The combined viewership of the two videos is well over 4 million, and their popularity has attracted the attention of the FAA.<\/p>\n<p>According to a detailed piece from Vice\u2019s <a href=\"https:\/\/motherboard.vice.com\/read\/teen-fights-for-the-right-to-strap-guns-to-drones\" target=\"_blank\" class=\"clickTracking\" campaign=\"can-private-citizens-arm-personal-drones-courts-decide-flying-gun-video-case\" title=\"Can Private Citizens Arm Personal Drones? Courts to Decide in \u201cFlying Gun\u201d Video Case\">Motherboard,<\/a> the FAA subpoenaed the Haughwout\u2019s for \u201cphotographs and video, receipts for the flamethrower, YouTube audience, advertising, and monetization information, and other evidence that could be used against the family in court should the FAA decide that a crime was committed.\u201d<\/p>\n<p>The Haughwout\u2019s have thus far refused to comply with the subpoena, and Bret Haughwout has stated he will use the \u201cmaximum extent of the law\u201d to protect his son.<\/p>\n<p>The FAA has filed a motion to compel the Haughwouts to comply with the subpoena, which is currently making its way through US District Court in Connecticut.<\/p>\n<p>Essentially, the case revolves around two issues: the definition of \u201caircraft\u201d and the Second Amendment.<\/p>\n<p>The Second Amendment issue is a tricky one, as it isn\u2019t clear whether the individual right to keep and bear arms applies to robotic arms as well. <a href=\"https:\/\/www.usnews.com\/news\/articles\/2013\/05\/21\/the-next-gun-debate-armed-drones-could-be-protected-by-the-second-amendment\" target=\"_blank\" class=\"clickTracking\" campaign=\"can-private-citizens-arm-personal-drones-courts-decide-flying-gun-video-case\" title=\"Can Private Citizens Arm Personal Drones? Courts to Decide in \u201cFlying Gun\u201d Video Case\">Some say it might<\/a>, but not even all Second Amendment advocates are willing to die on that hill.<\/p>\n<p>&#8220;It&#8217;s nothing I&#8217;ve ever heard of anyone wanting to do,&#8221; Dave Workman of the Citizens Committee for the Right to Keep and Bear Arms told <a href=\"https:\/\/www.usnews.com\/news\/articles\/2013\/05\/21\/the-next-gun-debate-armed-drones-could-be-protected-by-the-second-amendment\" target=\"_blank\" class=\"clickTracking\" campaign=\"can-private-citizens-arm-personal-drones-courts-decide-flying-gun-video-case\" title=\"Can Private Citizens Arm Personal Drones? Courts to Decide in \u201cFlying Gun\u201d Video Case\">US News and World Report<\/a>. &#8220;It certainly is an interesting idea, but if you&#8217;re launching an armed, remote controlled aircraft, I&#8217;d imagine you&#8217;d run into some serious safety issues. What if it crashes and you have a loaded gun on it?&#8221;<\/p>\n<p>The Haughwout\u2019s lawyer, Mario Cerame, also isn\u2019t convinced appealing to the Second Amendment is his client\u2019s best strategy. Cerame told Motherboard that \u201che\u2019s not sure if gun drones would be protected by the Second Amendment, and he said invoking the Second Amendment in this legal brief would be \u2018too cute.\u2019\u201d<\/p>\n<p>The amendment has a basis and a legal precedent in protecting the right to self-defense, he explained. And since \u201cthe gun is not very accurate,\u201d it would be tough to argue the Haughwout\u2019s weaponized drone could be used for self-defense.<\/p>\n<p>The stronger case, according to Cerame, attacks the FAA\u2019s too-broad definition of \u201caircraft.\u201d Under its current definition, anything that flies through the air\u2014including bullets and plastic bags\u2014is under FAA jurisdiction. Cerame argues that this definition is ridiculously broad, and that his client\u2019s drones should not fall into the same category as manned airplanes, blimps, and helicopters.<\/p>\n<p>\u201cThe statutory definition of aircraft is ambiguous, and the FAA\u2019s construction is patently absurd,\u201d he wrote in his legal brief. \u201cSure, [the regulations] look simple enough. A thing, any thing, that flies.<\/p>\n<p>\u201cThe verb fly, as in \u2018fly in the air,\u2019 is not so plain, though. There is fly in the sense of airborne locomotion, like how birds fly from one place to another. But . . . flags also fly, when attached to a pole, don\u2019t they? We also say that plastic bags or bits of paper carried on the air fly about\u2014isn\u2019t that a motif in\u00a0<em>American Beauty<\/em>? And don\u2019t we say that bullets or knives or any airborn dangerous object\u2014don\u2019t they fly through the air too, especially when there are lots of them?
