New Jersey native Danny Burt inherited his grandfather’s M1 carbine in 2006. Burt’s grandfathered served in WWII, so the iconic rifle meant a lot to the Cumberland County resident.
In April 2013, Burt’s entire gun collection — including the M1 carbine and 20 other firearms — was confiscated by the New Jersey State Police after a temporary restraining order was filed against him.
A month later, the restraining order was dropped. When Burt, who had no criminal history, attempted to reclaim his firearms, the court ruled that “the M-1 carbine is an illegal weapon and is therefore improper to possess.”
“Burt claimed the rifle had considerable sentimental value to him, and that he had no knowledge as to whether the gun was operable,” the decision states.
While the court offered its sympathy, it iterated that not only was the weapon “contraband” but since it’s a second-degree felony to possess the rifle in the first place, the court granted the prosecutor’s request to force Burt to forfeit his entire gun collection as well as his firearms purchaser’s identification card.

Here, of course, plaintiff had not one but two hearings in which he stipulated to a statutory basis for forfeiture, namely his possession of an illegal assault firearm, the M1 carbine, resulting in a judicial finding disqualifying him from gun ownership in New Jersey and revoking his firearms purchaser identification card. Possession of an assault firearm is a second-degree crime under N.J.S.A. 2C:39-5f.
As the prosecutor correctly asserts, “the weapon is contraband [which] can never be returned to [Burt].” Accordingly, because Burt has had a weapon seized as a result of a domestic violence complaint that has not and can never be lawfully returned to him, he is subject to the specific disability under the Gun Control Law contained in N.J.S.A. 2C:58-3c(8).

He was cleared of any domestic violence issues but upon inspection of the gun collection he owned a banned weapon the M1 Carbine. In New Jersey, this is a second degree felony to own this gun. Once he admitted to and was found guilty of owning that gun, he was guily of a second degree felony and thus lost his New Jersey Firearms Identification Card. He can no longer own amy firearms in New Jersey. His collection is confiscated since he cannot own them. If he had a family member he could get the guns returned to them. My brother ran into this problem and yes the police want to keep the guns to sell and then keep the money. I was able to get the NJ county prosecutor to get his guns tranferred to me as wisely we all in the family had NJ Firearms ID cards. Police were not happy as I came into their evidence room and took back my brothers guns. Many of these were left to him by my father so I wasn’t about to let this happen. Thankfully I live in an adjacent county away from those local cops as they were not happy and I could expect future harassment. The M1 carbine does not belong on this list as the list was created by past Governor Jim Florio who was out to destroy all gun ownership in NJ.

