{"id":38566,"date":"2015-06-18T09:37:53","date_gmt":"2015-06-18T13:37:53","guid":{"rendered":"http:\/\/www.gunsamerica.com\/blog\/?p=38566"},"modified":"2015-06-18T09:37:53","modified_gmt":"2023-08-18T19:32:06","slug":"if-you-open-carry-in-michigan-expect-to-be-stopped-by-police","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/if-you-open-carry-in-michigan-expect-to-be-stopped-by-police\/","title":{"rendered":"If You Open Carry in Michigan, Expect to be Stopped by Police"},"content":{"rendered":"<p>A r<a href=\"https:\/\/www.freep.com\/story\/news\/local\/michigan\/2015\/06\/10\/open-carry-laws-michigan-courts-legislature-gun-rights\/71042518\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"if-you-open-carry-in-michigan-expect-to-be-stopped-by-police\" title=\"If You Open Carry in Michigan, Expect to be Stopped by Police\" target=\"_blank\" rel=\"noopener\">ecent ruling from the U.S. District Court<\/a> of Michigan declared it\u2019s not a violation of one&#8217;s constitutional rights for law enforcement officers to stop individuals openly carrying a firearm. <\/p>\n<p>The decision resulted from a lawsuit filed by Johann Deffert, who claimed he was illegally stopped by police on a cold winter day in Grand Rapids in 2013. Deffert said he was falsely detained simply because he was carrying openly, but Michigan courts said differently. <\/p>\n<p>The argument is age-old and can be easily tied into the right to bear arms. Most Second Amendment advocates read the Constitution as permitting Americans to not only own firearms, but carry them, because, well, that\u2019s exactly what it says. <\/p>\n<p>However, many state laws require open carriers to adhere to certain guidelines, like keeping a dry weapon holstered in plain view. <\/p>\n<p>This difference in law and perspective led Officer William Moe to detain Deffert. The reason for the stop? To determine if he was of mentally sound mind.
