-lockdown protest and refusing to wear masks in public as they see it as a violation of their constitutional rights are among those against a form of gun regulations,” she said.
“As a concerned carry-permitted gun owner, if you refuse to wear a mask and try to come within 6 feet of me or my family, I will exercise the same constitutional rights to shoot you.”
The post was shared privately but was soon captured and shared online, according to PennLive.

“We dodged a bullet here in the 85 district when [Republican David Rowe] trounced her in the special election. Pun intended,” Boyd Martin told GunsAmerica. Martin has three daughters who have attended school in Rager-Kay’s district.
Rager-Kay ran for election in 2018 and 2019 for the Pennsylvania House of Representatives. In 2018, she was defeated by Rep. Fred Keller 32% to 68%. When Keller was elected to the U.S. House of Representatives, Rager-Kay ran for the seat again in a special election, but lost to Republican David Rowe 37% to 62%.
Rager-Kay issued an apology after receiving blowback online, but she justified her “overly dramatic and exaggerated post” by claiming that those who do not wear masks are a “threat against my life”:
I would like to publicly apologize to anyone offended by my recent post regarding the hypocrisy of those who refuse to wear face masks yet walk around openly carrying guns.
I am in a profession where the threat of someone approaching me not wearing a mask while in the midst of a pandemic is equivalent to the threat against my life. Just as it would be if they approached me with their gun drawn and pointed at me.
As a wife, mother and physician, it is my job and responsibility to ‘do no harm’ and the constant barrage of protests and defiance to public health reached a boiling point for me, thus the reason for my overly dramatic and exaggerated post. My words demonstrated how constitutional rights can be misinterpreted, and were meant to serve as an example of extremism.
Bioterrorism is, however, a real threat and refusal to prevent and/or the intentional release or dissemination of biological agents by not wearing a mask during a global pandemic is a clear example. I am sorry if my words were offensive or derogatory in any way. My concern and compassion for human life got the best of me.”
Rager-Kay told PennLive she has no plans to resign from the school board over her comments.

Her fellow school board members have not called for her resignation, but board member Amy Stauffer told PennLive, “as public servants our words are significant and have an impact on others. Threatening words should have consequences.”
School board president Dennis Wolfe said Rager-Kay “should have been more careful with how she expressed her opinion” but believes “her followup explanation reflects that understanding.”
Earlier this week, Rager-Kay posted a follow-up message on her Facebook page, according to PennLive. She described her original post as demonstrating “profound concern of those who refuse to wear a mask” and characterized those who do not wear a mask as have a “lack of love.”
During her failed state house run, Rager-Kay told a local news station that she would work to keep guns out of “improper hands,” including those who “suffer from mental health and addiction.”

