It did not,\u201d said representatives of the National Rifle Association and the California Rifle &amp; Pistol Association.<\/p>\n<p>The California DOJ claims that its <a href=\"https:\/\/michellawyers.com\/wp-content\/uploads\/2017\/07\/OAL-File-Number-2017-0719-04FP.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"cali-doj-attempting-expand-definition-assault-weapon-without-public-comment\" title=\"Cali DOJ Attempting to Expand Definition of 'Assault Weapon' without Public Comment\">entire set of new firearm regulations<\/a> is exempt from the standard rulemaking procedure that, under a 1945 law called the <a href=\"https:\/\/oal.ca.gov\/publications\/administrative_procedure_act\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"cali-doj-attempting-expand-definition-assault-weapon-without-public-comment\" title=\"Cali DOJ Attempting to Expand Definition of 'Assault Weapon' without Public Comment\">Administrative Procedures Act<\/a>, allows the public time to comment on the new rules.<\/p>\n<p>The Department <em>is<\/em> granted an exemption from the APA under Penal Code section 30900, subdivision (b)(5). That section, however, only provides the DOJ a limited exemption from the APA rulemaking process for regulations relating solely to the <em>registration<\/em> of <em>newly defined<\/em> \u201cassault weapons.\u201d<\/p>\n<p>In other words, the DOJ can create new regulations without public comment, but only those that pertain to the \u201cassault weapon\u201d registration process and bullet buttons.<\/p>\n<p>The DOJ\u2019s new rules go far beyond both of those categories.<\/p>\n<p>\u201cSome [regulations] seek to create or amend a whole host of definitions for \u2018assault weapon\u2019 features and other terms,\u201d the NRA\u2019s representatives point out in a <a href=\"https:\/\/michellawyers.com\/wp-content\/uploads\/2017\/06\/FINAL-Opp-Ltr-to-DOJ-re-Bullet-Button-AWs.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"cali-doj-attempting-expand-definition-assault-weapon-without-public-comment\" title=\"Cali DOJ Attempting to Expand Definition of 'Assault Weapon' without Public Comment\">letter<\/a> to the state. The new rules also seek to \u201cregulate activities after the registration process,\u201d which should also be subject to public comment.<\/p>\n<h2>SEE ALSO:\u00a0<a href=\"https:\/\/www.gunsamerica.com\/blog\/california-city-councilman-uses-gun-repel-home-intruder\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"cali-doj-attempting-expand-definition-assault-weapon-without-public-comment\" title=\"Cali DOJ Attempting to Expand Definition of 'Assault Weapon' without Public Comment\">California City Councilman Uses Gun to Repel Home Intruder<\/a><\/h2>\n<p>The rule change, for example, unilaterally includes shotguns within the definition of \u201cassault weapon.\u201d Despite the fact that the legislature has never included shotguns in its \u201cassault weapon\u201d policies, the DOJ clarifies that the \u201c[a]bility to accept a detachable magazine\u2019 means with respect to a semiautomatic shotgun, [that] it does not have a fixed magazine.\u201d<\/p>\n<p>\u201cShotguns with \u2018bullet buttons\u2019 are now \u2018assault weapons\u2019 not by legislative change, but by DOJ\u2019s action alone,\u201d the NRA\u2019s lawyers note.<\/p>\n<p>Of the regulations that <em>do<\/em> pertain to the new registration process, the most onerous requires firearms owners to submit pictures of each firearm being registered:<\/p>\n<blockquote><p>One photo shall depict the bullet button style magazine release installed on the firearm. One photo shall depict the firearm from the end of the barrel to the end of the stock if it is a long gun or the point furthest from the end of the barrel if it is a pistol.
