{"id":63092,"date":"2016-09-06T10:56:29","date_gmt":"2016-09-06T14:56:29","guid":{"rendered":"https:\/\/www.gunsamerica.com\/blog\/?p=63092"},"modified":"2016-09-06T10:56:29","modified_gmt":"2023-08-20T05:09:49","slug":"lawmakers-letter-executive-gun-control-gunsmiths","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/lawmakers-letter-executive-gun-control-gunsmiths\/","title":{"rendered":"GOP Lawmakers Pen Letter to Stop ITAR Gun Control Targeting Gunsmiths"},"content":{"rendered":"<p class=\"p2\">As GunsAmerica <a href=\"https:\/\/www.gunsamerica.com\/blog\/new-itar-guidelines-look-a-lot-like-executive-gun-control\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"lawmakers-letter-executive-gun-control-gunsmiths\" title=\"GOP Lawmakers Pen Letter to Stop ITAR Gun Control Targeting Gunsmiths\">previously reported<\/a>, last month, the State Department via the Directorate of Defense Trade Controls (DDTC) issued a new \u201cguidance\u201d that would ostensibly require machine shops, gun dealers and gunsmiths nationwide to register with ITAR (International Traffic in Arms Regulations) at a cost of $2,250 per year.<\/p>\n<p class=\"p2\">In response to that announcement, which many viewed as a backdoor way to put a financial squeeze on 2A businesses, pro-gun members of Congress penned <a href=\"https:\/\/www.daines.senate.gov\/imo\/media\/doc\/20160829%20DAINES%20Letter%20to%20Sec%20Kerry%20on%20ITAR-DDTC%20and%20Gunsmithing.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"lawmakers-letter-executive-gun-control-gunsmiths\" title=\"GOP Lawmakers Pen Letter to Stop ITAR Gun Control Targeting Gunsmiths\">a letter <\/a>voicing their opposition.<\/p>\n<p class=\"p2\">\u201cThe vast majority of our constituents engaged in gunsmithing make little to no income from their activities and often do it as a hobby or side business,\u201d reads the Senate version of the letter signed by Sens. Chuck Grassley, James Inhofe, Ted Cruz, John McCain, among 20 others.<\/p>\n<p class=\"p2\">\u201cThey most certainly do not export firearms.<span class=\"Apple-converted-space\">\u00a0 <\/span>They also do not manufacture firearms in any widely understood sense of the term,\u201d the letter, dated Aug. 29, 2016, continues.<span class=\"Apple-converted-space\">\u00a0 <\/span>\u201cTherefore, it makes no sense for them to be required to pay $2,250 and register under AECA and ITAR.\u201d<\/p>\n<p class=\"p2\">As a reminder, ITAR requirements were created to prevent military firearms and firearm technology from being freely exported out of the United States.<\/p>\n<blockquote>\n<p class=\"p2\">In response to questions from persons engaged in the business of gunsmithing, DDTC has found in specific cases that ITAR registration is required because the following activities meet the ordinary, contemporary, common meaning of \u201cmanufacturing\u201d and, therefore, constitute \u201cmanufacturing\u201d for ITAR purposes:<br \/>\na) Use of any special tooling or equipment upgrading in order to improve the capability of assembled or repaired firearms;<br \/>\nb) Modifications to a firearm that change round capacity;<br \/>\nc) The production of firearm parts (including, but not limited to, barrels, stocks, cylinders, breech mechanisms, triggers, silencers, or suppressors);<br \/>\nd) The systemized production of ammunition, including the automated loading or reloading of ammunition;<br \/>\ne) The machining or cutting of firearms, e.g., threading of muzzles or muzzle brake installation requiring machining, that results in an enhanced capability;<br \/>\nf) Rechambering firearms through machining, cutting, or drilling;<br \/>\ng) Chambering, cutting, or threading barrel blanks; and<br \/>\nh) Blueprinting firearms by machining the barrel.<\/p>\n<\/blockquote>\n<p class=\"p2\">The letter goes on to state that\u00a0the last thing gunsmiths and machinists need \u201cis an edict from the federal government imposing crippling fees and requirements which are wholly unnecessary and nonsensical.\u201d<\/p>\n<p class=\"p2\">The new guidance was confusing in that it wasn\u2019t exactly clear who would have to comply with the registration requirement.<span class=\"Apple-converted-space\">\u00a0 <\/span>Language within it seemed to carve out the following exemption, \u201ctraditional gunsmithing activities do not constitute manufacturing for ITAR purposes, and therefore, do not require registration.\u201d<\/p>\n<p class=\"p2\">However, and as the lawmakers noted in the letter, the guidance also contained contradictory language that seemed to undermine that putative exemption.<\/p>\n<p class=\"p2\">\u201cSpecifically, as outlined, the activity threshold that necessitates a type 07 FFL (Federal Firearms Licensee-manufacturing) does not match up with the activities listed on page three of the guidance,\u201d stated the lawmakers in the letter.<\/p>\n<p class=\"p2\">\u201cThat means that firearms dealers who engage in limited gunsmithing &#8211;