In the Declaration of Independence, we are told We, the People, have the right and the responsibility to restore sensible and responsible government. As is obvious by the subsequent actions of the writers, we are not limited to the means when the government becomes out of control. And many of us have taken what amounts to a blood oath to protect and defend the Constitution of the United States against all enemies both foreign and domestic. What are the true responsibilities associated with the meanings of these statements?
I do not know the acceptable answer to our problems and I do not know the proper method for causing the appropriate answer to be implemented. Violence will probably not work as the crooked system can not be changed to he extent necessary through violence. But, I do know that as long as crooked people are appointed as bureaucrats or elected and re-elected in a crooked system, we, the people, can expect no improvement. I also know that, as long as the federal government continually violates our rights without any legal recourse or punishment, the future will not differ positively from the present and nothing will change for the better.
How did we get here? Improper upbringing of the past generation comes to mind. So does contempt for proper values and respect for those who provided what came before. And, importation of those who do not hold the same values does play an important part as it will result in continuation and worsening of the unacceptable downward destructive spiral.
Many problems must be solved and those problems can not be addressed or solved by people whose income and position relies upon maintaining or continuing the spiral downwards. In our recent past, some politicians asked if we are better off economically today than we were previously. Is that all we have become – a society where physical commodities are more important than the moral principles associated with maintaining the rights that have been earned by those before us? Is that all we taught our children to believe? Perhaps we are guilty of this false teaching, and perhaps we are reaping the results.
Like I said, I do not know everything. One thing I do know: we can not have what we previously had if we are unwilling to demand that the federal government uphold the requirement that the federal employees, the state governments and employees, and local governments and employees AT ALL LEVELS and IN ALL BRANCHES abide by the US Constitution and recognize the validity of the complaints given in the Declaration of Independence.
If the governments and government employees at all levels will not willfully and of their own accord abide by the US Constitution and recognize the validity of the complaints within the Declaration of Independence, they are as guilty of treason as any other enemy – either foreign or domestic. And, I do not see a difference between the so-called intelligence agencies (which violate our “wiretap laws” or privacy), or the thugs who compromise or way of life by taking bribes or telling us they we can not know what is in a “Bill” without voting to pass it, or the various so-called justice department employees who invoke civil asset forfeiture, or judges who tell police that it is ok to kill, harm, or violate citizens when it is the policeman (or the judge) who has violated everything this country actually is supposed to stand for. I believe those people are guilty of treason against We, the People.
Clearly, the situation has become unacceptable. It will probably get worse and may not ever get better. Perhaps no one is wise enough to know how to fix the problems. Or, perhaps those who could solve the problems or at least move in the direction of solving the problems are in fear of their lives as they would be going directly against an unprincipled bunch of thugs who will (and probably have) killed to maintain their power and position.
I love my country. I regard the Declaration of Independence and the US Constitution as evidence of the maturing of man’s mind that required many, many years to attain the levels necessary for such documents to come into existence. I am saddened that such progression is negated by a bunch of thugs. Perhaps this is the natural expectation given that man, as a whole, is not good by inclination and false spirits abundantly roam loose. Perhaps, but I prefer to think that a Righteous and Holy Lord God in Heaven can straighten our path by raising up and empowering those among us who can and will do what is required. The necessary fixes will not occur any other way.
If the gun was issued in WW2 I gotta ask did it have full auto ability? I had a friend who’s father had one brought back from that war and it had full auto capability which we really enjoyed as teens of the 1960’s.
M1 carbines were/are semi-auto only. They were never a full-auto or select fire weapon.
The M2 carbine , a later model of the M1, was issued in late WW2 and widely used in Korea. It was full auto.
M16 carbines is not full auto. The m2 has a selector switch to turn on full auto. We used both WW2 guns I’m Viet nam, another question is how did the gun get to the US. Thousands of these gun are I’m Korea that could have been sold in us to pubic and Obama stopped that. These are collector guns made me.by GM and other companies only for the war time one time the NRA sold them to public for $25.

Each and every one of us has to do as we see fit in almost every thing we do, thus it’s my rule that I never go too or thru a state that has restrictive gun laws, I don’t spend my money there. I do have a problem at times if I’m buying something online that comes from such a state and I will shop around in hopes of finding somebody in a free state to do business with.

In Maryland we believe that our legislature should determine who should be allowed to possess or carry certain firearms in our state, and the idea of out of state people overruling our laws makes us quite nervous. So, although we would love to have you visit, please don’t bring a controlled gun.

I couldn’t agree more,and actually find it relatively easy to avoid purchases in anti patriotic states. I departed the communist State of NJ in 2015 for Florida with my collection in tow and never looked back. Obviously, once in Florida some upgrading of the fun stuff was in order.

@D.Baillie, just getting a domestic violence charge lodged against him isn’t a reason to ban his gun ownership. Some women to get even with a man breaking up with them file charges of domestic violence.
He had a temporary protection order placed against him. It wasn’t found to be valid by the court wasn’t renewed into a permanent one.
North Carolina does similar, and this is supposedly a gun friendly state.
I knew a man who got into an argument with his wife. He never physically threatened her. Next day she reports the argument as him threatening her and files a complaint.
She tells the magistrate she is afraid. The courts takes his firearms.
She drops the charges, admitting she exaggerated the complaint, but he doesn’t get his firearms back.
In the process he leaves her because of her actions.
I could tell y’all 3 or 4 stories of acquaintances I know where the girlfriends or wives filed false charges against their boyfriend or husband, and the courts fully sided with the women. Not necessarily that firearms or abuse was involed, but rather there was profit to be made.
One of the saddest cases I know a wife had affairs and children outside her marriage, she was caught red handed, and the testing proved the children weren’t his.
He lost his house and family farm, including the farm equipment to her. He was also ordered to sell his firearms. Then he had to make support payments on top of that.
He done the right thing in response though. He eventually quit working anywhere because he could never make anything for himself.
BTW, the ex wife was related to the judge, a cousin. Other judges were sympathetic to her also.
There goes the life of a farmer employee who worked hard trying to make a life. A once productive person forced into becoming a bum. Or driven to it.

