The Supreme Court: Where gun rights cases go to die.\u00a0 LOL.<\/p><\/div>\n

The Supreme Court gave the cold shoulder to gun rights on Monday, turning away cases challenging Maryland’s black rifle ban and Florida’s open carry prohibition.<\/p>\n

The high court did not elaborate on why it turned away:\u00a0Kolbe v. Hogan <\/em><\/a>and Norman v. Florida<\/a>.\u00a0<\/em><\/p>\n

Kolbe v. Hogan<\/em><\/h2>\n

The Free State’s Firearms Safety Act of 2013<\/a> was enacted shortly after Sandy Hook.\u00a0 It expanded the Maryland’s ban on so-called “assault weapons” and included magazines holding more than 10 rounds.<\/p>\n

Gun rights advocates sued, arguing that the ban violated the constitutional rights of law-abiding citizens.\u00a0 The case eventually landed at the door of the 4th Circuit Court of Appeals.<\/p>\n

Earlier this year, citing the landmark\u00a0Heller<\/em> decision<\/a>, the Fourth Circuit upheld the ban in a 10-4 decision.<\/p>\n

\u201cWe are convinced that the banned assault weapons and large-capacity magazines are among those arms that are \u2018like\u2019 \u2018M-16 rifles\u2019 \u2014 \u2018weapons that are most useful in military service\u2019 \u2014 which the Heller<\/em> Court singled out as being beyond the Second Amendment\u2019s reach,\u201d\u00a0wrote Judge Robert B. King, in the majority opinion.<\/p>\n

King continued. \u201cPut simply, we have no power to extend Second Amendment protection to the weapons of war that the Heller<\/em> decision explicitly excluded from such coverage.\u201d<\/p>\n

Gun rights advocates hoped that by appealing it to SCOTUS, the justices would take up the case and set things straight.\u00a0 Well, today we got their answer.\u00a0 It’s a no-go.\u00a0 The Maryland black rifle ban will stand.<\/p>\n

\u201cMaryland’s ban on commonly owned firearms and magazines violates our fundamental, individual right to keep and bear arms for self-defense,” said the NRA-ILA in a statement Monday.<\/p>\n

“The court\u2019s decision in District of Columbia v. Heller clearly stated that arms in common use for lawful purposes are protected by the Second Amendment and thus cannot be subject to an outright ban,” it continued.<\/p>\n

Norman v. Florida<\/em><\/h2>\n

This case involves Dale Norman, a permitted concealed carrier.\u00a0 Norman was nabbed by Fort Pierce police in 2012 because his gun became visible while walking down a sidewalk. That’s right, folks.\u00a0 Openly carrying firearms in the Gunshine state is a crime, with few exceptions.<\/p>\n

Norman was convicted of a misdemeanor, appealed the conviction, and followed the appeal process all the way to the Florida Supreme Court.<\/p>\n

In a 4-2 decision back in March, the Florida Supreme Court upheld the state’s ban on open carry<\/a>.<\/p>\n

The court\u00a0reasoned<\/a>\u00a0that because the ban on open carry regulates \u201conly one manner of bearing arms,\u201d it \u201cdoes not impair the exercise of the fundamental right to bear arms.\u201d<\/p>\n

In other words, because Florida residents generally have easy access to concealed carry permits, banning open carry does not significantly limit their right Second Amendment rights.<\/p>\n

Norman’s attorneys then tried their luck with the Supreme Court.\u00a0 Hoping that the high court would weigh in.\u00a0 Well, it declined.\u00a0 As a result, Florida’s open carry ban will stand.<\/p>\n

The Florida Legislature has taken up open carry bills in the recent past.\u00a0 But getting a bill to clear the Senate has proven to be difficult.<\/p>\n

Senate Judiciary Chairman Greg Steube (R-Sarasota) told the Orlando Sentinel\u00a0<\/a>that although he introduced an open carry bill in 2017, he had no plans to file one for the 2018 legislative session starting in January.<\/p>\n
