Stuteville confirmed last week that a student found his firearm in the bathroom in January and immediately reported it to a teacher without handling it.

The charge of involuntary manslaughter without the gun enhancement charge is still set to move forward. It carries a potential 18-month sentence. 

Legal owners of banned guns will be protected by a grandfather clause if they register the firearms with the Illinois State Police by Jan. 1.

Smith was taken into custody and later pronounced dead at Christ Medical Center on Jan. 20.
