In a decision this week, Harney County Judge Robert Raschio declared Oregon’s Measure 114 as “facially unconstitutional,” citing “clear and convincing evidence.”
This ruling has set off a wave of reactions across the state, with gun rights advocates celebrating the decision as a victory for liberty.
The Oregon Firearms Federation (OFF) expressed profound gratitude towards Tyler Smith and Associates and attorney Tony Aiello, who, supported by Gun Owners of America, successfully challenged the measure against Oregon State lawyers.

The OFF praised Judge Raschio for his “brave stand” amidst what they describe as an assault on gun rights by “Oregon’s establishment Leftists.”
This verdict, however, is not seen as the end of the legal battle. According to ABC 2, the state has announced it will appeal the ruling, a move expected to incur significant costs for Oregon taxpayers.
Furthermore, the OFF highlighted potential bias in the Oregon Appeals Court, specifically calling out Judge Jim Egan for his alleged derogatory remarks about gun owners.

Measure 114 was initially passed by a razor-thin majority with the intent of imposing stricter gun-control measures in the state. Such as:
- The creation of a permit-to-purchase (PtP) scheme
- Bans of magazines with a capacity greater than 10 rounds
- And a requirement that background checks be completed prior to the transfer of any firearm in the state, closing the so-called “Charleston Loophole.”
This decision at the state level currently halts the implementation of Measure 114, despite a separate federal court ruling that upheld the measure under federal law. That federal case remains in the appeals process.
As the legal proceedings continue, the OFF remains vigilant, affirming their commitment to the fight for gun rights in Oregon.

Oregon, or any state for that matter, should not be allowed to use taxpayer money for fighting taxpayers when their Constitutional rights are being infringed by the state!
