“As the officer approached the pedestrian, a struggle ensued in lanes of the freeway. During the struggle, the pedestrian was able to access a taser he had in his possession, activated the weapon and used the taser against the officer,” the release said.

“In fear for his safety, the officer fired his service weapon, striking the pedestrian,” the CHP added.

Victim Identification and Community Reaction

The identity of the victim has not been released, pending notification of his family.

Meanwhile, city, county, and state leaders are urging calm and patience as the investigation proceeds.

    After all the insults and names-calling, let’s get back to the meat-and-potatoes of it: If the officer had a taser readily accessible, appears he had the opportunity to use it (and should have)…assuming he hadn’t already tried it…before using deadly force (but understand the video may not have shown everything in real timing, so no way to tell for sure). That said, some good points on the location…no ordinary behavior by the guy “walking” there to begin with and not obeying commands, nor is an interstate any ordinary “road”, plus indeed if the guy had the reported taser in his hand and could have used it, the officer and potentially others could have been a gonner. More facts need to come out but for now have to side with the officer’s “justified” judgement.

    Of course it was justified. Thank you officer, for taking out the trash. Boy, you’ve gotta love Kalifornistan, excuse me, Newsomville, land of the lawless libatards. Ronald Reagan once said; “liberalism is a form of mental illness”. This state proves it! No wonder people are leaving in droves.

    A man walking on an interstate is a traffic hazard. People trying to avoid him might end up in an accident. Even suicidal, he can still cause injury or death to uninvolved people. The trooper needs to encounter this fool to prevent said mayhem. We don’t know yet how the struggle unfolded so there is something there to investigate, and investigations take time. Be patient and monitor for further developments. I have been Tazed twice and nipped by live leads during an app once. The nip was painful, but my body locked up both times I took the full ride and I could not have prevented anything from happening to me (theft of baton, gun, whatever) even if I had wanted to for a full 5 seconds. The TASER is “less lethal” because we do not expect death to result from its use. But you are often completely disabled during its cycle and that cannot be tolerated by LEO’s in the performance of their duties. The risk to the public from the officer’s duty weapon stolen under those circumstances is simply too great.

    Cops use tasers because they aren’t lethal.
    But use deadly force if YOU have one.
    Does this mean it’s OK to shoot a cop that uses one? I mean – the guy was walking down the road…

      The guy was walking down an LA Freeway. Big difference. Also your two scenarios aren’t the same at all. The dangers of an LEO being incapacitated are far greater to the general public and themselves and cannot be permitted. The force they use is always a degree greater than whatever is used on them for that reason.

    IF the taser was used on the officer before he fired, or after he missed with the first shot, YES, the shooting was justified.

    Outside of those parameters, there is not enough concrete evidence to determine either way.

    Srictly by the video, hard to say and maybe not (justified)…couldn’t the officer have used his tazer…? That said, if the officer was tazerless and the man indeed had a tazer (report said he had used it or tried to use it on the officer), then yes…the officer was justified in using deadly force.

    Let’s think about this objectively here. Guy walks on the road, then is killed for it. Does the crime fit the killing? As an officer do you have to escalate to the point of shooting? The answer is no, no was was in danger. Thus the officer should have tried lesser means of getting the guy off the road. Get some backup, move vehicles into positions and then apprehend. The LEO was an idiot and put himself and the guy into the dangerous positions they ended up in. Hence this was a bad shoot, but the blue line gang will investigate itself and find no wrong doing. I am pro police and hate all these idiot criminals today, but this time of police work and BS investigations need to stop.

    Walking in an interstate is prohibited under Federal law, arguing with LEO is stupid, to start with but we are talking California where they have a bunch of “Fruits and Nuts” and not just in the fields, so to pull a weapon on a cop is suicide by cop in my mind. Justified probably, under media scrutiny probably not. JMHO

    As a former armed guard & although I haven’t seen the beforehand going-ons with this CHP on foot highway incident I’d say the CHP action of discharging his firearm was not justified by him first stepping away from the on the ground Nan & then repeatedly shooting him as he walked backwards & away from him. And I did not see the suspect pointing a laser device at the officer while the officer shot him. He should be investigated for a homicide of at least voluntary nansslaughter!

      Agreed! #1 Don’t break the law. #2 Don’t resist when dealing with law ENFORCEMENT officers while in the lawful performance of their duties. #3 Don’t EVER produce anything that remotely resembles a weapon and point it at or toward a law enforcement officer… without expecting a lethal force defensive response. Seems pretty logical to me…