If she were a physician, at least a competent physician, she would know that those masks are only a placebo. In 1980, I lived about 450 miles from Mt. Saint Helens when it erupted. Within about a week we had about 5 inches of ash covering everything outside. We all had to wear those masks to filter out all of the volcanic ash that was continuing to fall. Every time we would go back inside and take the masks off, we would always have ash on our faces, under the mask. If the mask won’t even keep out dust sized particles, it certainly won’t keep out germ and microbe sized particles. She says that she wants to keep guns out of the hands of mentally deranged people, and she’s a CCW licensed person… Sounds like she needs to turn her gun in, since she’s willing to kill someone for a trifle. She wants us to wear a mask and is willing to kill us if we don’t. But, quite honestly, she won’t turn her gun in. Democrats don’t give up power. They just try to force their beliefs down our throats — and according to her, she’s willing to kill if we don’t do what “her royal highness” insists that we do. Carl makes several points that I feel need to be addressed since, If the reader believes them, the reader will have the incorrect impression that all masks are not effective to decrease/eliminate exposure to the COVID-19 virus. First, all masks are not equal. A surgical mask, or cloth masks which are open on the sides or bottom and made from coarse material are not effective at capturing the individual virus particles. Those can get in/out through openings and through the fiber mesh. They are effective at capturing large agglomerates of virus like spit or snot which might otherwise be expelled when you cough or breath out quickly. This is why those surgical and cloth masks are somewhat effective and better than not wearing any mask. They may not protect the wearer 100% but they do help prevent the transmission of the virus to people around them. Only PROPERLY WORN N,R, or P masks rated at 95, 99, or 100 (example N95, P100, R99) are truly effective at capturing individual virus particles. If the wearer does not properly maintain the mask, does not properly don the mask, does not properly fit the mask to their face, wears the incorrect size mask (yes, there are different model masks for different face shapes and sizes – you can only tell if you have the correct model mask if you have been fit tested annually), or if the wearer has facial hair or other feature (like a large mole) in the areas where the mask forms a seal to the skin, then the mask will NOT be 100% effective at capturing the virus or other small particles. Again, improperly wearing a mask is still better than wearing no mask to help slow the spread of the virus to the people around you. I have more than 35 years experience in wearing respirators for my job. I have been trained to wear these masks and have had to be fit tested to wear the correct masks at least annually. Plus I have received annual training regarding respiratory protection in addition to training for protection against biohazards such as viruses. Wearing a properly fitted N95 or better mask for long periods of time is uncomfortable, requires training to put on and take off correctly, and will power not to mess with it while you wear it but, it is really effective against viruses and small particles. Sorry Carl.
I also lived nearer to Mt. St. Helens when it erupted (more than once). The ash particles which traveled 450 miles (according to Carl) were the smallest particles since larger ones would have fallen out of the air much closer to the mountain. Those particles that Carl saw were much finer than the ones used in polishing compound and were often sub-micron in particle size. Similar to the COVID-19 virus today, those particles were difficult to filter and contain. I worked in a microelectronics fabrication plant at the time where these nanoparticles would create defects that would destroy the chips. We did keep the facility operating with a lot of effort proving that filters and cleaning do work.
I am a libertarian and a staunch supporter of the 2nd amendment. I own guns. More important, I have quite a bit of ammo since all the guns in the world are almost useless without ammo. I found the tone of the original article and the comments somewhat puzzling since it was bashing a gun owner who was expressing frustration regarding people who could potentially harm her family and her desire to protect them. She was somewhat in-discrete in stating publicly that she wanted to use excessive force (yes, even I believe that shooting anyone who comes within 6 ft because they are not wearing a mask is excessive). In this forum, comments regularly applaud people who shoot other people for breaking into their home or attacking their families. How is protecting your family against threat of bodily harm from exposing them to a potentially lethal virus different than protecting them against a knife wielding intruder? Are we hypocrites to deny a person the right to protect their families because they are a “democrat”? If the article had stated the doctor was a “republican”, I contend that this forum would have said she was just a little “hot headed” and sympathized with her frustration.
COVID-19 is a killer of elderly and people with pre-existing conditions. I have relatives at severe risk of death if they get exposed to COVID-19. One of my relatives has died from COVID-19. While most of us have relatively little to fear from the virus, people do die from it. Just look at the statistics. Twice as many people already dead in the USA so far than the number of gun related deaths in a year. I can sympathize with this woman who wants to protect her family. On an individual basis, it makes sense.
I also understand that shutting down the country because of fear of increasing deaths from COVID-19 is not rational and will cause more economic hardship/indirect harm than the actual virus. As a libertarian, I believe it is a question of individual choice whether to “self isolate”, wear respiratory protection, or practice social distancing. Just because I do, or do not choose to do those things, does not give me the right to impose my beliefs on other people (just because I choose not to social distance, does not give me the right to get within 6 feet of another person and cough, sneeze, or even breath heavily).
