Both accessories, as\u00a0 we&#8217;re told by industry folk, &#8220;simulate full auto fire.&#8221; The ATF classified the former as a \u201cfirearm part\u201d and the latter as a \u201cmachine gun.\u201d<\/p>\n<p>What gives? Is the ATF playing favorites? Is the agency failing to do its job by not classifying the bump stock a machine gun, as NRA executive vice president Wayne LaPierre intimated in a recent<a href=\"https:\/\/www.cbsnews.com\/news\/transcript-wayne-lapierre-on-face-the-nation-oct-8-2017\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"heres-why-atf-approved-bump-stock-but-not-autoglove\" title=\"Here\u2019s Why ATF Approved Bump Stock But Not AutoGlove\"> interview on CBS News<\/a>?<\/p>\n<p>Not that I\u2019m in the business of defending the ATF, but when it comes to the determination of the legality of the bump stock versus the AutoGlove it\u2019s a no-brainer. ATF made the proper call.<\/p>\n<p>Let me back up and say by \u201cproper call\u201d I don\u2019t mean the<em> right<\/em> call. The <em>right<\/em> call is to acknowledge that the National Firearms Act is a sham. That it should be fully repealed. That it&#8217;s an infringement on our Second Amendment.<\/p>\n<p>But that&#8217;s a convo for a different day. What I&#8217;m talking about today is the decision the ATF made based upon an honest reading of existing regs and established precedent with respect to similar devices.<\/p>\n<p>I\u2019m not an attorney. And I don\u2019t work for the ATF. You can take my opinion with a grain of salt. But I can read. And I have read both determination letters (<a href=\"https:\/\/www.slidefire.com\/downloads\/BATFE.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"heres-why-atf-approved-bump-stock-but-not-autoglove\" title=\"Here\u2019s Why ATF Approved Bump Stock But Not AutoGlove\">here<\/a> and <a href=\"https:\/\/www.vpc.org\/wp-content\/uploads\/2017\/10\/ATF-Auto-Glove-letter-2017.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"heres-why-atf-approved-bump-stock-but-not-autoglove\" title=\"Here\u2019s Why ATF Approved Bump Stock But Not AutoGlove\">here<\/a>) and, in my humble opinion, the ATF reasoning on both products is sound.\u00a0 As always, feel free to tell me I&#8217;m wrong in the comment section.<\/p>\n<h2>What is a Machine Gun?<\/h2>\n<p>Before we get at it, let&#8217;s start with an obvious question.\u00a0 What is a machine gun?\u00a0 Under the National Firearms Act, per\u00a026 U.S. Code \u00a7 5845, a machine gun is defined thusly:<\/p>\n<ul>\n<li>Any weapon which shoots, is designed to shoot, or can be readily restored to shoot, automatically more than one shot without manual reloading, by a single function of the trigger<\/li>\n<li>The frame or receiver of any such weapon<\/li>\n<li>Any part designed and intended solely and exclusively or combination of parts designed and intended for use in converting a weapon into a machinegun, or<\/li>\n<li>Any combination of parts from which a machinegun can be assembled if such parts are in the possession or under the control of a person.<\/li>\n<\/ul>\n<h2>Bump Stock is Legal<\/h2>\n<p>Good old Mr. bump stock. It&#8217;s a &#8220;firearm part,&#8221; according to the ATF.<\/p><\/div>\n<p>ATF wrote in 2010, in response to Slide Fire\u2019s submission, \u201cThe stock has no automatically functioning mechanical parts or springs and performs no automatic mechanical function when installed.\u201d<\/p>\n<p>\u201cIn order to use the installed device, the shooter must apply constant forward pressure with the non-shooting hand and constant rearward pressure with the shooting hand,\u201d it continues. \u201cAccordingly we find that the \u2018bump-stock\u2019 is a firearm part and is not regulated as a firearm under the Gun Control Act or the National Firearms Act.\u201d<\/p>\n<p>The main takeaway is that there is no automated firing. The shooter&#8217;s index finger is still technically doing the work, though it\u2019s aided by the inertia (or recoil) of the gun thanks to the sliding of the bump stock. Consequently, it\u2019s a part \u2014 not a machine gun.<\/p>\n<h2>AutoGlove&#8217;s TAD is a Problem<\/h2>\n<p>AutoGlove fails the smell test from the outset. It\u2019s called the <em>Auto<\/em>Glove for Christmas\u2019 sake. Okay, it shouldn\u2019t be judged by its name alone. How does this device work?