{"id":70649,"date":"2017-02-22T10:50:50","date_gmt":"2017-02-22T15:50:50","guid":{"rendered":"https:\/\/www.gunsamerica.com\/blog\/?p=70649"},"modified":"2017-02-22T10:50:50","modified_gmt":"2023-08-20T18:54:51","slug":"breaking-4th-circuit-upholds-maryland-assault-weapon-ban","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/breaking-4th-circuit-upholds-maryland-assault-weapon-ban\/","title":{"rendered":"BREAKING: 4th Circuit Upholds Maryland \u2018Assault Weapons\u2019 Ban"},"content":{"rendered":"<p>The Fourth Circuit Court of Appeals dealt a big blow to the Second Amendment Tuesday by emphatically upholding Maryland\u2019s ban on so-called \u2018assault weapons\u2019 and \u2018high-capacity\u2019 magazines in the case of <em><a href=\"https:\/\/scholar.google.com\/scholar_case?case=12567978536866210826&amp;q=Kolbe+v.+Hogan&amp;hl=en&amp;as_sdt=4000006&amp;as_vis=1\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-4th-circuit-upholds-maryland-assault-weapon-ban\" title=\"BREAKING: 4th Circuit Upholds Maryland \u2018Assault Weapons\u2019 Ban\">Kolbe v. Hogan<\/a>.<\/em><\/p>\n<p>In a 10-4 <a href=\"https:\/\/www.ca4.uscourts.gov\/Opinions\/Published\/141945A.P.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-4th-circuit-upholds-maryland-assault-weapon-ban\" title=\"BREAKING: 4th Circuit Upholds Maryland \u2018Assault Weapons\u2019 Ban\">majority opinion<\/a>, the court, which is based out of Richmond, Virginia, wrote that the Supreme Court\u2019s landmark 2008 <a href=\"https:\/\/www.law.cornell.edu\/supct\/html\/07-290.ZO.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-4th-circuit-upholds-maryland-assault-weapon-ban\" title=\"BREAKING: 4th Circuit Upholds Maryland \u2018Assault Weapons\u2019 Ban\"><em>Heller v. District of Columbia<\/em><\/a> decision left the door open to permit governments to regulate firearms that are similar to those issued to military personnel.<\/p>\n<p>&#8220;Both before and after Newtown, similar military-style rifles and detachable magazines have been used to perpetrate mass shootings in places whose names have become synonymous with the slaughters that occurred there,&#8221; wrote Judge Robert B. King in the majority opinion.<\/p>\n<p>&#8220;We are convinced that the banned assault weapons and large-capacity magazines are among those arms that are &#8216;like&#8217; &#8216;M-16 rifles&#8217; \u2014 &#8216;weapons that are most useful in military service&#8217; \u2014 which the Heller Court singled out as being beyond the Second Amendment&#8217;s reach,&#8221; King continued. \u201cPut simply, we have no power to extend Second Amendment protection to the weapons of war that the Heller decision explicitly excluded from such coverage.\u201d<\/p>\n<p>To make its case about black rifles, the opinion cites a 1994 Treasury Department study that identified certain rifle features and accessories that \u201cserve specific, combat-functional ends.\u201d Those include the usual suspects: flash suppressors, barrel shrouds, folding and telescoping stocks, pistol grips, grenade launchers, night sights, bayonet mounts and large capacity magazines.<\/p>\n<p>\u201cThe banned assault weapons \u2018are firearms designed for the battlefield, for the soldier to be able to shoot a large number of rounds across a battlefield at a high rate of speed,\u2019\u201d the opinion reads, citing the filings. \u201cTheir design results in \u2018a capability for lethality \u2014 more wounds, more serious, in more victims \u2014 far beyond that of other firearms in general, including other semiautomatic guns.\u2019\u201d<\/p>\n<p>Passed in the wake of Sandy Hook, Maryland\u2019s Firearms Safety Act of 2013 banned magazines with a capacity greater than 10 rounds and center-fire semiautomatic rifles that accept detachable magazines and have two or more of those aforementioned scary features and accessories. Those who possessed an \u2018assault weapon\u2019 prior to 10\/1\/2013 were allowed to maintain possession of it provided they register it with the state authorities.<\/p>\n<p>The National Shooting Sports Foundation, along with two Maryland gun owners, sued the state arguing that the sweeping ban was unconstitutional because AR and AK rifle platforms are commonly possessed for lawful purposes, particularly self-defense.<\/p>\n<p>Judge William Byrd Traxler, Jr., who wrote the dissenting opinion and was joined by three other judges, trashed the majority decision.<\/p>\n<p>\u201cToday the majority holds that the Government can take semiautomatic rifles away from law-abiding American citizens,\u201d wrote Traxler. \u201cIn concluding that the Second Amendment does not even apply, the majority has gone to greater lengths than any other court to eviscerate the constitutionally guaranteed right to keep and bear arms.\u201d<\/p>\n<p>Traxler also said that the court should apply a stricter review before the law is allowed to stand.<\/p>\n<p>\u201cFor a law-abiding citizen who, for whatever reason, chooses to protect his home with a semi-automatic rifle instead of a semi-automatic handgun, Maryland\u2019s law clearly imposes a significant burden on the exercise of the right to arm oneself at home, and it should at least be subjected to strict scrutiny review before it is allowed to stand,\u201d he wrote.<\/p>\n<p>This marks the fifth time a federal appeals\u00a0court has rejected a lawsuit challenging the constitutionality of a ban on modern sporting rifles. Overall, seven states and the District of Columbia have strict bans on the ownership of black rifles.<\/p>\n<p style=\"text-align: center\">***<\/p>\n<p>My $.02. The ruling is B.S. But what\u2019s even more\u00a0frustrating is the hole in the <em>Heller Decision<\/em> that has given these appeals courts the grounds on which to uphold these asinine bans. When Scalia wrote the Heller decision, he knew he had left the door open on this issue. As he famously stated\u00a0in an interview with Fox News on the constitutionality of black rifles, \u201cIt\u2019ll have to be decided\u201d (see video above).<\/p>\n<p>\u201cYes, there are some limitations that can be imposed,\u201d Scalia told Fox New\u2019s Chris Wallace. \u201cWhat they are will depend on what the society understood was reasonable limitation\u201d during the founding and framing of the Constitution. Scalia gave a historical example, a \u201chead axe,\u201d which was banned under an affrighting statute that prohibited weapons designed to intimidate and\/or scare people.<\/p>\n<p>Wallace then asked Scalia about black rifles, which can fire \u201ca hundred shots in a minute,\u201d and whether or not those can be banned by state governments and municipalities without violating one\u2019s right to keep and bear arms.<\/p>\n<p>\u201cThe [2nd Amendment] does not apply to arms that cannot be hand-carried,\u201d Scalia said. \u201cIt\u2019s to keep and bear. So, it doesn\u2019t apply to cannons.
