This just in, Trump has ordered the Department of Justice to ban bump stocks and other modifications like the ones allegedly used in the Las Vegas shooting.<\/p>\n

ATF, which reports to the DOJ, is currently reviewing whether bump stocks should be reclassified<\/a> as “machine guns” under the National Firearms Act.<\/p>\n

What’s not exactly clear is how the president is able to create a law that bans these devices.\u00a0 One would think that this would be a job for the legislative branch.<\/p>\n

Further complicating the matter is that the ATF has said on two separate occasions, once in 2010 and then again in 2012, that bump stocks are a “firearm part,” not a machine gun (or a firearm part whose sole purpose<\/a> is to convert semiautos into full autos).\u00a0 Therefore, they’re not to be regulated as an NFA item.<\/p>\n

Additionally, the DOJ told the NY Times<\/a>\u00a0back in December that banning reciprocating stocks would not be likely “without Congressional action.”\u00a0 Lawmakers have introduced legislation to prohibit bump stocks<\/a> and trigger cranks and other accessories but it has not yet cleared either chamber.<\/p>\n

Details on this story are still developing.\u00a0 Stay tuned for updates.\u00a0 I’m not sure what to make of this until I get all the facts.\u00a0 Could be fake news.\u00a0 Could be the beginning of something crazy…<\/p>\n

Presidential Memorandum on the Application of the Definition of Machinegun to \u201cBump Fire\u201d Stocks and Other Similar Devices<\/h2>\n

After the deadly mass murder in Las Vegas, Nevada, on October 1, 2017, I asked my Administration to fully review how the Bureau of Alcohol, Tobacco, Firearms and Explosives regulates bump fire stocks and similar devices.<\/em><\/p>\n

Although the Obama Administration repeatedly concluded that particular bump stock type devices were lawful to purchase and possess, I sought further clarification of the law restricting fully automatic machineguns.<\/em><\/p>\n

Accordingly, following established legal protocols, the Department of Justice started the process of promulgating a Federal regulation interpreting the definition of \u201cmachinegun\u201d under Federal law to clarify whether certain bump stock type devices should be illegal. The Advanced Notice of Proposed Rulemaking was published in the Federal Register on December 26, 2017. Public comment concluded on January 25, 2018, with the Department of Justice receiving over 100,000 comments.<\/em><\/p>\n

Today, I am directing the Department of Justice to dedicate all available resources to complete the review of the comments received, and, as expeditiously as possible, to propose for notice and comment a rule banning all devices that turn legal weapons into machineguns.<\/em><\/p>\n

Although I desire swift and decisive action, I remain committed to the rule of law and to the procedures the law prescribes. Doing this the right way will ensure that the resulting regulation is workable and effective and leaves no loopholes for criminals to exploit. I would ask that you keep me regularly apprised of your progress.<\/em><\/p>\n

You are authorized and directed to publish this memorandum in the Federal Register.<\/em><\/p>\n

When in doubt about the president’s position. Just look to Twitter!\u00a0 There you will find the answers.\u00a0 President Trump on Thursday articulated his positions on gun control and arming teachers in the wake of the Parkland, Florida school shooting.<\/p>\n

First the bad news.\u00a0 Trump is pushing for “comprehensive background checks with an emphasis on mental health,” which is presumably another name for the Fix NICS Act<\/a>.\u00a0 That’s not so bad.\u00a0 What sucks is that he supports Sen. Dianne Feinstein’s bill to block persons under the age of 21 from buying long guns.\u00a0 Moreover, Trumpster also wants to ban bump stocks (as noted above).<\/p>\n

I will be strongly pushing Comprehensive Background Checks with an emphasis on Mental Health. Raise age to 21 and end sale of Bump Stocks! Congress is in a mood to finally do something on this issue – I hope!<\/p>\n

While none of that will stop the next school shooting, Trump did say that he supports arming teachers. Not all teachers, but some. A common sense approach that may not be appropriate for all school districts but would certainly work for many.<\/p>\n

I never said \u201cgive teachers guns\u201d like was stated on Fake News @CNN<\/a> & @NBC<\/a>. What I said was to look at the possibility of giving \u201cconcealed guns to gun adept teachers with military or special training experience – only the best. 20% of teachers, a lot, would now be able to<\/p>\n
