It isn\u2019t every day we have good news from The Golden State.<\/p>\n<p>A federal judge in California ruled this week that the First Amendment protects the publication of anti-gun state legislators\u2019 personal information, as long as that information is already publically available.<\/p>\n<p>A pro-gun blogger writing under the pseudonym \u201cDoe Publius\u201d published on his blog what he called a \u201ctyrant registry\u201d: the names, telephone numbers, and home addresses of 40 anti-gun California legislators.<\/p>\n<p>\u201cIf you\u2019re a gun owner in California, the government knows where you live,\u201d he said in his post, according to <a href=\"https:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp-content\/uploads\/sites\/14\/2017\/02\/opinion.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"judge-california-gun-owners-tyrant-registry-protected-first-amendment\" title=\"Judge: California Gun Owner\u2019s 'Tyrant Registry' Protected Under First Amendment\">official court documents<\/a>. \u201cIsn\u2019t it about time to register these tyrants with gun owners?\u201d<\/p>\n<p>California state officials were not amused. The state legislative counsel ordered WordPress, the company that hosts Publius\u2019s site, to remove the post, citing a state law that restricts publication of government officials\u2019 personal information. They also claimed that several state legislators had received threatening phone calls to their homes since the publication of the list.<\/p>\n<p>WordPress complied, and Publius, along with another blogger who re-posted the \u201ctyrant registry,\u201d sued the state on First Amendment grounds.<\/p>\n<p>They argued that because Publius only published publically available information, the registry is protected under First Amendment speech. The registry is further protected, they argued, because it is a political statement responding to California\u2019s recent legislation that creates a registry for those who purchase ammunition.<\/p>\n<p>The courts agreed. Judge Lawrence J. O\u2019Neill of the U.S. District Court for the Eastern District of California sided with Publius, finding that the plaintiffs are \u201clikely to succeed\u201d in their First Amendment claims.<\/p>\n<p>\u201cThe legislators\u2019 home address and telephone number touch on matters of public concern,\u201d the\u00a0judge said in the\u00a0<a href=\"https:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp-content\/uploads\/sites\/14\/2017\/02\/opinion.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"judge-california-gun-owners-tyrant-registry-protected-first-amendment\" title=\"Judge: California Gun Owner\u2019s 'Tyrant Registry' Protected Under First Amendment\">38-page opinion<\/a>.<\/p>\n<p>\u201cThere is no dispute that Plaintiffs lawfully obtained and truthfully published information that was readily available online,\u201d O\u2019Neill continued. \u201cWhen lawfully obtained, the truthful publication of that information falls within the First Amendment\u2019s ambit.\u201d<\/p>\n<p>Publius responded to the decision on Monday, saying in a <a href=\"https:\/\/therealwritewinger.wordpress.com\/2017\/02\/28\/victory-for-the-tyrant-registry\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"judge-california-gun-owners-tyrant-registry-protected-first-amendment\" title=\"Judge: California Gun Owner\u2019s 'Tyrant Registry' Protected Under First Amendment\">blog post<\/a> that the victory is about more than his personal freedoms: the court\u2019s decision is \u201ca win for freedom of speech and political protest, and most importantly a win for those Californians who have had their civil rights and liberties violated by our state legislators for simply wanting to exercise their fundamental right to keep and bear arms,\u201d he said.<\/p>\n<p>\u201cMuch like the Sex Offender Registry, this common sense tyrant registration addresses a public safety hazard alerting the public of tyrants who have violated the civil rights and liberties of people in their communities.\u201d<\/p>\n<p>California has until March 10 to decide whether or not it wants to continue the fight. A spokesman from the state legislature told the <a href=\"https:\/\/www.washingtonpost.com\/national\/judge-blocks-california-law-protecting-officials-privacy\/2017\/02\/27\/e06414a8-fd54-11e6-9b78-824ccab94435_story.html?tid=a_inl&amp;utm_term=.789bc1dcf2c5\" target=\"_blank\" class=\"clickTracking\" campaign=\"judge-california-gun-owners-tyrant-registry-protected-first-amendment\" title=\"Judge: California Gun Owner\u2019s 'Tyrant Registry' Protected Under First Amendment\">Associated Press<\/a> that they\u2019re evaluating their next steps.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Savor this, Californians.
