{"id":60762,"date":"2016-07-14T09:33:59","date_gmt":"2016-07-14T13:33:59","guid":{"rendered":"https:\/\/www.gunsamerica.com\/blog\/?p=60762"},"modified":"2016-07-14T09:33:59","modified_gmt":"2023-08-20T00:01:00","slug":"biden-wants-ban-armor-piercing-rounds-via-executive-fiat","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/biden-wants-ban-armor-piercing-rounds-via-executive-fiat\/","title":{"rendered":"Biden Wants to Ban \u2018Armor-Piercing\u2019 Rounds Via Executive Fiat"},"content":{"rendered":"<p class=\"p1\">\u201c<a href=\"https:\/\/www.gunsamerica.com\/blog\/joe-biden-defense-works-prosecutor-drops-charges-man-firing-shotgun-air\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"biden-wants-ban-armor-piercing-rounds-via-executive-fiat\" title=\"Biden Wants to Ban \u2018Armor-Piercing\u2019 Rounds Via Executive Fiat\">Shotgun\u201d Joe Biden <\/a>is once again sounding off on the gun issue, this time setting his sights on \u201carmor-piercing\u201d rounds.<\/p>\n<p class=\"p1\">In a recent interview with<em> <a href=\"https:\/\/www.cbsnews.com\/news\/vice-president-joe-biden-restrict-sale-of-armor-piercing-bullets-dallas-shooting\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"biden-wants-ban-armor-piercing-rounds-via-executive-fiat\" title=\"Biden Wants to Ban \u2018Armor-Piercing\u2019 Rounds Via Executive Fiat\">CBS News<\/a><\/em>, Biden spoke about the need to ban \u201carmor-piercing\u201d rounds in the wake of the shootings in Dallas that left five police officers dead.<\/p>\n<p class=\"p1\">&#8220;We&#8217;ve been trying to do that for a long time,&#8221; Biden said. &#8220;The first bill introduced to stop armor-piercing bullets was introduced by Pat Moynihan and me years ago. And so what we get is the constant, constant push back from the gun lobby and the Republican Congress.&#8221;<\/p>\n<p class=\"p1\">Maybe Biden doesn\u2019t realize this, but the Federal government already bans &#8220;armor-piercing&#8221; rounds with few exceptions.<span class=\"Apple-converted-space\">\u00a0 <\/span>Under current law, the ATF defines &#8220;armor-piercing&#8221; ammo by the following criteria:<\/p>\n<h4>Armor piercing ammunition<\/h4>\n<p><a href=\"https:\/\/www.gpo.gov\/fdsys\/browse\/collectionUScode.action?collectionCode=USCODE&amp;searchPath=Title+18%2FPart+I%2FCHAPTER+44&amp;oldPath=Title+18%2FPART+I&amp;isCollapsed=true&amp;selectedYearFrom=2012&amp;ycord=1738\" target=\"_blank\" class=\"clickTracking\" campaign=\"biden-wants-ban-armor-piercing-rounds-via-executive-fiat\" title=\"Biden Wants to Ban \u2018Armor-Piercing\u2019 Rounds Via Executive Fiat\">18 U.S.C., \u00a7 921(a)(17)(B)<\/a><\/p>\n<ul>\n<li><em>A projectile or projectile core which may be used in a handgun and which is constructed entirely (excluding the presence of traces of other substances) from one or a combination of tungsten alloys, steel, iron, brass, bronze, beryllium copper, or depleted uranium; or<\/em><\/li>\n<li><em>A full jacketed projectile larger than .22 caliber designed and intended for use in a handgun and whose jacket has a weight of more than 25 percent of the total weight of the projectile.<\/em><\/li>\n<\/ul>\n<p><em>The term <strong>\u201carmor piercing ammunition\u201d<\/strong> does not include shotgun shot required by Federal or State environmental or game regulations for hunting purposes, a frangible projectile designed for target shooting, a projectile which the Attorney General finds is primarily intended to be used for sporting purposes, or any other projectile or projectile core which the Attorney General finds is intended to be used for industrial purposes, including a charge used in an oil and gas well perforating device.<\/em><\/p>\n<p class=\"p1\">The key exemption is the \u201cprimarily intended for sporting purposes\u201d clause.