<\/p>\n<p>The AutoGlove functions with the help of an electronically powered <strong>T<\/strong>rigger <strong>A<\/strong>ssist <strong>D<\/strong>evice (TAD). (<em>Photo: AutoGlove\/Facebook<\/em>)<\/p><\/div>\n<p>Because the AutoGlove uses electricity it immediately raises a red flag. ATF has ruled on three separate occasions that electrically-driven trigger devices are machine guns. Once in 1982 and twice in 1988.<\/p>\n<p>ATF makes another very important point regarding triggers. After a long legal paragraph defining the term \u201ctrigger,\u201d it states, \u201cIn both practical and legal terms, the \u2018trigger\u2019 of a firearm is whatever is used to initiate the firing sequence.\u201d<\/p>\n<p>When the AutoGlove is used on a firearm the TAD \u2014 not the trigger \u2014 initiates the firing sequence. It\u2019s now the mechanical element that gets the ball rolling. The conventional trigger of the gun becomes a subordinate part of the firing sequence.<\/p>\n<p>By comparison, the bump stock does not replace the trigger. Not at all. Like any other semiautomatic firearm, one\u2019s finger engages the trigger and the trigger initiates the firing sequence.<\/p>\n<p>Does that make sense?\u00a0 Clear as mud?<\/p>\n<h2>The AutoGlove is a Machine Gun<\/h2>\n<p>In this one sweeping paragraph, the ATF seals the fate of the beloved AutoGlove.\u00a0 Once you read it, it&#8217;s hard to argue that the agency missed the mark.<\/p>\n<blockquote><p>Electronically-driven trigger devices are considered \u201cmachine-guns\u201d because they are a \u201ccombination of parts designed and intended, for use in converting a weapon into a machine gun. Because these electronic devices use a switch\/button to activate the drive motor to initiate the firing sequence, that switch\/button is the firearm\u2019s trigger. Since the weapon firearms more than one round for each single function of its trigger (a single press on the AutoGloves\u2019 Activator Plunger), it would be a \u201cmachine-gun\u201d as defined.<\/p><\/blockquote>\n<p>Let me unpack that.\u00a0 The quote ATF refers to in the first sentence is part of the definition of a &#8220;machine gun,&#8221; as highlighted above.\u00a0 The second sentence relates to the trigger issue I explained. And the last sentence again refers to the definition of a &#8220;machine gun.&#8221;<\/p>\n<p>So, it&#8217;s a machine gun because it is a part that is designed to convert a semi-auto into a full auto, because it has an automated trigger system that when activated fires more than one round for a single function of the trigger.\u00a0 Remember, the TAD initiates the firing sequence (not the conventional trigger) and when it&#8217;s activated, when the plunger is pushed down, it has the capacity to continuously fire rounds.<\/p>\n<p>Sounds like a machine gun to me.\u00a0 Per the law.<\/p>\n<h2>Hold the Phone!<\/h2>\n<p>Wait a minute!\u00a0 Doesn&#8217;t the bump stock check the first box?\u00a0 Isn&#8217;t it a &#8220;part designed and intended solely and exclusively&#8230; for use in converting a weapon into a machine gun&#8221;?<\/p>\n<p>You may have been thinking this all along. But thanks, in part, to a smart play by Slide Fire, the inventors of the original bump stock, it doesn&#8217;t apply.\u00a0 See, Slide Fire\u00a0told the ATF that the part was &#8220;intended to assist persons whose hands have limited mobility to &#8216;bump-fire&#8217; an AR-15 type rifle.&#8221;<\/p>\n<p>Bump firing is not illegal. Bump fire is simply harnessing the recoil of a semiautomatic rifle to fire shots in rapid succession.\u00a0 But it&#8217;s still one trigger pull for every shot fired.<\/p>\n<p>The bump stock, which aids in this lawful way of operating a semiauto firearm, is not a machine gun.