New Bill Could Save Pistol Braces From Biden Admin’s NFA Reclassification
The Biden administration is seeking to reclassify pistol braces.

A U.S. senator last week introduced legislation to protect pistol braces from the Biden administration’s proposed rule to reclassify them under the National Firearms Act.

Sen. James Lankford (R-OK) spoke about the new bill known as the “Pistol Brace Protection Act.

“This is standard behavior for the ATF. ATF consistently finds new ways to manipulate the NFA so it’s difficult and burdensome to be a law-abiding gun owner” said Lankford.

“Congress should not wait for ATF to finalize the pistol brace rule. Law-abiding gun owners are counting on us to proactively protect their rights and their use of pistol braces by passing my bill immediately to make clear to the ATF that we won’t stand for this overreach,” he added.

Arm braces were designed to allow disabled veterans to fire large-format pistols one-handed. Usually, these braces are designed for AR-platform pistols (barrel shorter than 16”), and they’re attached to the buffer tube that normally accepts a collapsible stock.

If passed by Congress, the bill would eliminate “subjective standards that exist in federal law that have allowed ATF to reclassify firearms under the NFA, and guarantees that law-abiding gun owners will not have to register, destroy, or surrender their pistol brace.”

Thanks to the ATF’s incompetence up to this point, millions of law-abiding gun owners purchased these arm braces with the belief that they do not magically transform an AR pistol into a short-barreled rifle (SBR). SBRs are heavily regulated under the National Firearms Act, and possessing an unregistered SBR is a federal felony.

Under the ATF’s proposed rule, however, many of these arm braces will be considered gun stocks, and attaching them to an AR-pistol could land an unsuspecting gun owner in federal prison. As a group of 140 lawmakers told the ATF in a letter dated June 14, the rule would turn millions of law-abiding citizens into felons overnight.

While we’re still waiting for the shoe to drop on pistol braces, the Biden administration announced Monday that it is moving forward with its ban on so-called “ghost guns” and that it will seek to appoint a new nominee, Steve Dettelbach, to serve as the director of the ATF.

Sen. Lankford also said he will put forth a resolution of disapproval to overturn the new “ghost gun” rule. Stay tuned for updates.

Until the ATFE/NFA are abolished & eliminated or the 2nd amendment (one or the other we can’t have both) this American human right will continuely be infringed upon by progressive liberals!!!%

Why not create a pistol brace that’s not part of the gun??? Develop an adjustable fingerless glove that extends over the arm….? Or is ATF in charge of gloves too???

  • Mark Holcomb April 15, 2022, 3:07 pm

This is part of the movement to made BCGS, slides. magazines and the like regulated parts that reguire an FFL purchase only to legally buy. This isn’t just about tinker toy AR-15 builds, but is about all home built/repaired guns, too. The guy whom buys a 1911 or Browning HI-Power upper receiver and FFL buys the lower to snap it together at home will be hurt by this same movement, too.

Sink said part of said movement by backing Senator Lankford’s bill, too!

I’m a big supporter of 2A rights and have been an avid shooter for over 50 years. Hate to say it, but I knew this brace issue was going to backfire. While I have two “pistols” with braces (Tailhooks) it’s pretty obvious they’re stocks. Total BS to think it was designed for disabled vets as anyone that has tried it would acknowledge. I spent 26.5 years in the USMC and I’m as supportive of disabled vets as one can be. I have also jumped through the NFA hoops to purchase and WAIT for an SBR. Ironic that I can’t put that in my car and across a state boundary without a “Mother May I” document, but can do it all day with a braced pistol. I think the only viable solution is to repeal the SBR provision. it’s total BS and this brace issue proves it. No way, millions of braces are coming off pistols, thus the instant felon assertion, but they will have to be discreetly concealed. There is one way braces will come off and it sort of proves my point. If SBRs simply went away, dumpsters across America would be filled with pistol braces currently used and intended to be stocks and real stocks would be attached. BATFE screwed up letting the brace issue get out of hand. I understand the desire to accommodate the disabled, but it just kept getting more stupid with the touching the shoulder rules etc. Sadly, it became a public issue when a “pistol” was used in a mass shooting, but a review of the SBR and pistol brace weapons would show they aren’t a crime problem.

The reported bill is great, but it’s also nothing but political theater.

“…….Under the ATF’s proposed rule, however, many of these arm braces will be considered gun stocks, and attaching them to an AR-pistol could land an unsuspecting gun owner in federal prison……..”

And when the ATF/FBI etc. Or any other rogue ‘federal agency’ tries to enforce any of the unconstitutional laws it could land them in a cemetery.
We the People have had quite enough of this Government BS!

Dear himhewho… in the convoluted ramblings of ATF rulings they at one time realized that putting plastic on your shoulder was an unenforceable interpretation of this “rule”. I thought everyone knew this.

Talk about causing a Rip in the Fabric of America.

I dont know any “Real” Shooters who dont own at least one of these.
Arm brace for a SBR – to make it legal.
Best Set-up for Home Defense made.

I dont think the Dems have a clue about what this would bring/do.
A near if not real Revolution.

“Make me” a Criminal and I might start acting like one.

For you Dems – A clue:
It is the Criminals who commit crimes.
    NOT – Honest Gun owners.

Unless you “make us” Criminals by Passing Crap like this.

You need to understand that as soon as you possessed a firearm you became a criminal at least in a progressive liberals warped mind!!!%

  • Blue Dog (he/him) April 14, 2022, 7:34 pm

If people just used these pistol braces as pistol braces, this wouldn’t be an issue. But since yokels have to brag about shouldering them like SBRs, these braces have gone from a gauche accessory to an unnecessary polemic. Happy now?

    • Jay Smith April 15, 2022, 8:57 am

How many sbr or pistols with braces have been used in crimes ??? Not applicable to the problem/issue. Btw , polemic means verbal attack. Your term doesn’t fit , just like your attempt at pointing a finger.

      • Blue Dog (he/him) April 16, 2022, 11:22 am

Is it not a crime every time they shoulder a brace like a stock?

Pistol braces are polemical. They are a source of controversy. There are verbal arguments, like the one we are having right now, about them. This is a polemic, and an unnecessary one at that!

    • Kane April 15, 2022, 12:43 pm

Of course, one has to set aside all BD’s many posts where he railed against the subjective ‘assault style’ weapons and pretend “this wouldn’t be an issue” when his gelatinous posturing requires a shift here or there…

      • Blue Dog (he/him) April 16, 2022, 11:19 am

You are right, Kane, that I generally oppose AR pattern rifles and other black guns. Some of the accessories are more objectionable than others. Some accessories need special attention, like bump stocks, which try to counterfeit fully auto fire. Some accessories are no more objectionable than the rifle itself, like flashlights or lasers. Some accessories are just gauche and add no value to the rifle whatsoever, like those AR truck nuts or the now very real chainsaw bayonet. Pistol braces could have been in the second or third category if used as advertised. But they aren’t used as advertised. Like bump stocks, they need to be regulated. ARs do too but until Congress can finally act to make American streets and schools safer, we can make smaller, incremental steps to get certain accessories.

Binary triggers, btw, are probably in the second or third category.
