Editor’s Note: The following is a news alert from the National Shooting Sports Foundation, the firearms industry trade association. All I can say at this point is… actually, I’m speechless. This is bad. Really, really bad!
The National Shooting Sports Foundation is extremely disappointed that Gov. Brown today chose to sign into law these highly restrictive and unneeded gun control measures, all of which will affect law-abiding Californians while doing nothing to stop the criminal misuse of firearms. By acting within 24 hours after being sent these bills, and not allowing the public to voice their opinions in order to depart for his European vacation, the governor compounded the miscarriage of legislative process and procedure while demonstrating disdain for Californians who now face laws that clearly infringe on their Constitutional rights.
Gov. Brown SIGNED the following bills into law:
- AB 1135 (Levine) and SB 880 (Hall) Firearms: assault weapons – Expands the definition of assault weapons based on whether a semiautomatic firearm has a detachable magazine, banning thousands of popular firearms.
- SB 1235 (de Leon) Ammunition – Requires authorization to purchase ammunition and track what and how much ammunition each person buys, creating a database of ammunition purchasers.
- SB 1446 (Hancock) Firearms: magazine capacity – Makes it illegal to possess magazines capable of holding more than 10 rounds no matter how long a person has owned them.
- AB 1511 (Santiago) Firearms: lending – Makes it illegal to loan a firearm to a person who is personally known to you (except for family members with restrictions).
- AB 1695 (Bonta) Firearms: false reports – Creates a 10-year prohibition on owning firearms for someone convicted of falsely reporting a lost or stolen firearm.
Gov. Brown VETOED to the following bills:
- SB 894 (Jackson) Firearms: lost or stolen: reports – Would have made it a crime not to report lost and stolen firearms to law enforcement within the arbitrary time limit. Governor’s Veto Message
- AB 1673 (Gipson) Firearms: unfinished frame or receiver – Would have expanded the definition of a firearm to include partially finished frames and receivers (no definition of what this means) and require their registration.Governor’s Veto Message
- AB 1674 (Santiago) Firearms: transfers – Would have made it illegal to buy or receive more than one firearm in any 30 day period. Governor’s Veto Message
Contact Gov. Brown’s office today and voice your frustration with his hastiness to sign these bills less than 24 hours after receiving the bills, not allowing the public sufficient time to provide their input. This echoes the Legislature’s disregard for legislative rules and procedural abuse, once again not allowing the public a sufficient amount of time to give input on the pending legislation.

My gun store was burglarized and pistols were stolen. They have started showing up in Los Angeles in the hands of criminals (people who can’t legally possess firearms). Contrary to what I keep reading from other folks, law abiding citizens ARE the problem they are trying to solve. People who respect and will defend their Second Amendment Rights against Gov’t tyranny are the people these laws are aimed at, not the criminals. Criminals don’t follow existing laws, and won’t follow these either. I suggest reloading, and getting your components before they figure out that they didn’t address that, or make a few quick drives to Nevada to purchase your components or ammo, before they start checking us at the border.

How is abortion protected by the Constitution but gun rights not?
As liberals around the country celebrate Whole Women’s Health v. Hellerstedt, a decisively pro-choice Supreme Court ruling on abortion, they may want to consider how the precedent set would apply to gun rights.
Whole Women’s Health v. Hellerstedt was a 5-3 decision ruling on the concept of the “undue burden” originally established in Roe v. Wade. Roe stated, “a state has a legitimate interest in seeing to it that abortion is performed under circumstances that insure maximum safety for the patient… a statute which has the effect of placing a substantial obstacle in the path of a woman’s choice cannot be considered a permissible means of serving its legitimate ends.”
In the most recent decision, the Court ruled that Texas’ law placed too much of an obstacle to getting an abortion, reaffirming that no obstacle, such as requiring clinics to meet ambulance surgery center standards, may be used to limit this right.
