(Photo: Baltimore Sun)<\/p><\/div>\n<p>The 4th Circuit U.S. Court of Appeals is set to determine the constitutionality of <a href=\"https:\/\/mgaleg.maryland.gov\/2013RS\/Chapters_noln\/CH_427_sb0281e.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"u-s-appeals-court-determine-constitutionality-marylands-assault-weapons-ban\" title=\"U.S. Appeals Court to Determine Constitutionality of Maryland\u2019s 'Assault Weapons' Ban\">Maryland\u2019s Firearms Safety Act of 2013<\/a>, a piece of legislation that bans the possession of \u201cassault weapons\u201d as well as the sale and purchase of magazines holding more than 10 rounds.<\/p>\n<p>The 14-judge panel heard arguments from both sides of the case Wednesday but did not make a decision. The NRA-ILA reports that the outcome is \u201c<a href=\"https:\/\/www.nraila.org\/articles\/20160304\/federal-court-of-appeals-to-review-important-gun-rights-decision\" target=\"_blank\" class=\"clickTracking\" campaign=\"u-s-appeals-court-determine-constitutionality-marylands-assault-weapons-ban\" title=\"U.S. Appeals Court to Determine Constitutionality of Maryland\u2019s 'Assault Weapons' Ban\">too close to call at this point<\/a>.\u201d<\/p>\n<p>According to the <a href=\"https:\/\/blogs.wsj.com\/law\/2016\/05\/11\/second-amendment-challenge-to-maryland-gun-law-goes-before-appeals-court\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"u-s-appeals-court-determine-constitutionality-marylands-assault-weapons-ban\" title=\"U.S. Appeals Court to Determine Constitutionality of Maryland\u2019s 'Assault Weapons' Ban\">Wall Street Journal<\/a>, the case hinges on whether or not \u201cassault weapons\u201d\u2014semi-automatic, high capacity rifles\u2014constitute \u201cdangerous and unusual weapons.\u201d The Supreme Court ruled in its 2008 D.C. v Heller majority opinion that state and federal governments can ban weapons that fall into the &#8220;dangerous and unusual&#8221; category without violating the Second Amendment right to keep and bear arms.<\/p>\n<p>Challengers to the Maryland law\u2014including the Maryland State Rifle and Pistol Association\u2014argued that these rifles are neither particularly dangerous nor unusual. Semi-automatic long guns are \u201ccommonly kept by law-abiding citizens\u201d in Maryland and across the nation, <a href=\"https:\/\/online.wsj.com\/public\/resources\/documents\/14-1945_challengers.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"u-s-appeals-court-determine-constitutionality-marylands-assault-weapons-ban\" title=\"U.S. Appeals Court to Determine Constitutionality of Maryland\u2019s 'Assault Weapons' Ban\">they wrote<\/a>. \u201cThere are at least eight million AR-15 and AK-47 style firearms in the United States. Firearms based on these two popular models accounted for approximately 20 percent of firearm sales in 2012.\u201d<\/p>\n<p>Those in favor of the law disagree.<\/p>\n<p>When asked why semi-automatic rifles are more \u201cdangerous and unusual\u201d than semi-automatic shotguns, Assistant Attorney General Matthew Fader said the legislature had gathered sufficient evidence that \u201cassault weapons\u201d are \u201cparticularly dangerous\u201d and had not drawn the same conclusion about the other firearms, the <a href=\"https:\/\/www.washingtonpost.com\/local\/public-safety\/appeals-court-to-revisit-challenge-to-marylands-ban-on-assault-weapons\/2016\/05\/10\/c346cea4-1229-11e6-81b4-581a5c4c42df_story.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"u-s-appeals-court-determine-constitutionality-marylands-assault-weapons-ban\" title=\"U.S. Appeals Court to Determine Constitutionality of Maryland\u2019s 'Assault Weapons' Ban\">Washington Post reported<\/a>.<\/p>\n<p>Maryland\u2019s Attorney General\u00a0Douglas Gansler argued that the law is a reasonable measure designed to protect public safety and \u201creduce the negative effects of firearms violence,\u201d the WSJ reported. AK-47s and AR-15s are \u201csuited, for military-style assaults,\u201d not sport shooting or self-defense.<\/p>\n<p>Judge Robert B. King summed it up like this: \u201cLet\u2019s be real: The assault weapons banned by Maryland\u2019s [law] are exceptionally lethal weapons of war\u201d and, as such, are not constitutionally protected.<\/p>\n<p>A decision in favor of the law, challenges responded, \u201cwould further erode the rights of law-abiding citizens to own protected firearms to the point where they would be equated with criminals, domestic violence misdemeanants, and illegal drug users.\u201d<\/p>\n<p>Even criminals, it turns out, don\u2019t prefer to use \u201cassault weapons\u201d to commit crimes. According to the FBI, rifles of any kind (not just \u201cassault rifles\u201d) were used in only <a href=\"https:\/\/www.fbi.gov\/about-us\/cjis\/ucr\/crime-in-the-u.s\/2011\/crime-in-the-u.s.-2011\/tables\/expanded-homicide-data-table-8\" target=\"_blank\" class=\"clickTracking\" campaign=\"u-s-appeals-court-determine-constitutionality-marylands-assault-weapons-ban\" title=\"U.S. Appeals Court to Determine Constitutionality of Maryland\u2019s 'Assault Weapons' Ban\">2.6 percent of all homicides<\/a>. By contrast, \u201chands, fists, feet, etc.\u201d were used in 5.7 percent of homicides, and knives were used in a whopping 13.4 percent.<\/p>\n<p>If Maryland is looking to ban \u201cdangerous\u201d weapons, they should take a closer look at a statewide knife ban. According to the numbers, sharp objects are almost seven times more dangerous than AR-15s.<\/p>\n<p>\u201cAssault rifles\u201d aren\u2019t much more \u201cunusual,\u201d either. There are <a href=\"https:\/\/dailycaller.com\/2012\/11\/16\/the-truth-about-assault-weapons\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"u-s-appeals-court-determine-constitutionality-marylands-assault-weapons-ban\" title=\"U.S. Appeals Court to Determine Constitutionality of Maryland\u2019s 'Assault Weapons' Ban\">an estimated 20-30 million<\/a> of these firearms in the United States today, which equals nearly one rifle for every ten people.
