President Trump this week signaled that a federal ban on bump stocks is coming soon.<\/p>\n

Trump gave the update while taking questions from the media at Monday press conference at the White House.<\/p>\n

\u201cIn order to eliminate \u2014 terminate \u2014 bump stocks, we have to go through a procedure,\u201d explained Trump. \u201cWe are now at the final stages of that procedure \u2014 in fact, the lawyers were just telling me \u2014 and over the next couple of weeks, I\u2019ll be able to write it out. But you can\u2019t just write it out because rules and regulations in this nation are really tough, even for something like that.<\/p>\n

\u201cSo we\u2019re knocking out bump stocks,\u201d Trump continued. \u201cI\u2019ve told the NRA, I\u2019ve told everyone. Bump stocks are gone. But to do it you have to go to public hearings \u2014 which we\u2019ve had.<\/p>\n

\ufeff<\/span><\/p>\n

With respect to \u201cpublic hearings\u201d and \u201cprocedure,\u201d Trump was referring to the Notice of Purpose Rule-Making (NPRM) initiated by the Dept. of Justice in March of 2018<\/a> that sought to regulate reciprocating stocks as \u201cmachineguns\u201d under the National Firearms and Gun Control Acts.<\/p>\n

As part of the process, the public and the firearms community were permitted to weigh in and provide comment to the regulators at the Bureau of Alcohol, Tobacco, Firearms and Explosives. However, the agency is under no obligation to listen to or follow those comments when it comes to finalizing the rule. The comment period ended back in June of this year.<\/a><\/p>\n

The ATF estimates since 2011 the public has spent approximately $96 million on bump stock-type devices, with between 280,000 – 520,000 currently in circulation.<\/p>\n

When the new rule takes effect bump stock owners will be\u00a0forced to surrender their property to authorities or render the devices permanently inoperable.\u00a0 Failure to do so could\u00a0result in\u00a0fines and\u00a0even jail time.\u00a0 Unlawful possession of a machinegun carries a prison sentence of up to 10 years behind bars.<\/p>\n

No compensation will be offered as part of the rule change.\u00a0 Bump stock owners will have to bear the financial burden, take the loss.<\/p>\n

As noted in previous GunsAmeria articles<\/a>, the ATF had on two separate occasions issued letters clearly indicating that reciprocating stocks did not qualify as machineguns\u00a0and were therefore not subject to NFA\/GCA regulations.<\/p>\n

\u201cThe stock has no automatically functioning mechanical parts or springs and performs no automatic mechanical function when installed,” ATF wrote<\/a> in 2010, in response to a submission by former bump stock manufacturer Slide Fire.<\/p>\n

\u201cIn order to use the installed device, the shooter must apply constant forward pressure with the non-shooting hand and constant rearward pressure with the shooting hand,\u201d the letter continued. \u201cAccordingly we find that the \u2018bump-stock\u2019 is a firearm part and is not regulated as a firearm under the Gun Control Act or the National Firearms Act.\u201d<\/p>\n

Yet despite this established precedent and despite statements from current and former ATF employees<\/a> saying that a ban on the devices had to come from Congress because only it had the power to change the law, the Trump administration with the support of at least one high-profile gun-rights organization found a way to get the job done.<\/p>\n

As Trump said Monday, \u201cIn a very short period of time, bump stocks will be ruled out.”<\/p>\n
