Big news hit the 2A community on Sunday: Kash Patel is likely to serve as interim ATF Director while Attorney General Pam Bondi restructures the agency.
This development has left Second Amendment supporters both hopeful and cautious. Washington Gun Law President, William Kirk, broke down the potential impact in his latest analysis.
Why This Matters
Kash Patel’s appointment could signal significant changes at the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
Known for his stance on individual liberties and skepticism of government overreach, Patel’s leadership could shift the ATF’s approach to firearm regulations.
The Good News for Gun Owners
According to William Kirk, Patel’s track record suggests he will fight to protect 2A rights. His leadership style aligns with a more limited government approach, which may reduce regulatory burdens on law-abiding gun owners.
Kirk emphasized, “If ever there was a person that was willing to take a chainsaw or a blowtorch to a federal agency, well, Kash Patel has certainly made his mark talking about just that.”
Potential Concerns
While some in the 2A community are excited, others are cautious. Kirk noted that the ATF won’t be abolished, but will likely undergo significant restructuring.
He explained, “Do I believe that they’re going to abolish the ATF?… Hell no, I do not believe that they are going to abolish the ATF.”
But the changes could involve breaking the agency into smaller parts, making it harder to reassemble in its current form.

“What I have a very strong belief that they will be doing is dismantling it… breaking the ATF up into several subcomponents… in a way where legally and structurally it would take decades to actually piece the old version of the ATF back together,” he said.
However, the biggest worry is the possibility of the ATF being folded into the FBI, where Patel currently serves as Director.
Kirk warned, “Placing the ATF under the FBI’s control could set a dangerous precedent, especially if political leadership changes in the future.”
What’s Next?
Kirk predicts that during Patel’s tenure, the ATF will be restructured and possibly weakened in its ability to regulate lawful gun owners.
Once the restructuring is complete, Patel is expected to step down, returning to his role as FBI Director, with a new, yet-to-be-named ATF Director taking over.

EVERY regulation issued by the ATF is unconstitutional, and needs to be revoked. They do not have the right to, in effect, write laws.
I’ve been a gun collector, former FFL, and a die-hard supporter of the 2nd amendment since the 70’s. As a level 4 life/golden eagle member of the NRA, I supported that organization even when that a$$hole LaPierre and his cronies practically ran it into the ground.
All I’ve heard for decades from the anti-2nd amendment left-wing nutbags is we need more gun control. More gun laws, especially from the left-wing BATF. I have a suggestion. Try enforcing the laws that are already on the books. Close the revolving-door justice system. If a crime is committed with a firearm – add an additional 5 years on top of their sentence with NO early parole. If they hurt someone – 10 years. If they kill someone – life without parole, or the death penalty. These BLM street thug teens that we read about every night shooting and killing in the ‘hood’ – lock their dumbasses up on the first offense and don’t let them out for 10 years. Yes, we’ll need more prisons.
What we DON’T need is the BATF and the FBI in co-hoot with each other. The government bureaucracy is bad enough as it is. Matter of fact, just abolish the ATF and enforce the gun laws we already have. At the VERY least – enforce the 3 strikes laws, nationwide.
The ATF should be abolished yesterday. No politician, including Trump is going to do the right thing. Trump filled the swamp the first time and he’s filling the swamp this time.
In My Opinion: The firearms portion of the BATF should be abolished completely. Here’s why:
2nd Amendment: “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”
What part of “shall not be infringed” don’t the politicians understand?
Points:
1. If you have to ask permission to buy any kind of arm (weapon), your right to keep and bear arms has been infringed.
2. If they can tell you what type of weapon you can buy, your right to keep and bear arms has been infringed.
3. If they can tell you where or how you can carry your weapon, your right to keep and bear arms has been infringed.
4. If they can tell you what kind of ammunition you can have for your weapon, your right to keep and bear arms has been infringed.
5. If they can tell you how many weapons you can have or purchase, your right to keep and bear arms has been infringed.
6. “Arms” does not just mean “firearms”! All weapons that are light enough for a normal person to carry (bear) no matter what kind, are covered under the banner of “arms” and prohibiting or making conditional on government approval of any of them is an infringement on your right to keep and bear arms.
That’s what I think the second amendment means.
