(<em>Photo: Omaha.com<\/em>)<\/p><\/div>\n<p>An Omaha, Nebraska, man known to have gang affiliations has been sentenced to 18 months in prison after his daughter was shot in the face by his friend\u2019s 22-month-old son.<\/p>\n<p>Marquell Buie, 22, was convicted of negligent child abuse after leaving his loaded handgun on a kitchen counter where it was picked up and fired by the two-year-old boy. Buie\u2019s daughter, 17-month-old Ma\u2019Laya, was shot in the face.<\/p>\n<p>The young girl survived, but she suffered the loss of an eye and extensive brain damage.<\/p>\n<p>Investigators learned that Buie and a friend, 22-year-old Mosell Gulley, were smoking marijuana and watching a movie while their young children played, according to the <a href=\"https:\/\/www.omaha.com\/news\/crime\/omaha-dad-of-toddler-girl-who-was-shot-in-the\/article_5a4c417c-c280-55d4-91d2-4513ff9e1d70.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"omaha-gang-member-sentenced-18-months-daughter-accidentally-shot-face\" title=\"Omaha Gang Member Sentenced to 18 Months After His Daughter Was Accidentally Shot in the Face\">Omaha World-Herald<\/a>. The 9mm round fired by Gully\u2019s son passed through Ma\u2019Laya\u2019s face before embedding itself in a hot water heater.<\/p>\n<p>Buie pled no-contest to negligent child abuse resulting in serious bodily injury. Douglas County District Judge Mark Ashford sentenced Buie to the maximum three-year term. Which is cut in half under state law.<\/p>\n<p>After he completes his sentence, Buie will serve a term of nine months of supervised release. He was also ordered last summer to have <a href=\"https:\/\/www.omaha.com\/news\/crime\/father-of-toddler-who-was-shot-in-the-face-ordered\/article_9ad08e26-462e-11e7-a10d-63d92edf9aeb.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"omaha-gang-member-sentenced-18-months-daughter-accidentally-shot-face\" title=\"Omaha Gang Member Sentenced to 18 Months After His Daughter Was Accidentally Shot in the Face\">no contact with his daughter<\/a>.<\/p>\n<p>Doctors initially thought Ma\u2019Laya would not survive her injuries, according to prosecutor Eric Fabian. When she was eventually released from the hospital, she entered Madonna Rehabilitation Hospital. There, therapists had to teach her to walk, talk, and eat again.<\/p>\n<p>Ragine Moore, Ma\u2019Laya\u2019s mother and Buie\u2019s girlfriend, told the World-Herald that doctors hope continuing rehab will allow Ma\u2019Laya to fully recover. She argued that Buie cooperated with police and wasn\u2019t the one who pulled the trigger.<\/p>\n<p>\u201cThe charges should be on the parent of the child that shot my daughter \u2014 his child was unattended,\u201d said Moore, 22, referring to Gulley.<\/p>\n<p>She told the World-Herald that she\u2019s having trouble making ends meet after Buie\u2019s incarceration, since his job at Nebraska Furniture Mart was the family\u2019s source of income.<\/p>\n<p>\u201cHe\u2019s not doing good, he wants to see his baby,\u201d she said of Buie. \u201cIt\u2019s his daughter, and he\u2019s missing out on her recovery process.\u201d<\/p>\n<p>According to the <a href=\"https:\/\/www.cdc.gov\/injury\/images\/lc-charts\/leading_causes_of_death_age_group_2015_1050w740h.gif\" target=\"_blank\" class=\"clickTracking\" campaign=\"omaha-gang-member-sentenced-18-months-daughter-accidentally-shot-face\" title=\"Omaha Gang Member Sentenced to 18 Months After His Daughter Was Accidentally Shot in the Face\">Centers for Disease Control and Prevention<\/a>, unintentional injury was the leading cause of death in children ages 1-4 in 2015. Drowning, traffic accidents, suffocation, and fire were the top four causes of unintentional death by injury.
