{"id":89196,"date":"2018-03-08T13:50:29","date_gmt":"2018-03-08T18:50:29","guid":{"rendered":"https:\/\/www.gunsamerica.com\/blog\/?p=89196"},"modified":"2018-03-08T13:50:29","modified_gmt":"2023-08-30T17:56:41","slug":"florida-senate-big-gun-bill","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/florida-senate-big-gun-bill\/","title":{"rendered":"Update: Florida Senate &amp; House Approve Big Gun Bill: Bump Stock Ban, Age Restrictions, 3-Day Waits"},"content":{"rendered":"<h2><strong>UPDATE: 3\/8\/18<\/strong><\/h2>\n<p>Looks like the Florida GOP-controlled House has followed suit, voting 67-50 to enact\u00a0 the \u201c<a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2018\/07026\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-senate-big-gun-bill\" title=\"Update: Florida Senate &amp; House Approve Big Gun Bill: Bump Stock Ban, Age Restrictions, 3-Day Waits\">Marjory Stoneman Douglas High School Public Safety Act.<\/a>&#8221;<\/p>\n<p>As mentioned below, the 105-page bill contains measures to both improve school security and tighten restrictions on gun ownership.<\/p>\n<p>One of our readers was specifically concerned about the portion of the bill that bans bump stocks and similar devices.\u00a0 From the legislation:<\/p>\n<p><strong>790.222 Bump-fire stocks prohibited<\/strong>.\u2014<em>A person may not\u00a0import into this state or transfer, distribute, sell, keep for sale, offer for sale, possess, or give to another person a bump fire stock. A person who violates this section commits a felony of the third degree, punishable as provided in s. 775.082, s.741 775.083, or s. 775.084. <\/em><\/p>\n<p><em>As used in this section, the term \u201cbum fire stock\u201d means a conversion kit, a tool, an accessory, or a\u00a0device used to alter the rate of fire of a firearm to mimic\u00a0automatic weapon fire or which is used to increase the rate of fire to a faster rate than is possible for a person to fire such\u00a0semiautomatic firearm unassisted by a kit, a tool, an accessory,\u00a0or a device.<\/em><\/p>\n<p>The question is whether there is a grandfather clause for current owners of reciprocating stocks.\u00a0 Doesn&#8217;t appear to be the case based on the text.<\/p>\n<p>Gov. Rick Scott, meanwhile, will now review the bill and decide whether it&#8217;s worthy of his John Hancock.<\/p>\n<p>&#8220;I&#8217;m going to take the time and I&#8217;m going to read the bill and I&#8217;m going to talk to families,&#8221; <a href=\"https:\/\/abcnews.go.com\/Politics\/wireStory\/gov-rick-scott-sign-legislatures-compromise-guns-53605936\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-senate-big-gun-bill\" title=\"Update: Florida Senate &amp; House Approve Big Gun Bill: Bump Stock Ban, Age Restrictions, 3-Day Waits\">said<\/a> the Republican governor.<\/p>\n<p><span data-mce-type=\"bookmark\" style=\"width: 0px;overflow: hidden;line-height: 0\" class=\"mce_SELRES_start\">\ufeff<\/span><\/p>\n<p style=\"text-align: center\">***<\/p>\n<p class=\"p1\">Things are moving fast in the Sunshine State.<span class=\"Apple-converted-space\">\u00a0 <\/span>The Florida Senate this week approved a comprehensive gun control package in response to the mass killing at the Marjory Stoneman Douglas High School in Parkland.<\/p>\n<p class=\"p1\">Narrowly, by a vote of 20-18, the Senate approved bills to ban gun sales to anyone under the age of 21, prohibit the purchase and possession of bump stocks and establish a three-day wait period for all gun buyers.<\/p>\n<h2>SEE ALSO:\u00a0<a href=\"https:\/\/www.gunsamerica.com\/blog\/florida-gov-rick-scott-announces-major-action-plan-stop-school-shootings\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-senate-big-gun-bill\" title=\"Update: Florida Senate &amp; House Approve Big Gun Bill: Bump Stock Ban, Age Restrictions, 3-Day Waits\">Florida Gov. Rick Scott Announces \u2018Major Action Plan\u2019 to Stop School Shootings<\/a><\/h2>\n<p class=\"p1\">Along with those anti-gun provisions, the package sets aside $400 million for hardening schools and improving mental health services.<span class=\"Apple-converted-space\">\u00a0 <\/span>Funds may be used for mobile crisis teams, the purchase of metal detectors, bulletproof glass and the hiring of student resource officers, reports <a href=\"https:\/\/www.npr.org\/sections\/thetwo-way\/2018\/03\/05\/591036676\/florida-senate-approves-gun-control-package-oks-arming-some-school-personnel\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-senate-big-gun-bill\" title=\"Update: Florida Senate &amp; House Approve Big Gun Bill: Bump Stock Ban, Age Restrictions, 3-Day Waits\">NPR<\/a>.<\/p>\n<p class=\"p1\">Teachers are barred from carrying guns under a last-minute amendment proposed by Sen. Rene Garcia (R-Miami).<span class=\"Apple-converted-space\">\u00a0 <\/span>But other school personnel including support staff, those who are current or retired military and JROTC instructors would be exempt.<\/p>\n<p class=\"p1\">\u201cThe goal is to make sure that those instructional personnel that are in the classroom cannot participate in the program,\u201d Garcia told<a href=\"https:\/\/www.miamiherald.com\/news\/politics-government\/state-politics\/article203601899.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-senate-big-gun-bill\" title=\"Update: Florida Senate &amp; House Approve Big Gun Bill: Bump Stock Ban, Age Restrictions, 3-Day Waits\"> The Miami Herald<\/a>. \u201cThis is an opt-in program &#8230; It\u2019s dependent on the school district and the sheriff to determine if it participates in the program.\u201d<\/p>\n<p class=\"p1\">Legislation to ban black rifles and magazines with a capacity of 10 or more rounds was voted down.<\/p>\n<p class=\"p1\">The Florida House will now take a look at the legislation.<span class=\"Apple-converted-space\">\u00a0 <\/span>Given its tendency to lean pro-gun, it\u2019s likely that more changes will be made to the package before it lands on the desk of Gov.