I used to do child abuse investigations – in 100% of the cases I had assigned to me and there was a divorce in process or pending, the female made fraudulent accusations against the male. The sad thing is that local law enforcement/courts refused to deal with the unfounded accusations every time and ALWAYS awarded the majority of the custody to the female. I am certainly glad to see that there are groups and attorneys addressing this blatant discrimination now.
I don’t believe that all domestic violence complaints are necessarily true. Since he was never charged or convicted, it’s most likely this was a domestic dispute, not an assault, and the spouse may have over-reacted. However, abuser of not, the big problem for people who aren’t abusers is that NJ considers an historic semi-automatic weapon that was (is still on the few occasions they get any) sold by the CMP, and qualifies as a Curio and Relic Firearm under a Type 03 FFL, to be a so-called “assault weapon.” Now, maybe he had the automatic version, but the Guy’s list only says M1 Carbine, which includes the semi-auto version. Another good reason to avoid NJ altogether, even if I have to drive out of the way through PA to get to MA for a class reunion, or any part of NY. Now if only I could afford to move out of the DPRM (Democratic Peoples Republic of Maryland).
If it was a selective fire M2 Carbine the control freaks would have had him in federal court where possession of a full auto weapon is 10 years mandatory.

Mahatma, you make a couple of valid points, but overall you’re post doesn’t cut it. It can be understood that there are exceptions to everything, even when a statement appears to be all inclusive. I always state, adding, No Exceptions when I actually mean everyone. Other exceptions should be understood, even in statements referring to a whole, in general.

Women will often use a “domestic violence” complaint to get their way or get revenge for some imagined slight. Remember that in today’s era of whinyness and stupidity, “domestic violence” often includes non-verbal types of abuse and can be loosely interpreted. Courts these days are often run by either feminazis, or by castrated liberal “male” judges who have been brainwashed and browbeaten into submission by feminazis. I found out too late, for example, that my (now ex) wife only married me because she wanted children – she was jealous of her two older sisters who already had kids. Once she had the kids she wanted, she lied and claimed I had “emotionally abused her” in order to get the cops to show up and remove me from our home. It eventually came out in court that SHE, in fact, had abused ME. Sadly, the judge still had feminazi leanings and granted her custody of our kids and now I am being raped for child support because, the judge said, “the mother in most cases is generally the more nurturing parent”. Since then she has twice tried to use dirty tricks, including trumped-up child abuse accusations, to remove what custody and parenting time I still have (she was even found to be in contempt of court on one occasion); after the second such attempt at having me charged with child abuse, she was given a very stern talking-to by child protective services (among other things, when CPS interviewed my kids, each of them had a $5 bill in their hands!). My ex has been much more circumspect since then, but I have to walk on eggshells for another 9 years until my youngest graduates from high school, so that my ex doesn’t have a leg to stand on for any accusations. I trust her about as much as I would trust Kim Jong Un if he said “I’ve dismantled all my nukes”.

