While an increasing number of police officers carry Tasers while on-duty, and even though stun guns are clearly far less dangerous than firearms, the electronic devices have been deemed \u201cdangerous and unusual weapons\u201d and are therefore excluded from the protection of the Second Amendment.<\/p>\n<p>Eugene Volokh, a professor at the UCLA School of Law who specializes in criminal law and firearms regulation policy, has extensive experience on the subject and r<a href=\"https:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp\/2015\/08\/11\/are-stun-guns-protected-by-the-second-amendment\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"massachusetts-courts-decide-stun-guns-arent-protected-by-second-amendment\" title=\"Massachusetts Courts Decide Stun Guns Aren\u2019t Protected by Second Amendment\" target=\"_blank\" rel=\"noopener\">ecently filed an amicus brief<\/a> arguing against the court\u2019s decision.<\/p>\n<p>Volokh articulately raised several points, starting with the fact that being able to legally possess less-than-lethal weapons is in direct correlation to the right to keep and bear arms.<\/p>\n<p>Volokh explained that stun guns may be a more practical alternative to firearms for those who have \u201creligious or ethical compunctions about killing,\u201d those who feel they may be \u201cunable to pull the trigger on a deadly weapon,\u201d those concerned with fatally shooting the wrong person, those who are \u201creluctant to kill a particular potential attacker,\u201d those who are concerned a firearm \u201cmight be misused by their children or by a suicidal roommate,\u201d or those firearm owners who want the option of using less-than-lethal force.<\/p>\n<p>However, under the Massachusetts Supreme Judicial Court\u2019s new ruling, all the above listed individuals are now denied the right to possess a stun gun.<\/p>\n<p>Volokh enumerated several other points breaking down the court\u2019s decision to label stun guns as \u201cdangerous and unusual weapons.\u201d His amicus brief mentions several court cases that clearly show stun guns are neither \u201cdangerous\u201d (when compared to a firearm, which is protected under the Second Amendment) nor \u201cunusual.\u201d<\/p>\n<p>Volokh hopes his amicus will cause the courts to reconsider their decision to exclude stun guns from the protection of the Second Amendment.<\/p>\n<p>(<em>This article was a submission from freelance writer Brent Rogers<\/em>)<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Massachusetts Supreme Judicial Court has decided that stun guns will no longer be protected under the Second Amendment.<\/p>\n","protected":false},"author":34,"featured_media":41183,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_specdata_upc":"","_specdata_placement":"","footnotes":""},"categories":[244,7,326,25,216,240],"tags":[132,122],"featured":[],"hunt365":[],"class_list":{"0":"post-41182","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-2nd-amendment-r2kba","8":"category-gunsamerica-authors","9":"category-brent","10":"category-current-events","11":"category-s-h-blannelberry","12":"category-this-week","13":"tag-buzz","14":"tag-r2kba"},"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v27.3 (Yoast SEO v27.3) -
