{"id":49740,"date":"2016-01-02T13:53:00","date_gmt":"2016-01-02T18:53:00","guid":{"rendered":"https:\/\/www.gunsamerica.com\/blog\/?p=49740"},"modified":"2016-01-02T13:53:00","modified_gmt":"2023-08-19T05:43:59","slug":"pro-gun-groups-sue-fed-over-no-fly-list-gun-grab","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/pro-gun-groups-sue-fed-over-no-fly-list-gun-grab\/","title":{"rendered":"Pro-Gun Groups Sue Fed Over &#8216;No-Fly&#8217; List Gun-Grab"},"content":{"rendered":"<p>(<strong>Editor&#8217;s note<\/strong>: <em>This article was a submission from freelance writer Mike Doran<\/em>)<\/p>\n<p>Gun-rights groups are fighting back against the federal government\u2019s alleged misuse of the National Instant Criminal Background Check System (NICS) along with secret databases, like the Terrorist Watch List, that have been used to monitor gun owners.<\/p>\n<p>No, this is not a conspiracy theory. And, if you\u2019ve been paying any attention, it plays right along with the Anti-gunner&#8217;s Playbook.<\/p>\n<p>We have <a href=\"https:\/\/www.gunsamerica.com\/blog\/should-those-on-terrorist-watchlist-be-denied-gun-rights\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"pro-gun-groups-sue-fed-over-no-fly-list-gun-grab\" title=\"Pro-Gun Groups Sue Fed Over 'No-Fly' List Gun-Grab\">previously written<\/a> about the dangers of using databases like the federal No-Fly List or the more inclusive Terrorist Watch List.<\/p>\n<p>The groups alleging misconduct and violation of Second Amendment rights include the Gun Owners of America, the National Rifle Association, and the Second Amendment Foundation.<\/p>\n<p>\u201cBeing a named person on a \u2018terrorist watch list\u2019 is not a federal statutory disqualifying factor, nor should it be,\u201d the lawsuit states. \u201cPermanent deprivation of a fundamental civil right cannot and should not occur because something as small as an alleged, anonymous tip places an individual in a secret database managed by the attorney general, the FBI, and\/or the TSC to which the individual has no right of access and no method of recourse.\u201d<\/p>\n<p>This lawsuit comes after the shootings in San Bernardino, California where two Muslim shooters killed 14 and injured 22 last month. Though the husband and wife killers circumvented the law to obtain the firearms in one of the most anti-gun states through a straw purchase, there has been no shortage of cries from gun-grabbers to use the federal No-Fly List to ban those listed from purchasing firearms.<\/p>\n<p>But if the complaint holds water, the federal government has already been dangerously close to doing just that.<\/p>\n<p>\u201cWithout any legal authority to do so, since at least February 2004, the Federal Bureau of Investigation (the \u2018FBI\u2019) has carried out a fully-operational cross-check system between the NICS Firearms Background Check and the \u2018Terrorist Screening Database,\u201d the lawsuit says.<\/p>\n<p>2004 is, of course, well before President Obama was elected, making this is a brazen action, even more, shocking. It is all done in the name of safety, no matter who is steering the ship.