All Citizens have a Right to a trial by Jury, or can elect to have a trial by judge!
There are legal procedures the government must follow to just to get to trial these are constitutional protections, that we all are supposed to enjoy!
If Burt’s case had gone to trial, the government has to prove their case beyond a reasonable doubt, that Burt was guilty!…………
The problem is Burt’s case never got to Trial……
Because; the government lacked the evidence to prove he was guilty.
The Government dropped the case.
Quite frankly the Courts specifically the Supreme Court Of The United States, has dropped the ball on this subject and on our Constitutional Protections, from a Tyrannical Government, In the Commonwealth of New Jersey.
The fact is Burt is innocent of all charges, Burt should be able to sue the Commonwealth of new Jersey for defaming him, he should also have his firearms returned to him.
But the bigger picture is these laws, are Unconstitutional, Look at Burt’s case he is accused, his property is seized,

North Carolina does similar, and this is supposedly a gun friendly state.
I knew a man who got into an argument with his wife. He never physically threatened her. Next day she reports the argument as him threatening her and files a complaint.
She tells the magistrate she is afraid. The courts takes his firearms.
She drops the charges, admitting she exaggerated the complaint, but he doesn’t get his firearms back.
In the process he leaves her because of her actions.
I could tell y’all 3 or 4 stories of acquaintances I know where the girlfriends or wives filed false charges against their boyfriend or husband, and the courts fully sided with the women. Not necessarily that firearms or abuse was involed, but rather there was profit to be made.
One of the saddest cases I know a wife had affairs and children outside her marriage, she was caught red handed, and the testing proved the children weren’t his.
He lost his house and family farm, including the farm equipment to her. He was also ordered to sell his firearms. Then he had to make support payments on top of that.
He done the right thing in response though. He eventually quit working anywhere because he could never make anything for himself.
BTW, the ex wife was related to the judge, a cousin. Other judges were sympathetic to her also.
There goes the life of a farmer employee who worked hard trying to make a life. A once productive person forced into becoming a bum. Or driven to it.
Much more to that story, but it shows life belongs to the cheaters and liars, and the decent people pays for it.

1.) Just because a complaint was filed doesn’t mean it was justified. During my divorce my ex-wife claimed she was threatened by me when I sent her a bouquet of flowers in a failed attempt to reconcile our marriage.
2.) There should be no linkage between domestic violence (not a felony) and firearm ownership. Firearms are a Constitutional Right.
Understand that women file 85% of divorces in this country and use firearm ownership against men as leverage during the divorce.
I as any Man would not ever beat or mistreat a woman or anyone else for that mater. Having said that , I give an exception, self defense against a physical attack from anyone is a given.. The laws on domestic abuse are way to tight and people are being punished for so call abuse . We absolutely do not need a federal law on such cases.

Any New Jersey resident knows that NJ has onerous gun laws. If one possesses a “controversial” firearm in NJ, one must never let it see the light of day, unless and until he takes up residence in another state. It is also well-known that, if you have a Restraining Order against you or even an ACCUSATION of Domestic Violence, the cops will seize ALL your guns without a court order, and this applies to most ALL states, not just NJ. If it’s likely that any such thing will come your way, you must store your weapons collection ELSEWHERE than at your house, or Forfeit. It sucks, but Reality will be in your face if you do not prepare adequately.
Once more NJ shows its hand. Keep in mind that Chris Christie thinks New Jersey gun laws are “about perfect”. Any one thinking of supporting Christie, is out to destroy liberty. Christie needs to pardon everyone convicted and imprisoned for these silly gun crimes. We know he wont. He had a chance a few years ago, when a new resident was arrested and convicted after he tried to register his guns. Christie let him out of prison and left his felony conviction intact. NJ is a premiere example of what is wrong in America – and American politics.

No authoritative definition of an assault weapon or assault rifle includes an M1 Carbine, not by DOD, ATF or any military in the world. An M1 carbine as manufactured is incapable of fulfilling the tasks of an assault weapon. The cartridge used itself is incapable of intended ballistic performance, it is semi-automatic instead of select fire or fully automatic. It is not capable of sustained offensive or suppressive missions for assault forces.
This is simply a matter combining willful ignorance and dishonesty in arbitrarily deciding which firearms the court will allow and which ones it won’t without justification.
In light of the total actions of the court, the firearms returned to the plaintiff I believe this decision violates the Second Amendment and should be rebutted and fought in the courts. I hope the NRA and other gun rights organizations will offer material support to this man who has been victimized by the state of New Jersey.
Lesson #1 from this abuse of individual rights – If you voluntarily live in a state that is widely known for the abuse of individual rights, don’t be surprised when yours are also.

