Florida Republicans Back Proposal to Restrict Private Gun Sales, Impose Three-Day Waiting Periods

While Virginians work to block sweeping gun-control measures authored by Democratic lawmakers, Republicans down the coast in Florida are proposing some of those same anti-gun policies.

A Republican-controlled Senate committee voted unanimously on Monday to pass an omnibus bill that would restrict gun sales, ban private sellers at gun shows, impose safe storage requirements, and mandate a three-day waiting period to obtain firearms.

The bill (SB 7028) is a “priority” of Republican Senate President Bill Galvano, according to local media. Galvano asked the Senate Infrastructure and Security Committee to vote on the measure a day before the legislature’s 2020 session is set to begin, and all five Republicans on the committee voted in favor, including committee chairman Senator Tom Lee.

“I know that you don’t see NRA members in the headlines of these mass shootings,” Lee told reporters following Monday’s meeting. “But we have a job to do. We can’t just sit by idly while our children are killing children and pretend this isn’t happening.”

The measure prohibits all private transfers of firearms “on property to which the public has the right of access,” essentially eliminating private sales at gun shows and other events. Sellers who are not federally licensed gun dealers and want to conduct a transfer on publicly accessible property will be required to obtain the services of a licensed dealer who can perform a background check.

For sales not on publicly accessible property, the bill requires the seller to confirm the buyer is over 21 years of age, and make and preserve a dated record of the sale. The record must include the make, model, and serial number of the firearm along with the buyer’s name, date of birth, and ID number.

In addition, the seller must compose an affidavit signed by the buyer that includes all of the information above along with the buyer’s answers to a list of questions similar (though not identical) to the form used by the ATF in firearms transfers. The seller must also have that affidavit notarized.

The measure imposes a three-day waiting period to purchase a firearm but provides exceptions for those with a valid concealed carry license and those who wish to purchase a rifle or shotgun and have completed a hunter’s safety course.

The proposal also mandates safe storage of firearms where minors under the age of 18 or “persons with unsound mind” may be able to gain access to them. Previous law only required safe storage of firearms when children under the age of 16 may be present.

Marion Hammer, the primary lobbyist in Florida for the National Rifle Association, said the measure contains “the worst universal background check language I have ever seen.”

“It appears to be an actual attempt to ban private sales through red tape and fear,” she said. “Asking average citizens to create what amounts to a government form and get it notarized is ridiculous.”

The legislation is “nothing less than gun control on steroids,” Hammer said.

There is currently no companion legislation in the House, but Sen. Lee promised the Senate president and the Speaker of the House would be coordinating in the coming weeks.

    Since the Reconstructed State of Florida wishes to be under “federal” rule, rather than the sovereign republic which it was intended to be, and as such, must follow federal protocol. These politicians seem to forget that the Second Amendment BINDS government from infringing on the right of the people to keep AND BEAR arms.
    This is definitely infringement. Despite this sissy boy’s wish to stop his kids from killing other kids, he is STILL bound by his oath (not that politicians are honorable) to uphold and defend the Constitution. He is in clear violation of any such oath.
    Violating that oath makes him unfit to fulfill that office.

      of closing down gun shows by litigating them which is also unconstitutional. Also, these laws get innocent police and citizens killed by trying to enforce them. Grandma and Grandpa will not give up their guns and brave officer Pete is just doing his job enforcing these anti-American laws and someone will be killed and it’s just stupid laws that do that. Why don’t these politicians read the Constitution and Bill of Rights to defend our freedoms?; Because they don’t have to; even when they took an oath to them.

    How can it be legal for someone who is not a permanent resident of a state to infuse large sums into the political process of that state? This is serious question. I can understand it’s legality at the federal level because legal state citizens should be able to lobby federal officials, but it seems immoral for a state government to allow non-permanent residents the ability purchase the political and legal process of said state. Beyond the fact that citizens rights are being diminished, the process which facilitates that diminishment seems immoral and needs to be stopped on a state-by-state basis as quickly as possible.

    I would like to know exactly how many children were killed by people who would have been violating ANY of the provisions of this bill. I’m wracking my brain trying to think of a situation where a person who wants to kill a child will only do so if he can go to a gun show, avoid any paperwork, and commit the crime within 72 hours.

    This demonstrates how the Republican label on a politician does not guarantee protection of your 2A rights. People you MUST vote in Republican primaries after finding out which candidate actually will. Granted this law is “moderate” compared to what Democrat confiscators want (looks like it’s designed to generate revenue from CC permits and notary licenses) but it is still outrageous for Republicans to be supporting. No matter what state you live in, find out where your GOP politicians really stand and get rid of these hypocrites in the primaries. That way you won’t be left with no other choice but a left-wing gun grabber in the general.

    I am frustrated and politicians who create problems. This example from Florida is a good example. Something is passed just so they can say they “did something”. Doing something is NOT good enough, they must do the “RIGHT THING”. Sadly, that requires too much effort for 90% of our political class, they have neither the stamina nor the intellectual power to figure out what the “right thing” is and then implement it. A three day waiting period or a 100 day waiting period doesn’t solve the problem of mass shooting, it doesn’t even address the issue.