Ron, let me help you out with the law because apparently neither you nor Dr. Liberal Fascist “I’ll shoot anybody who comes within 6 feet of me or my family without a mask” has any clue whatsoever about it. Self defense laws in many states focus on the right of citizens to use deadly force to defend themselves when they are facing an imminent or immediate threat of death or serious physical injury. In other words one must know, not speculate, that a person threatens them with death or serious injury before they can use deadly force to protect themselves. In the hypothetical situation
discussed by Dr. Rager-Kay she wouldn’t “know” with any degree of certitude that anyone approaching her was an imminent threat b/c she would have no idea as to whether they had COVID-19 or not. The fact that they aren’t wearing a mask isn’t a threat in and of itself at all. It would be so only if the person indeed had COVID-19. In addition, even if they did have COVID-19 it is doubtful that the threat would constitute a “deadly threat” because the recovery rate from the virus is 99%, and the vast majority of people who have the virus are likely asymptomatic. So legally Dr. Rager-Kay would likely be in violation of the self-defense laws in most states were she to try and employ deadly force against someone who approached her or her family closer than 6 feet without a mask. In addition, as a physician she should be well aware that 6 feet is actually a minimum distance and that the actual threat distance is much greater.
Dr. Rager-Kay is a liberal progressive Democrat. As my good friend Claude Werner says, “Inside every liberal progressive is a fascist totalitarian struggling to get out.” Dr. Rager-Kay is a fascist totalitarian whose goal it is to control the behavior of those around her. Not content to live and let live, she seeks to control others through exercising political power or with her concealed weapon. Instead she should focus her efforts on safeguarding her family, something she presumably DOES have control over. Get them N95 masks and make THEM wear those masks and stop trying to micromanage the small details of others’ lives. And let freedom reign.
A final note to Ron, who shamelessly threw his Bona Fides around to enhance the legitimacy of his opinion, noting that he has 35 years experience wearing respirators and he too lived near Mt Saint Helens. I am well versed and experienced in the law concerning the use of deadly force and the use of deadly force. After a 20+ year career as an operational legal advisor in the Army, to include assignments in Special Forces and with the nations most elite Special Mission Unit, as well as numerous deployments to overseas combat zones, I work in law enforcement as a sworn officer and legal advisor. I am a POST certified firearms instructor, EVOC instructor and General Instructor. I teach the use of force, including deadly force, to law enforcement personnel as well as non-sworn citizens. As an attorney, Soldier and sworn law enforcement I am familiar with both the law of self defense and deadly force as well as the tactical and practical aspects of using force in self defense. Dr Rager-Kay is simply ignorant and well outside her area of knowledge and expertise, although as an American she is perfectly entitled to her opinion, wrong and ill conceived though it may be. Her so called “apology” is clear evidence that she doesn’t merit anyone defending her fascist and dangerous comments. In fact Ron should be calling on her to be investigated as someone who is dangerous and ought not to have a concealed carry permit rather than engaging in justification and rationalization on her behalf.
Whiskey10, I appreciate your response regarding the legal aspects of whether coming in contact with COVID-19 could constitute enough of a threat to justify deadly force. I do not believe that I ever stated that I condoned the doctors statements other than to show sympathy with her desire to protect her family from exposure. Yes, putting her family in properly fitted respiratory protection and using proper hygiene to control exposure is the most effective solution (that is the one that I use – in spite of what the WHO says). Protecting yourself with the proper equipment, training, and knowledge is the best solution for many problems, including home break-ins and potentially lethal virus exposure. I am not a medical doctor, or a microbiologist who studies viruses. I have done quite a bit of research and have studied the literature regarding viral exposure as well as the statistics regarding illness and death rates. I have had quite a few discussions with nurses and doctors who are directly involved with and treating COVID-19 patients in general hospital and intensive care units. Your blanket statements regarding “safe distances”, and recovery rates and the number who are asymptomatic are open to debate/discussion (which I like to do with intelligent people such as yourself – but perhaps in a different forum). I actually agree that Dr. Ragar-Kay should have exercised more judgement in her statements, especially since she is in a position of some authority as a school board member and a physician. i believe the same thing could be said of Donald Trump (whom I support) or many other politicians. I do not know the Doctor at all. Nor do I know the area in which she practices. If her practice includes people who have tested positive for COVID-19 then she may have more expertise and experience than she has been given credit for. My statement of my bona fides was in response to the original post by Carl who stated that respiratory protection does not work and used the Mt. St. Helens eruption as anecdotal proof that respirators/filters do not work. Promulgating that misconception can lead the readers of this forum to come to false conclusions and potentially endanger their lives. Anyone can make statements in these forums. By stating my background, I hoped that readers could make a better assessment as to who to place more faith in with regard to respiratory protection. That does not substitute for doing their own research but, many people do not take the time to fully research topics anyway.

