{"id":26942,"date":"2014-11-07T11:36:52","date_gmt":"2014-11-07T16:36:52","guid":{"rendered":"http:\/\/www.gunsamerica.com\/blog\/?p=26942"},"modified":"2014-11-07T11:36:52","modified_gmt":"2023-08-18T04:27:01","slug":"california-loosens-penalties-gun-thieves-date-rapists","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/california-loosens-penalties-gun-thieves-date-rapists\/","title":{"rendered":"California Loosens penalties for gun thieves, date rapists"},"content":{"rendered":"<p>Gun thieves and date rapists are rejoicing in the Golden State following the passage of Proposition 47, a ballot initiative that reduces penalties for those\u00a0so-called &#8220;non serious&#8221; offenses.<\/p>\n<p>To give one an idea, the <a href=\"https:\/\/www.voterguide.sos.ca.gov\/en\/propositions\/47\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"california-loosens-penalties-gun-thieves-date-rapists\" title=\"California Loosens penalties for gun thieves, date rapists\" target=\"_blank\" rel=\"noopener\">text<\/a> from the state-approved voter guide describes one of the &#8220;cons&#8221; of Prop. 47 thusly:<\/p>\n<blockquote><p>Potentially releases 10,000 felons from state prison. Reduces penalties for stealing guns. Reduces penalties for possession of &#8220;date rape&#8221; drugs. Opposed by prosecutors, law enforcement, and the business community. Opposed by crime victims and sexual abuse victims. Vote NO on Prop. 47.<\/p><\/blockquote>\n<p>Naturally, as one might imagine, law enforcement isn&#8217;t too thrilled. For example, the Sacramento County Sheriff&#8217;s Department issued the following critiques of Prop. 47 on its <a href=\"https:\/\/www.facebook.com\/SacSheriff\/posts\/530414980429028?fref=nf\" target=\"_blank\" class=\"clickTracking\" campaign=\"california-loosens-penalties-gun-thieves-date-rapists\" title=\"California Loosens penalties for gun thieves, date rapists\">Facebook<\/a> page:<\/p>\n<ol>\n<li><em>In most instances, many crimes that were previously \u201carrestable\u201d as a felony will now only be \u201ccitable\u201d as a misdemeanor. That means they may not be booked into jail but rather given a citation (similar to a traffic ticket) with a court date to appear, and released in the field. They will not be held pending trial. Such felony crimes that are now misdemeanors include:<\/em><\/li>\n<\/ol>\n<ul>\n<li><em>\u00a0Commercial burglary (theft under $950)<\/em><\/li>\n<li><em>\u00a0Forgery and bad checks (under $950 value)<\/em><\/li>\n<li><em>\u00a0Theft of most firearms<\/em><\/li>\n<li><em>\u00a0Theft of a vehicle (under $950 value)<\/em><\/li>\n<li><em>\u00a0Possession of stolen property (under $950 value)<\/em><\/li>\n<li><em>\u00a0Possession of heroin, cocaine, illegal prescriptions, concentrated cannabis, and methamphetamine<\/em><\/li>\n<\/ul>\n<p>Undoubtedly, America has a problem with mass incarceration. We have five percent of the world&#8217;s population with 25 percent of the world&#8217;s prison population, according to the <a href=\"https:\/\/www.aclu.org\/safe-communities-fair-sentences\/prison-crisis\" target=\"_blank\" class=\"clickTracking\" campaign=\"california-loosens-penalties-gun-thieves-date-rapists\" title=\"California Loosens penalties for gun thieves, date rapists\" target=\"_blank\" rel=\"noopener\">ACLU<\/a>. \u00a0We are the world&#8217;s largest jailer. So, yes, we need to address this problem. But we must address it intelligently.