<\/p>\n<h2>The Last Salvo for AutoGlove<\/h2>\n<div id=\"attachment_77455\" style=\"width: 410px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/www.gunsamerica.com\/blog\/wp-content\/uploads\/2017\/08\/Screen-Shot-2017-08-03-at-10.51.52-AM.png\" target=\"_blank\" class=\"clickTracking\" campaign=\"heres-why-atf-approved-bump-stock-but-not-autoglove\" title=\"Here\u2019s Why ATF Approved Bump Stock But Not AutoGlove\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-77455\" title=\"Here\u2019s Why ATF Approved Bump Stock But Not AutoGlove\" class=\"wp-image-77455 size-medium\" src=\"https:\/\/www.gunsamerica.com\/blog\/wp-content\/uploads\/2017\/08\/Screen-Shot-2017-08-03-at-10.51.52-AM-400x271.png\" alt=\"Here\u2019s Why ATF Approved Bump Stock But Not AutoGlove\" width=\"400\" height=\"271\" srcset=\"https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2017\/08\/Screen-Shot-2017-08-03-at-10.51.52-AM-400x271.png 400w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2017\/08\/Screen-Shot-2017-08-03-at-10.51.52-AM-150x102.png 150w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2017\/08\/Screen-Shot-2017-08-03-at-10.51.52-AM.png 526w\" sizes=\"(max-width: 400px) 100vw, 400px\" \/><\/a><p id=\"caption-attachment-77455\" class=\"wp-caption-text\">The AutoGlove does not permanently affix to the rifle, but ATF says that&#8217;s &#8220;immaterial.&#8221;\u00a0 It doesn&#8217;t matter. (<em>Photo: AutoGlove\/Facebook<\/em>)<\/p><\/div>\n<p>The makers of the AutoGlove tried to get around the pesky NFA with two additional arguments.\u00a0 The first was that the AutoGlove isn&#8217;t permanently affixed to the firearm.\u00a0 It&#8217;s a glove!<\/p>\n<p>The second was that the TAD needs to be ever so slightly pulled towards\u00a0the trigger to activate the firing sequence.\u00a0 This &#8220;micro-trigger&#8221; pull, as they called it, means that without additional human interaction the gun does not discharge.<\/p>\n<p>ATF shot down both arguments.\u00a0 The agency said that &#8220;not being permanently affixed to the firearm&#8221; doesn&#8217;t matter. It&#8217;s &#8220;immaterial.&#8221; Nowhere in the definition of machine gun is it spelled out that the device has to be &#8220;permanently attached.&#8221;<\/p>\n<h2>SEE ALSO:\u00a0<a href=\"https:\/\/www.gunsamerica.com\/blog\/atf-suspend-green-tip-ammo-ban-reclassification\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"heres-why-atf-approved-bump-stock-but-not-autoglove\" title=\"Here\u2019s Why ATF Approved Bump Stock But Not AutoGlove\">ATF to Suspend \u2018Green Tip\u2019 Ammo Ban, Reclassification<\/a><\/h2>\n<p>For the second point about the micro-trigger pull, the ATF tested the AutoGlove and found that, well, it worked without additional human interaction. That little micro pull wasn&#8217;t necessary to get the gun to fire once the TAD was placed within the trigger guard.<\/p>\n<p>ATF said that, during testing, they even put forward pressure on the TAD to try to keep it away from the traditional trigger but there was still enough contact, and the rifle fired &#8220;continuously until the ammunition supply was exhausted.&#8221;\u00a0 The test was repeated multiple times with the same results.<\/p>\n<p>Oh, no.<\/p>\n<h2>Conclusion<\/h2>\n<p>You may be sitting back in your chair thinking that this is all just a bunch of hooey.\u00a0 I don&#8217;t disagree with that assessment.\u00a0 Both products should be lawful.\u00a0 As mentioned, I believe the NFA is a sham.<\/p>\n<p>You may also be thinking that while the ATF may have interpreted the law fairly in this instance, it&#8217;s still an agency that defaults to the political whims of the current administration.\u00a0 I don&#8217;t disagree with that either.\u00a0 Under Obama, the ATF <a href=\"https:\/\/www.gunsamerica.com\/blog\/atf-suspend-green-tip-ammo-ban-reclassification\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"heres-why-atf-approved-bump-stock-but-not-autoglove\" title=\"Here\u2019s Why ATF Approved Bump Stock But Not AutoGlove\">sought to &#8220;reclassify,&#8221; aka ban, green-tip ammo<\/a>.\u00a0 Under Trump, earlier this year, someone from the <a href=\"https:\/\/www.gunsamerica.com\/blog\/breaking-high-ranking-atf-official-proposes-de-regulation-suppressors-gun-imports\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"heres-why-atf-approved-bump-stock-but-not-autoglove\" title=\"Here\u2019s Why ATF Approved Bump Stock But Not AutoGlove\">ATF leaked a &#8220;white paper&#8221;<\/a>\u00a0that voiced support for suppressor de-regulation and the importation of M1 Garands.<\/p>\n<p>Until the ATF disbands, which probably will never happen, they are the devil we have to dance with.\u00a0 I think it&#8217;s best to reserve our criticism for them when they overreach or mess up, not when they do the job they&#8217;ve been tasked with.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Bump stock.
