A gunfight at Benihana Sunday night left one would-be robber dead and one victim injured, reports local media.

At around 10 p.m. two customers were leaving the popular Hibachi chain restaurant when at least one suspect stopped them and asked for a lighter, according to witnesses. Not long after he made the request, the suspect pulled a mask over his face and drew his firearm.

Instead of complying with the would-be robber’s request, one of the patrons pulled a gun out of his vehicle — and gunfire erupted.

Police say that the 28-year-old perpetrator, who has yet to be identified, was rushed to a local hospital where he later died of the gunshot wounds he sustained. Meanwhile, the 30-year-old victim was also shot but was (thankfully) listed in stable condition.

It’s unclear how many rounds were fired but authorities said that no one else was injured. Police are still investigating the incident to determine if there was another suspect involved.

As for the victim, police will turn over the case to a grand jury to see whether his use of lethal force was lawful (based on the available evidence, it appears to be a no-brainer; meaning the use of force was justified).
