{"id":82440,"date":"2017-11-16T10:52:04","date_gmt":"2017-11-16T15:52:04","guid":{"rendered":"https:\/\/www.gunsamerica.com\/blog\/?p=82440"},"modified":"2017-11-16T10:52:04","modified_gmt":"2023-08-21T09:22:40","slug":"breaking-bipartisan-gun-deal-reached","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/breaking-bipartisan-gun-deal-reached\/","title":{"rendered":"BREAKING: Bipartisan Gun Deal Reached!"},"content":{"rendered":"<p>Breaking news!\u00a0 A bipartisan group of senators reached an agreement on a new gun bill Thursday aimed at improving the FBI&#8217;s background check system.<\/p>\n<p>Known as the <a href=\"https:\/\/www.cornyn.senate.gov\/sites\/default\/files\/Fix%20NICS%20Act%20Bill%20Text.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-bipartisan-gun-deal-reached\" title=\"BREAKING: Bipartisan Gun Deal Reached!\">Fix NICS Act<\/a>, the legislation is designed to ensure federal and state authorities are submitting relevant mental and criminal history records to the FBI&#8217;s\u00a0National Instant Criminal Background Check System (NICS).<\/p>\n<p>Sponsors of the bill include some real heavy hitters on both sides of the gun divide.\u00a0 We&#8217;re talking,\u00a0John Cornyn (R-TX), Chris Murphy (D-CT), Tim Scott (R-SC), Richard Blumenthal (D-CT), Orrin Hatch (R-UT), Dianne Feinstein (D-CA), Dean Heller (R-NV), and Jeanne Shaheen (D-NH).<\/p>\n<p>\u201cFor years agencies and states haven\u2019t complied with the law, failing to upload these critical records without consequence,\u201d Sen. Cornyn said in a<a href=\"https:\/\/www.cornyn.senate.gov\/node\/4478\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-bipartisan-gun-deal-reached\" title=\"BREAKING: Bipartisan Gun Deal Reached!\"> press release<\/a>. \u201cJust one record that\u2019s not properly reported can lead to tragedy, as the country saw last week in Sutherland Springs, Texas.<\/p>\n<p>The senator is referring to the fact that the shooter at the church in Sutherland Springs had a documented history of domestic violence while serving in the Air Force. He cracked the skull of his infant stepson in addition to beating his former wife.<\/p>\n<p>Had that been reported, the gunman would&#8217;ve been designated a prohibited person.\u00a0 And, thus unable to\u00a0purchase a firearm at an FFL or gun store.\u00a0 It&#8217;s not clear why the Air Force failed to turn those records over to the FBI.<\/p>\n<p>&#8220;This bill aims to help fix what\u2019s become a nationwide, systemic problem so we can better prevent criminals and domestic abusers from obtaining firearms,&#8221; Cornyn concluded.<\/p>\n<h2>Bullet points for the Fix NICS Act:<\/h2>\n<ul>\n<li>Requires federal agencies and states to produce NICS implementation plans focused on uploading all information to the background check system showing that a person is prohibited from purchasing or possessing firearms under current law\u2014including measures to verify the accuracy of records.<\/li>\n<li>Holds federal agencies accountable if they fail to upload relevant records to the background check system through public reporting and prohibiting bonus pay for political appointees.<\/li>\n<li>Rewards states who comply with their NICS implementation plans through federal grant preferences and incentives, while increasing accountability through public reporting for those who do not comply with their plans.<\/li>\n<li>Reauthorizes and improves important law enforcement programs to help state governments share relevant criminal record information with NICS.<\/li>\n<li>Creates a Domestic Abuse and Violence Prevention Initiative to ensure that states have adequate resources and incentives to share all relevant information with NICS showing that a felon or domestic abuser is excluded from purchasing firearms under current law.<\/li>\n<li>Provides important technical assistance to federal agencies and states who are working to comply with NICS record-sharing requirements.<\/li>\n<\/ul>\n<p>\u201cThis deal will strengthen the background check system and save lives. Our bill marks an important milestone that shows real compromise can be made on the issue of guns. I\u2019m grateful that Senator Cornyn was such a strong partner and straightforward negotiator,\u201d said Sen. Murphy.<\/p>\n<p>\u201cIt\u2019s no secret that I believe much more needs to be done. But this bill will make sure that thousands of dangerous people are prevented from buying guns,&#8221; Murphy added. &#8220;It represents the strongest update to the background checks system in a decade, and provides the foundation for more compromise in the future.\u201d<\/p>\n<p>At first blush, there&#8217;s nothing too objectionable in the bill.\u00a0 The National Shooting Sports Foundation, the firearms industry trade organization, has been pushing a <a href=\"https:\/\/fixnics.org\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-bipartisan-gun-deal-reached\" title=\"BREAKING: Bipartisan Gun Deal Reached!\">Fix NICS campaign <\/a>for years.\u00a0 It appears that this new bill was crafted with that in mind.<\/p>\n<p>I reached out to the NSSF for comment.\u00a0 Should hear soon as to whether they give it the thumbs up or down.<\/p>\n<h2>UPDATE: Statements from the NSSF and Everytown for Gun Safety<\/h2>\n<p>&#8220;We commend Sen. Cornyn for his leadership to encourage state and federal agencies to enter all applicable records in the FBI\u2019s National Instant Criminal Background Check System (NICS),&#8221; said Lawrence G. Keane, Senior Vice President and General Counsel for the National Shooting Sports Foundation. &#8220;This legislation will provide states with the necessary resources to promptly and efficiently provide disqualifying records to NICS on those who are prohibited under current law from possessing firearms. Federally licensed firearms retailers rely upon NICS to prevent the sale of firearms to prohibited persons. This legislation will fix NICS so that background checks are accurate and reliable.&#8221;<\/p>\n<p>\u201cThe Sutherland Springs, Texas, mass shooting was another deadly reminder that the criminal background check system is only as good as the records it contains. This bipartisan legislation is an important first step to improve the background check system, and keep guns out of the hands of domestic abusers and criminals,&#8221; said John Feinblatt, the president of Everytown for Gun Safety. &#8220;A majority of mass shooters in this country have histories of domestic violence, and we\u2019re glad that Sens.
