But their do-gooder plans have hit a snag in Oregon, where a 20-year-old is suing both companies for \u201cage discrimination.\u201d<\/p>\n<p>Tyler Watson tried to purchase a Ruger 10\/22 from Dick\u2019s subsidiary <a href=\"https:\/\/media.breitbart.com\/media\/2018\/03\/claims.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"sues-walmart-dicks-denied-firearm-purchases\" title=\"20-Year-Old Sues Walmart, Dick\u2019s After Being Denied Firearm Purchases\">Field and Stream<\/a> and an unspecified rifle from <a href=\"https:\/\/volokh.com\/wp-content\/uploads\/2018\/03\/WatsonvWalmart.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"sues-walmart-dicks-denied-firearm-purchases\" title=\"20-Year-Old Sues Walmart, Dick\u2019s After Being Denied Firearm Purchases\">Wal-Mart<\/a>, according to the official complaints. In both instances, the clerk informed Watson of the company\u2019s new policy not to sell rifles, shotguns, or ammunition to anyone under the age of 21, and denied the purchase.<\/p>\n<p>Watson and his attorneys argue that these policies violate Oregon Statue 659A.403, which bars age discrimination in places of \u201cpublic accommodation\u201d like retail stores. The law makes specific exceptions for alcohol and marijuana sellers, but does not make an exception from firearms dealers:<\/p>\n<h2><strong>659A.403 Discrimination in place of public accommodation prohibited.<\/strong><\/h2>\n<p><em>(1) Except as provided in subsection (2) of this section, all persons within the jurisdiction of this state are entitled to the full and equal accommodations, advantages, facilities and privileges of any place of public accommodation, without any distinction, discrimination or restriction on account of race, color, religion, sex, sexual orientation, national origin, marital status or age if the individual is of age, as described in this section, or older.<\/em><\/p>\n<p><em>(2) Subsection (1) of this section does not prohibit:<\/em><\/p>\n<p><em>(a) The enforcement of laws governing the consumption of alcoholic beverages by minors and the frequenting by minors of places of public accommodation where alcoholic beverages are served;<\/em><\/p>\n<p><em>(b) The enforcement of laws governing the use of marijuana items &#8230; by persons under 21 years of age and the frequenting by persons under 21 years of age of places of public accommodation where marijuana items are sold; or<\/em><\/p>\n<p><em>(c) The offering of special rates or services to persons 50 years of age or older.<\/em><\/p>\n<p><em>(3) It is an unlawful practice for any person to deny full and equal accommodations, advantages, facilities and privileges of any place of public accommodation in violation of this section<\/em>&#8230;.<\/p>\n<p>These retailers didn\u2019t just violate the law, according to the complaints. They \u201cwillfully\u201d violated it by issuing press releases and other materials advertising their decision to discriminate based on age.<\/p>\n<h2>SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/blog\/dicks-sell-ars-high-cap-mags\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"sues-walmart-dicks-denied-firearm-purchases\" title=\"20-Year-Old Sues Walmart, Dick\u2019s After Being Denied Firearm Purchases\">Dick\u2019s Will No Longer Sell ARs, High-Cap Mags<\/a><\/h2>\n<p>The complaints don\u2019t mention this specifically, but these willful violations likely include Dick\u2019s CEO Edward Stack\u2019s virtue signaling in every major media outlet.<\/p>\n<p>\u201cWhen we saw what happened in Parkland, we were so disturbed and upset,\u201d Stack said in an interview with the <a href=\"https:\/\/www.nytimes.com\/2018\/02\/28\/business\/walmart-and-dicks-major-gun-retailers-will-tighten-rules-on-guns-they-sell.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"sues-walmart-dicks-denied-firearm-purchases\" title=\"20-Year-Old Sues Walmart, Dick\u2019s After Being Denied Firearm Purchases\">New York Times<\/a>. \u201cWe love these kids and their rallying cry, \u2018Enough is enough.\u2019 It got to us.\u201d<\/p>\n<p>He added, \u201cWe\u2019re going to take a stand and step up and tell people our view and, hopefully, bring people along into the conversation.\u201d<\/p>\n<p>Stack\u2019s PR gambit may come back to bite him. Despite his company\u2019s <a href=\"https:\/\/www.nytimes.com\/2018\/02\/28\/business\/walmart-and-dicks-major-gun-retailers-will-tighten-rules-on-guns-they-sell.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"sues-walmart-dicks-denied-firearm-purchases\" title=\"20-Year-Old Sues Walmart, Dick\u2019s After Being Denied Firearm Purchases\">insistence<\/a> that the policy is \u201cin accordance with the law,\u201d legal experts like UCLA\u2019s <a href=\"https:\/\/reason.com\/volokh\/2018\/03\/06\/age-discrimination-suit-against-dicks-sp\" target=\"_blank\" class=\"clickTracking\" campaign=\"sues-walmart-dicks-denied-firearm-purchases\" title=\"20-Year-Old Sues Walmart, Dick\u2019s After Being Denied Firearm Purchases\">Eugene Volokh<\/a> call the case \u201copen and shut for the plaintiff and against Dick&#8217;s.\u201d<\/p>\n<p>The Democrat-controlled Oregon legislature could always amend the law to include a firearm exception or raise the age limit for firearm purchases for all retailers, but for now it looks like Watson is going to get his guns.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>These retailers didn\u2019t just violate the law, according to the complaints.