Brass I agree with you in that if this is a M1 carbine it is a semi- auto case closed not an assault rifle few were made full auto only but unlikely this is one. I believe the problem here is the Restraining order and the fact that the rifle is a “stolen gun” verified by his father. Since the Prosecutor is being hardline and has his state behind him add to it a domestic flag to the case it is an uphill case. I wouldn’t live in NJ or NY or other states that trample on gun rights. But the father like it or not kept his $48 rifle, Christ he earned it but under the law it was stolen property. At the very least the collection should be return since the RO is now resented and at the very least considering the sentimental valve at least decommission the rifle as the owner didn’t shoot it and give it back. That at the minimum .

Seems to be happening more and more. The governments have nothing really to compensate so they use various laws to just seize without recompense. Sorry, but in many police departments and agencies it has become something of racket.
Each Police dept. or State in so cases have a policy in place that all guns after X number of years get destroyed I have seen some really fine guns gone because of this. Now with that said if that is a full auto and they sell it at auction to me that is a conflict of interest as they are profiting. In my experience as a collector they destroy the weapons.

As a C&R collector a couple of things are interesting here. They should have researched NJ gun laws the fact is its considered stolen by the Gov and confirmed by the father. In the case of that gun it should have “never existed” from the time it came back from the war. eventually in time it becomes traded in the C&R trade with no way of tracing it.
As far as the restraining order and going through 2 divorces you can’t just get one without documentation of police reports or some actions. Not to say some women can help it along but as gun owners we have to be aware of our actions at all time. If a RO was ever pulled on me for “no reason” I know what would be happening to my collection and I would have an attorney all over that that day. Nobody here knows the whole story and to say the order was trumped up or not is guessing

I’m a little confused by the courts definition of a M1 as an assault rifle. The M1 is a semi-auto, gas operated magazine fed rifle with a garand style action, it’s a conventional styled rifle with a full stock and an 18″ barrel. Really no different in design to a Ruger Mini-14. Now unless this particular rifle was not actually an M1 but instead a select fire M2 then I don’t see the problem but I’m not completely familiar with NJ laws so I don’t know if a Ruger Mini14 is legal there.
Either way it’s complete bullshit to confiscate his entire collection and remove his 2nd amendment rights over what seems to be a misunderstanding of the laws and misclassification of the rifle.
I would run this past the BATF for a review of the classification of the rifle but if Mini14’s are legal then no reason an M1 isn’t. Also Citadel makes a .22lr rifle design as a look a like for the M1, is that rifle illegal inNJ?
Since I live across the river from NJ I have heard some silly laws, like only Law Enforcement can carry hollow points, which brings me to the point. The NJ law makers who don’t know anything about ballistics should not be able to enact laws regarding firearms, not to mention it being an infringement on the Constitution. NJ judges should not be allowed to rule on cases they do not understand.

I was wondering when this would happen, I had thought perhaps California would be the fist to try this ploy. You see, and if you remember Obama stated that “military weapons have no business on the streets.” I am not surprised that this court has declared an M1 carbine can be defined as one of the evil assault rifles. But then, using Obamas logic and if you know your history of military rifles, you’d know that at any point in the history of military rifles … ALL RIFLES, be they muzzle loaders, trap door, lever actions, bolt actions, semi automatic loaders or fully automatic rifles have been employed by some military, somewhere. Ergo all rifles fit that criteria of being assault rifles at some point in time. Even the lowly Ruger 10/22 could be by that definition, an assault rifle it is after all a semi-auto just like the M1 Carbine and the AR 15.

The fact that a Republican can be elected is an amazing feat there. Believe me, I know. I live in the neighboring DPRM (Democratic Peoples Republic of Maryland). I paid $103 and change for a Handgun Qualification License (HQL) for the privilege of buying a handgun and STILL have to wait 8 days before I can pick it up. As far as I can tell, even a C&R handgun is subject to DPRM state law.