But abortion is not an explicit right under the Constitution. Still, the Supreme Court refuses to allow any burden to prevent it from being exercised. The Justices continue to treat the right to abortion as a right equal in strength to the right to due process, trial by jury or free speech.
By this logic, then, federal courts should equally treat the right to keep and bear arms, a fundamental right actually included in the Constitution’s Second Amendment, with the same level of respect.
When Judge Myron Thompson wrote his decision in Planned Parenthood Southeast v. Luther Strange in the Middle District of Alabama, he explained this correlation. Writing “at its core, each protected right is held by the individual: the right to decide to have an abortion and the right to have and use firearms for self-defense. In the context of both rights, the Supreme Court recognizes that some regulation of the protected activity is appropriate, but that other regulation may tread too heavily on the right.”
He explains that since both inherently involve other individuals or potential individuals, there is a level of supervision but, in his view, any effort to deliberately prevent an abortion is as unjust as preventing gun ownership.
Now to be consistent the Supreme Court must use the logic they used in Hellerstedt once again, this time in the 9th Circuit Appeals case Peruta v. San Diego, which denies individuals the ability to carry concealed weapons without adhering to strict criteria which changes from county to county.
Arbitrary guidelines like “good moral character,” and demonstrating “good cause” outside of simply self-defense or self-interest are vague burdens governments against gun rights impose to prevent ownership. In abortion cases the Supreme Court ruled burdens just like these which are used to limit abortion rights are unconstitutional, the rulings dealing with the right of gun ownership must be viewed by the same standard.
The next Supreme Court docket will likely include the Peruta case, making it more important than ever that the Justice replacing the late Justice Scalia be one to vote in consistency with the fundamental right of being pro-choice on gun ownership.
In the last major gun rights case, D.C. v. Heller it was Justices Scalia, Roberts, Kennedy, Thomas, and Alito all voting in favor of the Second Amendment right to keep and bear arms as an individual right. However, with Scalia’s passing it is more feasible than ever that if, for example, Hillary Clinton the presumed Democratic nominee, is elected president all of these established precedents protecting gun rights will be thrown away with a 5-4 decision against the second amendment.
Our next president will not just have power over the executive office but the fundamental rights of the Second Amendment to be practiced without undue burden.
The NSSF has backed “gun control” for a very long time. Its leaders cannot grasp that “gun control” is akin to an aggressive cancer. It cannot be managed. It must be eliminated. Were “gun control” suddenly to vanish, the NSSF – like the NRA – would implode, because its reasons for existing – pretending “to fight” against “gun control” – would have gone away.
“Gun control” is a vast consumer fraud, in which the NSSF is complicit. First, things super-abundant cannot be controlled. That’s what foredoomed Prohibition, the nationwide ban on alcoholic drinks (1919-33). Then, as now, the ingredients for home-brew could be bought in any grocery store. In some regions, distilling alcohol (“moonshine”, “white lightning”) was a tradition older than is this Republic. Prohibition made some “moonshiners” wealthy. Those, who backed Prohibition, were impenetrably stupid. They bequeathed to us well-organized criminal cartels, still a plague on the land.
At end-2013, there were 335,000,000 firearms in the US, more than one per resident, including infants, who usually own little. (See US Dept. of Justice, “Firearms Commerce in the United States”, 2000 and 2015). With so large a supply, those who want firearms will get them, no matter what laws exist.
Second, since 1980, the number of firearms in the US has doubled, but the murder rate has halved. In 1980, the murder rate was 10.2 per 100,000 residents (Dept. of Justice, “Homicide Trends in the United States, 1980-2008”, p.2). In 2013, the homicide rate was 4.6 per 100,000 residents (FBI, “Crime in the United States”, 2013, Table 16). If firearms drive the incidence of criminality, the murder rate should have doubled. It didn’t. It halved.