<span class=\"Apple-converted-space\">\u00a0 You&#8217;ll recall that n<\/span>ot too long ago, in the Spring of 2015,<a href=\"https:\/\/www.gunsamerica.com\/blog\/atf-suspend-green-tip-ammo-ban-reclassification\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"biden-wants-ban-armor-piercing-rounds-via-executive-fiat\" title=\"Biden Wants to Ban \u2018Armor-Piercing\u2019 Rounds Via Executive Fiat\"> the ATF actually attempted to \u201creclassify\u201d<\/a> \u2014 or as the gun community correclty called it, \u201cban\u201d \u2014 M855 rounds, also known as \u201cgreen tip\u201d ammo, so that it would no longer fall under that exemption.<\/p>\n<p class=\"p1\">But after receiving over 80,000 critical comments from concerned gun owners on the proposal to ban the popular green tips, the ATF backed down.<\/p>\n<p class=\"p1\">\u201cAlthough ATF endeavored to create a proposal that reflected a good faith interpretation of the law and balanced the interests of law enforcement, industry, and sportsmen, the vast majority of the comments received to date are critical of the framework, and include issues that deserve further study,\u201d said the agency in a statement.<\/p>\n<p class=\"p1\">\u201cAccordingly, ATF will not at this time seek to issue a final framework,\u201d the statement continued.<\/p>\n<p class=\"p4\">What was particularly concerning about the assault on green tips was that it was coming from a federal agency and not the Legislative Branch.<span class=\"Apple-converted-space\">\u00a0 <\/span>As we all know, Congress is charged with drafting new laws \u2014 not the ATF.<span class=\"Apple-converted-space\">\u00a0 <\/span>But this type of rogue law-making \u2014 circumventing the House and Senate \u2014 is something that vice president Biden endorses.<\/p>\n<p class=\"p4\">&#8220;There is a debate as to whether or not there is authority in an executive action. I think we have the authority,\u201d said Biden.<span class=\"Apple-converted-space\">\u00a0 &#8220;<\/span>And there is a concern that if in fact we go ahead and do it, what the response will be from the United States Congress in a way that may be able to override a veto.&#8221;<\/p>\n<p class=\"p4\">In other words, Biden believes that Obama has the power via executive to expand the existing ban on \u201carmor-piercing\u201d rounds to cover all sorts of steel core ammo in common use.<span class=\"Apple-converted-space\">\u00a0 <\/span>Biden also said in the interview that the \u201carmor-piercing\u201d rounds have \u201czero\u201d sporting application.<\/p>\n<p class=\"p4\">At this point it\u2019s not clear whether the Obama administration will pursue an expanded ban on \u201carmor-piercing\u201d rounds.<span class=\"Apple-converted-space\">\u00a0 <\/span>However, if Obama decides to go down that road one can pretty much guranatee that the GOP-controlled Congress will vociferously weigh in on the matter and ultimately prevent it from taking effect.<span class=\"Apple-converted-space\">\u00a0 <\/span>At least one would hope.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a recent interview with CBS News, Biden spoke about the need to ban \u201carmor-piercing\u201d rounds in the wake of the shootings in Dallas that left five police officers dead.<\/p>\n","protected":false},"author":34,"featured_media":60763,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_specdata_upc":"","_specdata_placement":"","footnotes":""},"categories":[244,7,25,216,240],"tags":[132,607,122],"featured":[],"hunt365":[],"class_list":{"0":"post-60762","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-2nd-amendment-r2kba","8":"category-gunsamerica-authors","9":"category-current-events","10":"category-s-h-blannelberry","11":"category-this-week","12":"tag-buzz","13":"tag-news","14":"tag-r2kba"},"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v27.1 (Yoast SEO v27.3) - https:\/\/yoast.com\/product\/yoast-seo-premium-wordpress\/ -->\n<title>Biden Wants to Ban \u2018Armor-Piercing\u2019 Rounds Via Executive Fiat<\/title>\n<meta name=\"description\" content=\"Recenty, V.P.
