A homeowner shot at a man last weekend after the man ran a golf cart into his fence.
Reports say that the homeowner had heard his dogs barking outside of his house. He “grabbed his gun to see what was going on.”
Outside, he found a 50-year-old man “on construction equipment across the street” according to reports from Kiro7 and KTRK. Both sources cited a statement from Sgt. Sidney Miller, a spokesperson for the police department.
An Argument and a Golf Cart
The homeowner apparently then confronted the individual, and was reportedly told, “Mind your own business.”
Kiro7 reports that the man lived in that same neighborhood and would often drive a golf cart to a nearby store, according to Miller.

The man then drove up in his golf cart next to the homeowner, starting an argument. This argument culminated in a strange sequence of events. The man “barrels the golf cart into the [homeowner’s] gate,” said Miller.
The gate, which was close to the homeowner’s position, struck him. In response, the homeowner fired several shots at the man in the golf cart

Police and paramedics responded to the 911 call around 8:30 to find the man dead.

According to KTRK, Miller said, “The shooter did administer CPR. He is cooperating with the investigation. So we’re still out here interviewing some people inside the home as well to see what their story is.”
He went on to say that once the investigation had wrapped up, the case would be taken to a district attorney. It is unclear, according to him, if the homeowner will receive charges.
It’s not specified if the two men were acquainted, though KPRC 2 did refer to the man in the golf cart as a “neighbor.”
While the sequence of events raises many questions, a primary concern centers around the homeowner’s motivations. Given the circumstances, was the homeowner genuinely acting in self-defense, or were there other factors at play?

It seems like there is a lot of detail left out of this but I wouldn’t have shot. The golf cart maniac, while reckless in his actions did not meet the standard for use of lethal force (jeopardy, ability, and opportunity). Opportunity…yes. Jeopardy….possible in his actions. But ability? I can get out of the way of a golf cart even on my crutches. Just don’t see that factor being checked off.
Really? Even if the construction property was YOUR property, is it really worth spending a night in jail or many years in PRISON???? Call the police, take lots of pictures and then retreat back into your house if they guy makes any sort of threatening gesture.
He’s not holding your wife at gunpoint or your child at knifepoint and even if he were, you (the average gun owner in America) is NOT good enough to hit the guy in a vital area. That is what SWAT is for .
I hope this homeowner gets the book thrown at him even if the thief was in the middle of stealing someone else’s property….
Some people earn what they get, sometimes you have to adult.
This one will be interesting to see how it plays out in the court system. I’ll admit being an ‘arm-chair’ quarterback at this point, but driving the golf cart towards the homeowner with a fence between them, and being stopped by that fence – if that’s the case – doesn’t seem like deadly force was warranted to me. If it went beyond verbal sparring and the guy jumped off the golf cart and approached the home owner in a threatening manner, crossing onto his property, then that’s a different scenario all together.
But this doesn’t look justified to me. No doubt a grand jury will indict him and this will be a very costly trial.
I suspect that the guy in the golf cart either had anger management issues or HBD. Or both. The latter tends to exacerbate the former.
