Gov. Cuomo is pushing a Red Flag bill that would allow teachers to petition a judge to disarm a student believed to be an “extreme risk.” But that confiscation mandate might also extend to all the firearms in a household, not just the ones belonging to the student.\u00a0 In other words, if your kid is an “extreme risk,” the state might seize your guns too.\u00a0 (Photo: Como<\/em>)<\/p><\/div>\n

Gov. Andrew Cuomo is making the rounds this week promoting his Red Flag bill, what he is framing as \u201ctaking the SAFE Act to the next level,\u201d as he said in a recent ad.<\/p>\n

The legislation allows designated people to petition a court to disarm a person believed to be a danger to themselves or others.<\/p>\n

At its core, it\u2019s a way for the state to confiscate firearms. What makes Cuomo\u2019s Red Flag bill different than other Extreme Risk Protection Orders (ERPOs) is that along with family members and law enforcement, school officials are empowered to solicit a gun seizure order for a student they believe to be an \u201cextreme risk.\u201d<\/p>\n

Moreover, based on various media reports,\u00a0here<\/a> and here<\/a>, it appears that the bill allows for state police to seize all the firearms in an entire household, not just the ones belonging to the student.<\/p>\n

\u201cIf a parent or a teacher knows a child might act out, has access to guns, let them have the ability to go to a judge,\u201d Cuomo said Monday at a press conference.<\/a> \u201cThis has nothing to do with politics. It is common sense. There is no reason this shouldn\u2019t pass.\u201d<\/p>\n

GunsAmerica reached out to Cuomo\u2019s office several times to get more clarification on the scope of this Red Flag bill. We\u2019ve also reached out to a half-dozen state lawmakers. No responses thus far.<\/p>\n

We asked Tom King, a lobbyist for the NRA-ILA and the president of the New York State Rifle and Pistol Association if the state would really be directed to disarm an entire family because there is a troubled student living in the home.<\/p>\n

\u201cWe are trying to get the same question answered,\u201d said King in an email to GunsAmerica. \u201cUnlike other states there are no public hearings on these bills and we have to rely on them answering questions. Since this is a Cuomo bill I expect the worst.\u201d<\/p>\n

Alan Gottlieb of the Second Amendment Foundation was even more cynical about Cuomo\u2019s agenda.<\/p>\n

“New York Governor Andrew M. Cuomo is and has always been for gun prohibition,\u201d Gottlieb told GunsAmerica. \u201cIf he had his way no one would be allowed to own a firearm. This move is just one more step towards his goal. He is totally allied with the gun ban lobby.”<\/p>\n

Lawmakers are scheduled to debate the legislation Tuesday. Maybe when they\u2019re finished we\u2019ll get some answers. Stay tuned.<\/p>\n