Third, laws in force are not used to punish those, who seek unlawfully to acquire firearms. Only rarely are there prosecutions of those ineligible to own firearms, who try to buy from a Federally-licensed dealer. Only 62 Federal prosecutions followed 76,142 denials (in 2010) of purchase applicants. For the data see, Regional Justice Information Service, “Enforcement of the Brady Act, 2010”, 2012, p. 7 (https://www.ncjrs.gov/pdffiles… ).
Some denials may have been erroneous, i.e., applicants were actually eligible to buy firearms but were mistaken for ineligible persons. Even so, it beggars logic to think that all but 62 denials were unjustified. It is a Federal felony for a “prohibited person” to possess or to try to acquire any firearm. Such a small number of prosecutions shows that Federal authorities care little about stopping those, who seek to abuse firearms.
Fourth, the agreement to add to the database of prohibited persons, those from the “no fly”, list is similarly a fraud. If enacted, it will have little impact. The reason: only 2,700 of the 109,000 on “no fly” lists are US residents or legal permanent residents. Those not in the US plainly cannot buy any firearms in the US. Those unlawfully in the US cannot lawfully acquire any firearms.
Form 4473 – by which custody of firearms is transferred from dealer to buyer – has a question (11. k), which asks the applicant to state whether s/he is an alien illegally in the US. If an applicant answers that question in the affirmative, the dealer does not seek approval to transfer, because the applicant cannot lawfully acquire a firearm.
Finally, even the offer of redress via the Federal Courts – to those wrongly put on these lists – is a cruel hoax. Few have the $250,000 required to litigate. For, the Dept. of Justice will surely appeal a District Court decision that a plaintiff was wrongly included on a “no fly” list. Even if the law allows recoupment of attorney’s fees and costs, few can afford to tie-up that much money.
In short, “gun control” – specifically background checks – is simply a fraud. These laws burden the law-abiding but can do nothing to stop a person, who wants to acquire a firearm, even if that person cannot do so lawfully.

The Governor signed these bills into law, then turns around and strikes down a handful more stating that they would do nothing to stop criminals from committing crimes. If you are so happy to change that “old and outdated” second amendment always remember there is one amendment that is older and our forefathers only envisioned the use of old hand cranked printing presses, not these global message channels that can spread hate and disinformation from strangers. I operate a small business in Arizona, less than a mile from the Kalifornia border. I am going to get so bloody rich on cash only purchases of ammo and magazines. It might even be cost effective to upgrade my FFL now and start selling “assault weapons”, if I can do it without blatantly violating too many BATFE regs. Keep passing those bills, boys.

Yep, moved out over 20 years ago. I saw that they wanted me to be a victim. All the criminals cheered when Jerry signed these bills. But don’t be too quick to write his office, as he’s on vacation in Europe now.
The problem is that each inch given turns into a mile and soon there won’t be anywhere to move to if these illegal and treasonous laws are not spoken out against and fought in court. When you start surrendering you start losing. Simple as that.

Idiots elect idiots. The Feds turn a blind eye to CA’s violations of Fed Laws, a near bankrupt State, they will in time be as bad as chiraq. The problem is that as CA decays, the Libs/Dems move to WA, OR & ID and spread their contamination. Look at the anti gun movement and new gun laws in WA and OR. At least lD’s foundation is solid but how long will it last?
California may have been near bankrupt, but after 8 years of Governor Brown, it is on (at least at the current time) on a firm financial footing and with a budget surplus. The problem with surpluses is that every legislator wants it spent on his pet project instead of catching up on billions of dollars of backlogged infrastructure repairs. I think maybe they are waiting for the next big quake so as to qualify for federal disaster funds….