Anyone with any knowledge of self defense knows you NEVER shoot to kill; you shoot to stop the threat. If the threat dies in the process, so be it. And there are certainly other ways to defend yourself than shooting. Maybe you didn’t know that.
By the way, my state doesn’t require me to “turn and walk away”, no matter what I my be feeling. Keeping people I don’t know six feet away from me doesn’t seem like all that unreasonable an action to take, covid or no covid.

The nutjob in the article DID NOT make a sound claim to a “constitutional right” of self-defense. Shooting someone you IMAGINE poses a threat is not a “right,” it’s murder. (See my other post on this matter.)
You go ahead and shoot someone who merely comes too close to you or your family and see how the local prosecutor feels about that. Shooting someone who does not pose an immediate threat of death or grievous bodily harm, or who does not instill a REASONABLE fear of same, is NOT self-defense – it’s murder. If you shoot someone who you DON’T KNOW is infected, a court will consider your fear UNREASONABLE. If you shoot someone KNOWN to be infected, good luck convincing a jury that your fear was reasonable. But you will go to trial, guaranteed.
I sincerely hope you aren’t a gun owner. If you are, you need to educate yourself on the law of self-defense for your own good. Otherwise you may end up in prison someday, and it will probably be exactly where you belong. I suggest reading Andrew Branca’s book “The Law of Self Defense.”

I find it interesting the you, like Stan, immediately jump to shooting someone as the only form of self defense. I said I would defend myself. I never said shoot.
I suppose you missed the part about giving ample warnings. Completely ignoring any possibility of any virus, a person who insists on advancing after being warned off, is either deranged or a threat. You decide which.

I find it interesting that Anti Gun Advocate Jennifer Rager-Kay is threatening to shoot anyone who come near her without a mask. Basically, she is claiming she has the right to kill innocent people for just sharing the same PUBLIC area she is in. This type of comment indicates this woman is mentally unstable and should have her carry permit recalled and guns confiscated. Why does she even have a carry permit if she advocates gun control? Perhaps she feels it’s her right to protect herself, but others may not protect themselves from her.
This is why liberals are nearly all anti-gun – they feel compelled to control people because they believe they believe that all people are as unstable and irresponsible as they are themselves. It’s called “projection.”

Her obvious hysteria and ill-logic is that anyone without a mask is a bio terrorist and will kill her and her family if they are allowed to approach within 6 feet. Any rational person who is that concerned about their safety would remove themselves from the situation, not threaten to shoot. Our constitutional right is to express our concerns about a variety of things through social discourse and even vigorous demonstration. Her rights are the same. But neither position has the right to shoot the other or become physical.
Her response and afterthoughts are fraught with red flags, not the least of which is to consider murder as a solution. I don’t believe a red flag law is the answer, but where are all those Democrats that do? By definition they should be calling for her to give up her gun. But no. I see this happening more and more. We have become so politically divided I fear for our country.
And then there is the fact that she is on a school board. Where she can inject her bizarre and warped sensibility and politics in to the school system. Consider that this is happening across the country and what effect it has on our children.
And I don’t see any incongruity in the anti-lock down protesters position on gun rights. And how does she know what their position is on gun rights? If anything, they are consistent in their desire to have their constitutional rights respected. As do I.
Brett, you’re right. That was a bad example that I used. Maybe I’m wrong, but I think to qualify as threatening an act of violence, it has to be more specific. The point I was trying to make, is that people on this site quite frequently make statements of “what they would do” in any given situation, and no one jumps up to suggest charging them. But it seems in this case, that happened simply because of who she is.
If what she did was illegal, she should be charged. Because she committed a crime, not because of who she is.
