The Second Amendment Foundation (SAF) is gearing up to promptly contest any federal “assault weapons” ban, spearheaded by Sen. Charles Schumer (D-NY), if it successfully passes into law.
In a swift response to the revival of bill S. 25 by the late Sen. Dianne Feinstein (D-CA), which hit a roadblock due to Republican opposition this week, SAF has made it clear that any maneuvers by Schumer to advance the legislation will be met with legal challenges.
Alan M. Gottlieb, SAF founder and Executive Vice President, affirmed their readiness to fight back.
“We’re already tackling eight state law challenges related to modern semiautomatic rifles, and we’re set to confront a federal ban head-on if it gets the green light.”
“If Schumer tries to run it as an amendment to another bill, or move it via the regular process, we will take action,” said Gottlieb.
Adam Kraut, SAF Executive Director, emphasized that not only would such a ban clash with constitutional rights, but it also lacks evidence to prove its efficacy in preventing violent crimes, including mass shootings.
“We have eight pending challenges to state laws banning modern semiautomatic rifles, and we absolutely will challenge a federal ban should one pass,” said Kraut.
“Aside from the fact that such a ban would be unconstitutional, there is no conclusive research showing that such a ban would actually prevent violent crimes, including mass shootings,” he added.

The organization highlighted the case of Bianchi v. Frosh, which challenges Maryland’s ban and, after the landmark 2022 Bruen decision, is awaiting further proceedings from the 4th U.S. Circuit Court of Appeals.
This development signals that the Supreme Court is poised to scrutinize the constitutionality of such bans.

We must stand with the American people and with families sick of living under the threat of gun violence.
Gottlieb criticized Schumer’s longstanding crusade against firearms, suggesting that a ban would merely be a hollow victory for Schumer and President Joe Biden, with little impact on curbing violent crime.
He pointed out that a Rand review echoed this sentiment, calling findings from the 1994 to 2004 semi-auto ban “inconclusive” regarding its effect on mass shootings, a stance supported by fact-checkers against President Biden’s claims.
In a poignant conclusion, Kraut argued that while the misuse of firearms is a serious issue, penalizing law-abiding citizens who exercise their Second Amendment rights will not prevent such tragedies.
“The misuse of firearms against innocent victims is both an outrage and a tragedy,” Kraut said, “but criminalizing the possession of commonly-owned firearms will not prevent such incidents, and instead only penalize peaceable citizens whose only crime is exercising their rights under the Second Amendment.”
The SAF remains steadfast in its commitment to safeguarding these rights against these ineffective legislative measures.

I cannot believe that any American can truly think this is an answer to crime when they won’t even prosecute it and they let out mass amounts of criminal’s all the time. I never ever hear a Democrat mention prosecuting crime and keeping those criminals locked up with the thousands of already written laws on the books. We don’t need more laws especially to disarm law abiding citizens we just need the existing laws enforced. Democrats (Communists) are not willing to do this because they are for tearing down our freedoms and liberty by creating anarchy, and tearing down American Society. With America tore down the rest of the world is in trouble. This is the Democrat’s dream!
