The case was sent to the U.S. Court of Appeals for the Eleventh Circuit in Atlanta, who found \u201cthe Act is a valid regulation of professional conduct that has only incidental effect on physicians\u2019 free speech.\u201d <\/p>\n<p>But a group of physician lobby organizations represented by the Brady Center to Prevent Gun Violence was unsettled that they could no longer cross-examine patients about how they exercised their Second Amendment. The doctors banded together the Circuit to review the case again.<\/p>\n<p>The courts said, \u201cno,\u201d raising the point that doctors can still question patients about firearms, but only when it is appropriate, thereby safeguarding their First Amendment rights. <\/p>\n<p>\u201cThe Act codifies the commonsense conclusion that good medical care does not require inquiry or record-keeping regarding firearms when unnecessary to a patient\u2019s care \u2013 especially not when that inquiry or record-keeping constitutes such a substantial intrusion upon patient privacy,\u201d wrote Circuit Judge Gerald Tjoflat. <\/p>\n<p>However, Circuit Judge Charles Wilson disagreed with the majority decision, arguing that the prohibitive law is a breech of free speech. <\/p>\n<p>\u201cThis law is not designed to protect Second Amendment rights because doctors have no authority \u2013 and have not used their private positions of power \u2013 to compel firearms owners to relinquish their weapons,\u201d wrote Wilson. \u201cThis law is instead designed to stop a perceived political agenda, and it is difficult to conceive of any law designed for that purpose that could withstand Frist Amendment scrutiny.\u201d<\/p>\n<p>Marion Hammer, president of the Unified Sportsmen of Florida and past president of the National Rifle Association, summed it up nicely by noting that we go to the doctor\u2019s office for medical treatment, not to be interrogated about guns.<\/p>\n<p>\u201cWe take our children to pediatricians for medical care, not moral judgment, or privacy intrusions \u2013 we got to address medical needs, not to be interrogated about gun ownership,\u201d Hammer told <a href=\"https:\/\/www.guns.com\/2015\/07\/29\/courts-hand-down-another-pro-gun-victory-in-docs-vs-glocks-case\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doctors-no-longer-allowed-to-interrogate-patients-about-their-guns-after-docs-vs-glocks-win\" title=\"Doctors No Longer Allowed To Interrogate Patients About Their Guns After \u2018Docs Vs Glocks\u2019 Win\" target=\"_blank\" rel=\"noopener\">Guns.com<\/a>. \u201cThe legislation is about helping families who are complaining about being questioned about gun ownership and the growing anti-gun political agenda being carried out in examination rooms by doctors and medical staffs.\u201d<\/p>\n<p>(<em>This article was a submission from freelance writer Brent Rogers<\/em>) <\/p>\n","protected":false},"excerpt":{"rendered":"<p>The case popularly referred to as \u201cDocs vs. Glocks\u201d has been officially closed after a federal court rejected a request for rehearing last Tuesday.<\/p>\n","protected":false},"author":34,"featured_media":40765,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_specdata_upc":"","_specdata_placement":"","footnotes":""},"categories":[244,7,326,240],"tags":[132,122],"featured":[],"hunt365":[],"class_list":{"0":"post-40764","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-2nd-amendment-r2kba","8":"category-gunsamerica-authors","9":"category-brent","10":"category-this-week","11":"tag-buzz","12":"tag-r2kba"},"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v27.1 (Yoast SEO v27.2) -
