{"id":63497,"date":"2016-09-15T16:04:49","date_gmt":"2016-09-15T20:04:49","guid":{"rendered":"https:\/\/www.gunsamerica.com\/blog\/?p=63497"},"modified":"2016-09-15T16:04:49","modified_gmt":"2023-08-20T05:47:07","slug":"breaking-missouri-lawmakers-override-governor-veto-enact-constitutional-carry","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/breaking-missouri-lawmakers-override-governor-veto-enact-constitutional-carry\/","title":{"rendered":"Breaking: Missouri Lawmakers Override Governor Veto to Enact Constitutional Carry!"},"content":{"rendered":"<p class=\"p1\">Missouri became the latest state to enact Constitutional Carry after the Legislature voted Wednesday to override the governor\u2019s veto of <a href=\"https:\/\/www.senate.mo.gov\/14info\/pdf-bill\/tat\/SB656.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-missouri-lawmakers-override-governor-veto-enact-constitutional-carry\" title=\"Breaking: Missouri Lawmakers Override Governor Veto to Enact Constitutional Carry!\">Senate Bill 656<\/a>.<\/p>\n<p class=\"p1\">Senate Bill 656 contains all sorts of goodies for law-abiding citizens.<span class=\"Apple-converted-space\">\u00a0 <\/span>In a nutshell, here are some of the main highlights:<\/p>\n<ul>\n<li class=\"p1\">Allows Missourians to carry a concealed weapon without training or a permit in areas that do not prohibit open carry.<\/li>\n<li class=\"p1\">Expands Missouri\u2019s \u201ccastle doctrine\u201d to allow invited guests (such as babysitters) to use deadly force against intruders.<\/li>\n<li class=\"p1\">Creates a \u201cstand-your-ground\u201d statute, which removes an individual\u2019s duty to retreat from danger in any place they are legally entitled to be present.<\/li>\n<\/ul>\n<p class=\"p1\">It should be noted that Senate Bill 656 does not completely eliminate Missouri\u2019s concealed carry permit program.<span class=\"Apple-converted-space\">\u00a0 <\/span>Residents may still want to obtain a permit for reciprocity purposes when traveling into other states that honor the Missouri CCW permits.<\/p>\n<p class=\"p1\">As the NRA-ILA <a href=\"https:\/\/www.nraila.org\/articles\/20160914\/nra-applauds-veto-override-of-senate-bill-656-in-missouri\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-missouri-lawmakers-override-governor-veto-enact-constitutional-carry\" title=\"Breaking: Missouri Lawmakers Override Governor Veto to Enact Constitutional Carry!\">noted<\/a>, SB 656 does modify the CCW system in that it caps the state fee at $100 to process permits, allows members of the military extra time to renew their permits and adds additional permit options to include extended and lifetime permits.<span class=\"Apple-converted-space\">\u00a0 <\/span>So, for the cost of $100, presumably one can get a lifetime permit to carry in the state of Missouri.<\/p>\n<p class=\"p1\">&#8220;This is a great day for freedom in Missouri. The legislature stood strong for the constitutional rights of law-abiding citizens by overriding Gov. Nixon&#8217;s misguided veto,&#8221; said Chris W. Cox, Executive Director of NRA&#8217;s Institute for Legislative Action. &#8220;Despite the best efforts of Michael Bloomberg and out-of-state gun control groups to defeat the override vote, their agenda was rejected.&#8221;<\/p>\n<p class=\"p1\">Nixon vetoed the bill earlier this summer because<a href=\"https:\/\/www.kansascity.com\/news\/politics-government\/article101906277.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-missouri-lawmakers-override-governor-veto-enact-constitutional-carry\" title=\"Breaking: Missouri Lawmakers Override Governor Veto to Enact Constitutional Carry!\"> he claimed it <\/a>would allow \u201cindividuals to legally carry a concealed firearm even though they have been or would be denied a permit because their background check revealed criminal offenses or caused the sheriff to believe they posed a danger.\u201d<\/p>\n<p class=\"p1\">However, a close reading of Nixon\u2019s objection shows that it makes zero sense.<span class=\"Apple-converted-space\">\u00a0 <\/span>If an individual is a convicted felon, he couldn\u2019t lawfully possess let alone carry a firearm.<span class=\"Apple-converted-space\">\u00a0 <\/span>So, the law wouldn\u2019t allow a prohibited person to \u201clegally carry\u201d a firearm.<span class=\"Apple-converted-space\">\u00a0 <\/span>Rather, it simply allows non-prohibited persons, aka, law-abiding citizens, to carry concealed in any place that they could already carry openly.<\/p>\n<p class=\"p1\">The Senate voted to override the Nixon\u2019s veto on a party-line vote of 24-6.<span class=\"Apple-converted-space\">\u00a0 <\/span>The House cleared the bill by a vote of 112-41.<\/p>\n<p class=\"p1\">As one might expect, gun-control organization were less than pleased with the news of the override.<span class=\"Apple-converted-space\">\u00a0 <\/span>Former New York City mayor Michael Bloomberg via his gun-control outfit, Everytown for Gun Safety\/Moms Demand Action spent time and money on a campaign designed to kill SB 656.<span class=\"Apple-converted-space\">\u00a0 <\/span>Clearly, it failed.<\/p>\n<p class=\"p1\">\u201cMissouri lawmakers buckled to the NRA instead of listening to the vast majority of Missouri voters, including mayors and law enforcement leaders, who support our current concealed carry permit system,\u201d said Becky Morgan, a member of Moms Demand Action in a statement. \u201cAnd in doing so, they made our state the first new Stand Your Ground state since the death of Trayvon Martin.\u201d<\/p>\n<p class=\"p1\">The truth is Missouri lawmakers didn\u2019t buckle to the NRA, they buckled to common sense and the Constitution.<span class=\"Apple-converted-space\">\u00a0 <\/span>See, crime has a tendency to go down when more Americans exercise their right to keep and bear arms.<span class=\"Apple-converted-space\">\u00a0 <\/span>So, why not embrace a more purist (and historically accurate) reading of the Second Amendment (It says, Shall Not Be Infringed!<span class=\"Apple-converted-space\">\u00a0 And what is a f<\/span>ee but an infringement, a way to chill a right) and make it easier for responsible folks to carry and defend themselves in public?<span class=\"Apple-converted-space\">\u00a0 <\/span>That is the impetus behind the support of SB 656.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Missouri became the latest state to enact Constitutional Carry after the Legislature voted Wednesday to override the governor\u2019s veto of Senate Bill 656.<\/p>\n","protected":false},"author":34,"featured_media":63499,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_specdata_upc":"","_specdata_placement":"","footnotes":""},"categories":[244,7,25,216,240],"tags":[132,308,607,122],"featured":[],"hunt365":[],"class_list":{"0":"post-63497","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-2nd-amendment-r2kba","8":"category-gunsamerica-authors","9":"category-current-events","10":"category-s-h-blannelberry","11":"category-this-week","12":"tag-buzz","13":"tag-constitutional-carry","14":"tag-news","15":"tag-r2kba"},"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v27.3 (Yoast SEO v27.3) -
