Technically, it never left.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Second Amendment Foundation, NSSF and several partners have <a href=\"https:\/\/saf.org\/wp-content\/uploads\/2026\/10\/NSSF-v.-Torrez-MPI_10.23.26.pdf?utm_source=chatgpt.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gun-waiting-period-injunction\" title=\"Gun Groups Challenge New Mexico\u2019s 7-Day Waiting Period\">filed a motion for a preliminary injunction<\/a> in <em>NSSF v. Torrez<\/em>. It generally requires buyers to wait seven calendar days before receiving a firearm, even after passing the required background check.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law includes exceptions for certain transactions and buyers, including holders of New Mexico concealed handgun licenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Violating the waiting period can result in misdemeanor charges for both the seller and buyer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Supporters call it a \u201ccooling-off\u201d period intended to reduce impulsive violence and suicide. Gun-rights groups argue the state cannot force qualified buyers to wait before exercising a constitutional right.<\/p>\n\n\n\n<h2 id=\"h-didn-t-the-courts-already-settle-this\" class=\"wp-block-heading\">Didn\u2019t the Courts Already Settle This?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">That is where things get a little messy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In August 2025, the <a href=\"https:\/\/www.ca10.uscourts.gov\/sites\/ca10\/files\/opinions\/010111284574.pdf?utm_source=chatgpt.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gun-waiting-period-injunction\" title=\"Gun Groups Challenge New Mexico\u2019s 7-Day Waiting Period\">U.S. Court of Appeals for the Tenth Circuit<\/a> ruled in <em>Ortega v. Grisham<\/em> that the waiting period likely violated the Second Amendment when applied to buyers who had cleared their background checks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court said New Mexico failed to identify a comparable historical <a href=\"https:\/\/www.ca10.uscourts.gov\/sites\/ca10\/files\/opinions\/010111284574.pdf?utm_source=chatgpt.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gun-waiting-period-injunction\" title=\"Gun Groups Challenge New Mexico\u2019s 7-Day Waiting Period\">tradition<\/a> of forcing eligible citizens to wait before obtaining a firearm. It reversed the district court and instructed it to issue injunctive relief. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On remand, the district court <a href=\"https:\/\/nssfpdf.s3.us-east-1.amazonaws.com\/Ortega%2Bdct%2BMSJ%2Border.pdf?utm_source=chatgpt.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gun-waiting-period-injunction\" title=\"Gun Groups Challenge New Mexico\u2019s 7-Day Waiting Period\">entered judgment for the two Ortega plaintiffs<\/a>. However, the resulting injunction protected only those named individuals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/henry-golden-boy-deadeye-revolver-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gun-waiting-period-injunction\" title=\"Gun Groups Challenge New Mexico\u2019s 7-Day Waiting Period\">Henry Golden Boy Deadeye Review: .22 LR Gets Sharper<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">New Mexico therefore continues enforcing the law against everyone else.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not technically a violation of the existing injunction because the order was limited to the original plaintiffs. However, SAF and NSSF argue that continuing enforcement ignores the Tenth Circuit\u2019s broader constitutional analysis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Put simply, the appeals court said the waiting period is unconstitutional in this context, but the original court order did not protect every New Mexico gun buyer.<\/p>\n\n\n\n<h2 id=\"h-new-case-seeks-broader-protection\" class=\"wp-block-heading\">New Case Seeks Broader Protection<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The plaintiffs in <em>NSSF v. Torrez<\/em> are asking the court to extend protection to a much larger group.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>National Shooting Sports Foundation<\/li>\n\n\n\n<li>National Rifle Association<\/li>\n\n\n\n<li>Second Amendment Foundation<\/li>\n\n\n\n<li>New Mexico Firearms Industry Association<\/li>\n\n\n\n<li>New Mexico Shooting Sports Association<\/li>\n\n\n\n<li>Calibers Shooting Sports Center<\/li>\n\n\n\n<li>Omni Tactical USA<\/li>\n\n\n\n<li>Right to Bear Arms<\/li>\n\n\n\n<li>New Mexico resident Peter Hackett<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Their motion asks the court to stop Attorney General Ra\u00fal Torrez and those under his supervision from enforcing HB129 against the organizations, their members and their customers. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cA motion for preliminary injunction is a way of asking the court for emergency relief,\u201d SAF Senior Director of Legal Operations Bill Sack explained.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NSSF Senior Vice President and General Counsel Lawrence Keane said the state should not be allowed to continue enforcing a law the Tenth Circuit has already found constitutionally defective.<\/p>\n\n\n\n<h2 id=\"h-now-it-is-back-to-the-judge\" class=\"wp-block-heading\">Now It Is Back to the Judge<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The latest motion does not automatically suspend New Mexico\u2019s waiting period. The law remains enforceable against anyone not protected by the earlier order unless the court grants the new injunction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Still, the plaintiffs enter this round with a major advantage. They are making essentially the same constitutional argument that already prevailed before the Tenth Circuit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">New Mexico can continue fighting over who is protected by the earlier ruling.
