Judge Denies New York City Handgun Permit for Traveling Gun Dealer

A traveling firearms dealer will not be allowed to carry a concealed weapon for self-defense while working in New York City, a judge ruled Friday.

Arguing that he needed the handgun permit to defend against “criminals and terrorists,” who might try to ambush him while he’s out on a sales call, Cavalier Knight filled out an application with the New York City Police Department in 2014.

Not long after Knight applied, the NYPD denied his application, saying that Knight has been doing his job for years without incident and failed to show how he was in more danger than others who work within his profession.

Knight, who sells gun through the California firm Armored Mobility took the matter to court, arguing that the NYPD violated his Second Amendment.

On Friday, Manhattan State Court Judge Michael Stallings backed the NYPD, claiming that the denial of the CCW application did not infringe on Knight’s right to keep and bear arms.

Judge Stallings also rejected the notion that Knight could be a target for criminals and terrorists because he is a traveling arms dealer.

“That claim is based upon pure speculation, which is unsupported by any evidence,” the judge said.

New York City is one of the few remaining holdouts in the country with a Constitutionally-dubious, may-issue concealed carry standard that requires one to get arbitrary approval from law enforcement before one is allowed to carry.

Typically, under the may-issue standard, law enforcement requires the applicant to show “good cause” to justify one’s right to carry, e.g. restraining order, police report documenting violent threats, etc.

But residents in NYC, including Knight, may be able to take solace in a federal judge’s ruling last week that struck down the “good cause” requirement in Washington, D.C.

Like New York City, the District has long ban a bastion for draconian gun laws. But if these laws are being overturned in our nation’s capital, there is reason to believe that one day they’ll be scrapped in the Big Apple too.

    The author cites NY City as “one of the few remaining holdouts. Apparently he overlooked the entire State of Maryland, which also has it’s dubious “may issue” hoops, justifications and subjective discretionary practices that effectively eliminate 90% of the population from carrying legally.

    In NY, you have to wait until AFTER you have been murdered to get a concealed weapon permit.

    Obviously this judge may have passed the bar but he must have cheated. No one that ignorant (arms dealer not in danger from thieves?) could have legitimately taken and passed the test.

    Want to really do something worthwhile? Forget impeaching these people.

    Prosecute them.

    Start with the NYC Borough Council and the Mayor, and the judges, then the DC City Council and Mayor for their gun control laws. Move on from there. A year or two in federal prison would enlighten them in a hurry.

      Brilliant idea, Penrod! I vote we start with NYC, then D.C. and if that hasn’t gotten California’s attention, we do them next. Liberalism is a mental disorder and if we cannot get them committed, let’s put them in prison so that they can no longer harm the rest of us.

    Having once lived in NY the only people who get carry permits are the rich and famous. Just Google people who have gun carry permits in NYC and you’ll be in for a big surprise.

    This judge should be Impeached for not upholding his Oath of Office, Obstruction, and Violation of the Peoples Rights to bear arms. Re read the 2A. I rather have a gun in my hand than a cop on the phone.
    It is unconstitutional to turn a Right into a privilege and charge a fee for it. That’s the LAW. Our City Father’s should drop dead!

    While the Chief LEO of a county may issue, in practice only a handfull have ever been allowed.
    It is defacto a “No Issue” State

    Hey judge, before a person is the victim of a crime it is ALWAYS speculation. As far as evidence, I am sure the crime scene will provide more than enough to justify the speculation.

    On that basis, it’s clearly unnecessary for the Judge issuing that opinion to have armed bailiffs. No sense in giving them weapons until someone blows daylight through the good Judge, after which his successor can make the case that HE needs armed security.

    I have loved the above statement from the first time I heard it. Well my dear Judge and NYCPD, I haven’t have a car accident in years, yet I still carry insurance.

    This is ridiculous. The mans right to keep and bear arms is not being infringed when the governing authority refuses to give the man a permit to keep and bear arms? I got news for these fools who call themselves judges and the NYCPD, you are intentionally disarming this man who is in dire need of a means of defense. This is a major violation of his civil rights under our 2nd Amendment. Nothing in our Bill Of Rights describes a need to ask police or judges whether we can exercise them. It’s that simple. Tell this judge he needs to find work in the private sector, because his days of denying individuals their civil rights are over right now. There is no reason he shouldn’t spend some time in prison to think about it all first. Stand up for your rights or lose them to jerks like this. I’m going to find his address and post it widely over the internet. I’m sure he has sufficient means of defending himself, so it won’t matter if every mouth breathing lunatic from the internet sees pictures of his lovely children and wife and finds out exactly where they live. Have fun with that your honor………

    I’ve been turn down 3 times.This January I can apply again. The last time I didn’t write down on the application that I had been pulled over for a headlight being out and I was off by 1 date on and answer on something that happened 20 plus years ago..btw this is just to keep a pistol in the house not even to carry and the process takes over a year. And even though I have CCW in multiple states they just don’t want citizens armed. I was forced to purchase a shot gun for home defense. Can’t wait to move back south.

    Well..this was to be expected. New York government insist with all their vigor that the only ones that should have firearms or carry them publicly are law enforcement and vetted and professional security for some of their ‘select’ residents…PERIOD!!
