(Editor’s Note:<\/strong> <\/em>The following is an article from the National Rifle Association Institute for Legislative Action.\u00a0 It’s an important one because it carefully dispels the myth, perpetuated by anti-gunners, that former Supreme Court Justice Antonin Scalia thought bans on so-called “assault weapons” comported with the 2A.\u00a0 NOT TRUE!\u00a0 While the high court never took up a case on the constitutionality of black rifle prohibitions during Scalia’s tenure, there is ample evidence to indicate that Scalia would’ve regarded them as an infringement on one’s right to keep and bear arms. Kudos to NRA-ILA for setting the record straight.)<\/p>\n

On July 9,\u00a0Sen. Chris Murphy (D-Conn.)<\/a>\u00a0offered the following ham-handed statement in an attempted attack on President Donald Trump\u2019s U.S. Supreme Court nominee, D.C. Circuit Judge Brett Kavanaugh.<\/p>\n

Brett Kavanaugh is a true Second Amendment radical. He believes assault weapon bans are unconstitutional, a position way out of the judicial mainstream, far to the right of even late Justice Scalia.<\/em><\/p>\n

Murphy\u2019s comment gives the\u00a0false impression<\/a>\u00a0that Former U.S. Supreme Court Justice Antonin Scalia, who authored of the majority opinion in the landmark 2008\u00a0District of Columbia v. Heller<\/em>\u00a0case that recognized the Second Amendment protects an individual right to keep and bear arms, did not consider bans on commonly-owned semi-automatic firearms (termed \u201cassault weapons\u201d by gun control advocates) to be unconstitutional.<\/p>\n

Unfortunately, Murphy is not the only individual to peddle this falsehood. Murphy\u2019s fallacious claim was parroted by\u00a0Rep. Ted Deutch (D-Fla.)<\/a>, who tweeted, \u201cEven Justice Scalia knew the 2nd Amendment has limits. It doesn\u2019t guarantee access to every weapon, he said, and assault weapons can be banned.\u201d In bemoaning Kavanaugh\u2019s 2011 dissent in\u00a0Heller II<\/em><\/a>, where he concluded that D.C.\u2019s semi-auto ban is unconstitutional,\u00a0Brady Campaign Co-President Avery Gardiner<\/a>\u00a0contended that Kavanaugh\u2019s view is \u201cinconsistent w\/ Scalia\u2019s Heller opinion.\u201d<\/p>\n

Political operatives and partisan hacks aside, this deceit has infected those who should know better. Earlier this year, U.S. District Court for the District of Massachusetts Judge William G. Young distorted Scalia\u2019s views in his opinion in\u00a0Workman v. Healy<\/em><\/a>, which rejected a Second Amendment challenge to Massachusetts\u2019 ban on commonly-owned semi-automatic firearms. Young found that the banned firearms \u201care not within the scope of the personal right to \u2018bear arms\u2019 under the Second Amendment.\u201d Suggesting that Justice Scalia would endorse such an outcome, Young concluded his opinion by writing, \u201cJustice Scalia would be proud.\u201d<\/p>\n

Taken alone, Justice Scalia\u2019s\u00a0Heller<\/em>\u00a0opinion<\/a>\u00a0is enough to dispel this deception. In it, Justice Scalia made clear that the types of firearms protected by the Second Amendment include those \u201cin common use at the time\u201d for \u201clawful purposes like self-defense.\u201d The AR-15, which is the favorite target of so-called \u201cassault weapon\u201d ban legislation, is the most popular rifle in America and therefore undoubtedly \u201cin common use\u201d and protected by the Second Amendment. Gun control advocates seem to\u00a0agree<\/a>\u00a0that such semi-automatic rifles are common, considering they\u00a0routinely<\/a>\u00a0complain about the \u201cproliferation<\/a>\u201d of these firearms.<\/p>\n

Further, in the 1994 case\u00a0Staples v. United States<\/em><\/a>, the Supreme Court determined that semi-automatic rifles were common. The case concerned the\u00a0mens rea<\/a>\u00a0requirement for a conviction for possession of an unregistered machine gun. The subject of the case had argued that he was unaware that the AR-15 in his possession had been modified for automatic fire and was not simply a legal semi-automatic AR-15. In the majority opinion, Justice Clarence Thomas made clear that the mere possession of a converted AR-15 is not enough to infer a mens rea sufficient for conviction, as some firearms are, \u201cso commonplace and generally available that we would not consider them to alert individuals to the likelihood of strict regulation.\u201d Justice Thomas went on to write that most categories of guns, including semi-automatic rifles, \u201ctraditionally have been widely accepted as lawful possessions.\u201d<\/p>\n

If after\u00a0Heller<\/em>\u00a0there was any remaining doubt as to where Justice Scalia stood on this matter, he settled the matter in 2015. That year, Justice Scalia joined Justice Thomas in a dissent from the denial of certiorari in\u00a0Friedman v. Highland Park<\/em><\/a>, a case concerning a local ban on commonly-owned semi-automatic firearms.<\/p>\n

In the dissent, Justice Thomas lamented that despite the Supreme Court\u2019s holdings in\u00a0Heller<\/em>\u00a0and\u00a0McDonald v. Chicago<\/em><\/a>, \u201cseveral Courts of Appeals\u2026 have upheld categorical bans on firearms that millions of Americans commonly own for lawful purposes,\u201d which he made clear was \u201cnoncompliance with our Second Amendment precedents.\u201d<\/p>\n

Justice Thomas went on to explain,<\/p>\n

Roughly five million Americans own AR-style semiautomatic rifles. The overwhelming majority of citizens who own and use such rifles do so for lawful purposes, including self-defense and target shooting. Under our precedents, that is all that is needed for citizens to have a right under the Second Amendment to keep such weapons.<\/em><\/p>\n