It not only solves nothing, it makes you an unwitting ally of the very enemies of freedom you so detest. Why? It’s pretty simple really. If enough states’ totally draconian laws are allowed to stand, it’s only a matter of time before they come to YOUR state. Granted, it may be quite a few years down the road, and by that time they may or may not affect YOU. But they WILL affect your children and grandchildren. In other words, while you may have won the battle where you live for now, the enemy will win the war!

Thank you for some common sense amongst those that just do not understand running from the problem is as anti 2nd Amendment as the existing laws in the aforementioned states. I’ve been inactive and uncharacteristically quiet for quite some time on the internet in general as it seems people in for the most part would rather insult each other than to unite over the issue of the 2nd Amendment. (actually on nearly every topic) But this topic and it’s comments struck that nerve.
I find it difficult to comprehend the thought process of the vast majority of so-called pro 2nd Amendment rights people. The fact is we should be taking action as a whole, all gun owners actually uniting, pressuring our/their Representatives, donating money not toward the status quo NRA (if you want to keep your membership, no qualms here) but rather a group like NAGR, or similar group that does not have other agendas and who will not negotiate away our 2nd Amendment Rights, (yes, the NRA has repeatedly caved on 2nd Amendment policy) and we would be the most powerful, influential Pro 2nd Amendment group since Patrick Henry, Alexander Hamilton, Samuel Adams, James Madison, George Mason and Noah Webster. Unfortunately, we have ten’s of thousands of people telling each other what they should do, and doing nothing themselves. It is bad enough to give horrible off-the-cuff advice, like telling people to “move out of states without favorable 2nd Amendment laws” when it is the worse thing a Pro 2nd Amendment believer can do! That would mean the powers-that-be who want these ridiculous interpetations of the 2nd Amendment will have won that battle! STAY AND FIGHT! Be active, at minimum contact your representatives, if possible attend Rallies, start or join a Pro 2nd Amendment type club, donate money to a PRO 2ND AMENDMENT action committee or lobbyist group.
We are also unfortunately one of the worse groups for having people stating others should be doing “something” about the rules, laws, etc. while the extent of their own activities consist of telling others they should be doing something… I read 50 of these types of comments a day, in reply I used to ask them what they personally have done. Naturally the majority fire back what have you done, or more often, a string of profanity… But I tell them what I have done, I write my Representatives here in WI and in Washington (during the threat of background check changes that would have done nothing to curb criminals from using guns I apparently wrote a bit too often, until two of them requested I stop). I donate about 30% of my income to Pro 2nd Amendment lobbyist and political action committees, I attended protests, including at the Minnesota Capitol steps as one of about 25 pro-2nd Amendment people amongst a sea of anti-gun nuts. I am a member of our local Rod and Gun Club, Izaak Walton League, and the U.S. Sportsmen`s Alliance, I participate in a local group who seeks hunting privileges for Youth Hunts from landowners…
Now do I believe everyone should go to my extreme? No, most cannot do as I do. But…. If those people would instead of commenting aimlessly and derogatively, and oft uselessly, would each write or call their Representatives the entire fight for the 2nd Amendment would swing the other way, and law abiding, gun owning citizens would not be the ones worried about losing their guns!

I had a buddy of mine do just that and he came back to New England because there weren’t any decent jobs. He is single and the most pro gun guy you’d ever want to meet. It didn’t work out for him he was so sick of our lousy state he quit his job and left. Now he regrets it. He also sold most of his guns to make ends meet.

How good can the job be, when you risk your life and freedom every day for having it?
How good can the schools be, when they are used to bring up generations of children who grow into people who would demand that freedom and property be taken away of unpopular minorities?
Get some perspective. You stand and fight where a battle can be won — places where Fascism has already won are not the places to stand.
Hundreds of thousands of people did exactly that to get here, over the course of our history, when conditions in their own countries, for one reason or another, including infringements upon basic rights, became intolerable. Why is the thought of simply moving to another state so objectionable? Maybe our forebears were made of sterner stuff.
Right on. I grew up in Northern NJ and harbor fond memories of my years there. However, I moved away when the “assault weapon” law was passed in 1990. I then moved to Connecticut and when they too started getting wacky I finally moved to Houston. Never again!