I would have written an E-Mail to Mr. Brown although I do believe he gives a damn about the opinions from someone from the other side of the Atlantic. But I was disappointed when I wanted to try it and saw that I only can send him an E-Mail with a maximum of 6.000 characters. Yes, characters not letters! I would have so much to write for Mr. Brown but when I already compare the amount of characters of my comment on the blog entry before this one (Wave of Draconian Gun Bills Headed to California Governor’s Desk) MS Word counted that already there I used a total of 4.688 characters and there I just wrote about one thing of many I wanted to tell Mr. Brown about, trying to convince him to change his mind. I have so much more to write to him, collecting so many good reasons to throw these bills away as well as the Californian believe about guns in general, but his character limit and the behavior of not letting the public to know that he makes a decision about these unfair bills before the very day he signs these things, makes me wonder if the American Democracy is more and more a dictatorship, like they already are in mine and many other European countries.
Anyway, if one of you guys knows a real public E-Mail address of Mr. Brown without a character limit I could send all my concerns to, I still would give it a try. But via this website with a 6.000 character limit there is no way for me, as I have too much to write. I guess many of you have too and I also guess that’s why they input this 6.000 letter limit because of pure fear that they are flooded with perfect reasons for not behaving like that.

Hey Matt, happy Independence Day! Hmmm, maybe I could do this. Or maybe there is some kind of a public E-Mail address of his party in California? So, not a main E-Mail address of them for the whole country but a specific one for California. I am still very serious about it and although I do fully understand your dislike and anger about this matter, I don’t want to flood them with multiple messages that all link together because then the chance that someone of them will actually read it and take it serious (if they ever will) will surely go down if I do annoy them like this because I also have my own experience with things like that:
Last year I was sending an E-Mail to a German SPD politician (Christian Hanke) who has a direct E-Mail address and I only received an E-Mail demon but I was wondering why the demon came a full day after I’ve sent it because normally these things arrive as soon as you have sent your mail. Someone else tried to send this guy a mail too and he had the same thing. As he knows more about computers he told me that this was in fact a manual demon so someone sent me this demon to lie to me that my E-Mail has never arrived although it likely did. But hey, it was SPD so I didn’t expected something better out of this.
Why not just write it all in Word and send it to the governor in parts?
Hi Rollin, just as I’ve told Matt I think the chance of someone actually reading it would extremely go down if I send them many parts that are obviously all linked together. They would think I just want to flood or spam them and then all my writing would be in vain, which I obviously don’t want to. This is what I’m worrying about it. I was even searching in the net for a real E-Mail address of him but of course I wasn’t successful.
The Communist state of California leads the rest of the nation in trends and public policy. A state that gives legal status, law licenses, drivers licenses, and soon to be voting rights to criminal migrants living in the state in violation of federal immigration statutes. At the same time the state guts the 2nd Amendment which will not stop criminals from getting guns. Citizens rights are trampled while non citizens are given privledges in violation of standing law.
You know…I have heard that for a long time….about how Kalifornia goes, so goes the rest of the nation. I want to say BS to that notion. I think that’s what they want….but I think we need to rail against that notion. They can keep their trends and policies. And I’m sorry, but its time to hit them where it hurts….In the wallets. Don’t buy anything from Kalifornia, don’t go to or have anything to do with Kalifornia, If you live there….MOVE out of Kalifornia. That’s the only way to respond really. Or you can play sheep and let them steam roll over you even more than they already are. As far as I’m concerned, let the Idiot democrats and liberal morons have their own little mecca where they can have their own little dysfunctional nation. On the same token….don’t let them leave. Set up a border, arm it, and don’t let them leave. Let all the illegal immigrants in that wants in. Keep all the hollywood libtards locked in there. Treat them as a foreign hostile nation. The governor also vetoed a bill that would have expanded California’s “gun violence restraining order” law (which allows for specified close family members to apply for a restraining order requiring the person to turn over firearms for up to one year if there is proof that the person presents a significant risk of harm to himself or others) to allow co-workers and employers to seek such restraining orders. I haven’t seen the veto message, but am thankful that the Governor recognized the mischief that would likely result from this bill as minor job squabbles turn into court cases with serious consequences.
