He should have been listed in the FBI\u2019s National Instant Criminal Background Check System (NICS) as a \u201cprohibited person.\u201d<\/p>\n<p>However, the Air Force failed to turn those records over to NICS. Since those records were not reported, the killer was able to purchase the rifle he used in the attack from a gun store in San Antonio.<\/p>\n<p>The<a href=\"https:\/\/cdn.cnn.com\/cnn\/2017\/images\/12\/26\/edva.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-philly-sanfran-suing-doj-nics\" title=\"Why New York, Philly, SanFran are Suing the DOJ over NICS\"> lawsuit<\/a> \u201cseeks narrowly-tailored injunctive relief to make certain that never happens again.\u201d<\/p>\n<h2>SEE ALSO:\u00a0<a href=\"https:\/\/www.gunsamerica.com\/blog\/texas-hero-speaks-stopping-church-shooter-ar\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-philly-sanfran-suing-doj-nics\" title=\"Why New York, Philly, SanFran are Suing the DOJ over NICS\" rel=\"bookmark\">Texas Hero Speaks Out About Stopping Church Shooter with AR-15<\/a><\/h2>\n<p>Attorney General Jeff Sessions has already ordered the FBI and ATF to do \u201ca comprehensive review of the NICS.\u201d But those municipalities believe the internal audit is not enough. They want an independent third party to get involved to ensure compliance and establish a timetable for completion.<\/p>\n<p>&#8220;The national criminal background check system is the backbone of common-sense gun regulations,&#8221; San Francisco City Attorney Dennis Herrera said in a statement.<\/p>\n<p>&#8220;The Defense Department&#8217;s failure to fulfill its legal duty and accurately report criminal convictions puts innocent Americans at risk,\u201d he continued \u201cIt is past time to ensure that we&#8217;re doing everything we can to keep guns out of the wrong hands.&#8221;<\/p>\n<p>The lawsuit comes on the heels of a \u201c<a href=\"https:\/\/www.gunsamerica.com\/blog\/nssf-fix-nics-act-not-gun-control\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-philly-sanfran-suing-doj-nics\" title=\"Why New York, Philly, SanFran are Suing the DOJ over NICS\">Fix NICS<\/a>\u201d bill that was added to the Concealed Carry Reciprocity Act of 2017. The House <a href=\"https:\/\/www.gunsamerica.com\/blog\/concealed-carry-reciprocity-act-2017-passes-house\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-philly-sanfran-suing-doj-nics\" title=\"Why New York, Philly, SanFran are Suing the DOJ over NICS\">voted to pass the legislation<\/a> earlier this month.<\/p>\n<p>It seems that the holes in NICS are obvious enough to everyone at this point. Though, a word of caution to those who view a \u201cfixed\u201d NICS as a panacea for gun violence. It won\u2019t be. Relying on a government system to keep you safe is like relying on the mainstream media to tell you the truth.
