Another lost because his record included violent threats connected to a carjacking.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The basic message is fairly simple. A conviction involving violence or threats can support disarmament on its own. A conviction without those elements may require a closer look.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These decisions do not erase the federal prohibited-person law. That shorthand is not entirely accurate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ban can also cover certain state misdemeanors carrying longer maximum sentences. Federal law excludes most state misdemeanors punishable by two years or less, but the Pennsylvania offenses in these cases carried possible five-year sentences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Third Circuit considered both cases with its full bench and issued both opinions on October 13.<\/p>\n\n\n\n<h2 id=\"h-edward-williams-wins-his-challenge\" class=\"wp-block-heading\">Edward Williams Wins His Challenge<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www2.ca3.uscourts.gov\/opinarch\/241091p.pdf?utm_source=chatgpt.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"third-circuit-federal-gun-ban-rulings\" title=\"Third Circuit Limits Federal Gun Ban in Two Major Rulings\">Edward Williams<\/a> had two DUI offenses during the early 2000s. His second involved Pennsylvania\u2019s highest blood-alcohol category and carried a possible five-year sentence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Williams received a sentence of 90 days to two years, which he served through home confinement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because the offense carried a five-year maximum, it triggered the federal firearm prohibition. Williams said he did not initially realize that.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He continued owning firearms and worked at a gun store. According to the opinion, ATF conducted a background check and cleared him to work there.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2015, an attorney informed Williams that his DUI record prohibited him from possessing firearms. He then gave up his guns and filed suit in 2017.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Third Circuit ruled 8-6 that permanently applying the federal ban to Williams violated the Second Amendment. It <a href=\"https:\/\/www2.ca3.uscourts.gov\/opinarch\/241091p.pdf?utm_source=chatgpt.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"third-circuit-federal-gun-ban-rulings\" title=\"Third Circuit Limits Federal Gun Ban in Two Major Rulings\">affirmed<\/a> a lower court\u2019s decision granting him declaratory relief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/fn-scar-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"third-circuit-federal-gun-ban-rulings\" title=\"Third Circuit Limits Federal Gun Ban in Two Major Rulings\">FN SCAR Buyer\u2019s Guide 2026: 16S vs. 17S vs. 20S<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This was an \u201cas-applied\u201d ruling. In plain English, the court decided the law was unconstitutional when applied to Williams and his particular record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court did not excuse drunk driving. It focused on whether Williams currently presented the kind of physical danger that historically justified disarmament.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More than 20 years had passed without violent or dangerous conduct. Williams maintained the same employment for more than 30 years. He also submitted to an expert evaluation that found no addiction or violent tendencies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The government pointed to historic laws targeting habitual drunkards. The court found those laws to be a poor match.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Many involved temporary confinement, treatment or guardianship. They did not impose an automatic lifetime firearm ban after someone returned to society.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court concluded that Williams currently posed no physical danger and had never misused a firearm. It <a href=\"https:\/\/cases.justia.com\/federal\/appellate-courts\/ca3\/24-1091\/24-1091-2026-10-13.pdf?utm_source=chatgpt.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"third-circuit-federal-gun-ban-rulings\" title=\"Third Circuit Limits Federal Gun Ban in Two Major Rulings\">described<\/a> him as a peaceable citizen capable of exercising his Second Amendment rights.<\/p>\n\n\n\n<h2 id=\"h-james-bost-gets-the-opposite-result\" class=\"wp-block-heading\">James Bost Gets the Opposite Result<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The result changed in <a href=\"https:\/\/www2.ca3.uscourts.gov\/opinarch\/241719p.pdf?utm_source=chatgpt.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"third-circuit-federal-gun-ban-rulings\" title=\"Third Circuit Limits Federal Gun Ban in Two Major Rulings\">United States v. Bost<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">James Bost\u2019s record stemmed from a 2002 carjacking. According to the opinion, he threatened to kill the driver unless she gave him money.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bost pleaded guilty to terroristic threats, criminal conspiracy, false imprisonment and simple assault. His terroristic-threats offense required proof that he threatened a violent crime with the intent to terrorize another person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Years later, U.S. Marshals found Bost near a stolen .38-caliber pistol while arresting him after he failed to appear in another case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bost challenged his prohibited-person charge and the federal ban on possessing stolen firearms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Third Circuit upheld the result against him by a 12-2 vote, although the judges differed over the reasoning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/taurus-tx22-braced-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"third-circuit-federal-gun-ban-rulings\" title=\"Third Circuit Limits Federal Gun Ban in Two Major Rulings\">Taurus TX22 Braced Review: The TX22 With a Folding Brace<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court held that a conviction containing violent or threatening elements can <a href=\"https:\/\/www2.ca3.uscourts.gov\/opinarch\/241719p.pdf?utm_source=chatgpt.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"third-circuit-federal-gun-ban-rulings\" title=\"Third Circuit Limits Federal Gun Ban in Two Major Rulings\">create<\/a> an initial presumption that the person presents a risk of physical violence involving firearms. That was enough to defeat Bost\u2019s request to dismiss the charge at that early stage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Importantly, the majority did not decide what later evidence might overcome that presumption. It only held that Bost\u2019s threatening conviction was sufficient to keep the prosecution alive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judges also rejected Bost\u2019s challenge to the stolen-firearm charge. The Second Amendment protects keeping and bearing arms, the court explained, but it does not create a right to possess stolen property.<\/p>\n\n\n\n<h2 id=\"h-what-the-rulings-actually-change\" class=\"wp-block-heading\">What the Rulings Actually Change<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These decisions do not automatically restore gun rights to everyone with a nonviolent conviction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Williams won a case-specific judgment based on his offense, personal history and present circumstances. Other challengers will still need to bring their own cases or pursue the federal restoration process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court also did not strike down <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/922?utm_source=chatgpt.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"third-circuit-federal-gun-ban-rulings\" title=\"Third Circuit Limits Federal Gun Ban in Two Major Rulings\">Section 922(g)(1)<\/a> across the board. Bost\u2019s case demonstrates that the law still has constitutional applications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The procedural difference also matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bost asked a court to dismiss a criminal charge at an early stage. Williams brought a civil lawsuit and developed a broader record concerning his current behavior.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Read together, the rulings establish a practical framework:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Violent or threatening convictions may justify disarmament based on the conviction itself.<\/li>\n\n\n\n<li>Clearly nonviolent convictions do not automatically justify permanent disarmament.<\/li>\n\n\n\n<li>Cases falling between those categories will likely require more historical and factual analysis.<\/li>\n\n\n\n<li>Courts may consider whether someone currently poses a physical danger during a developed, case-specific challenge.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The biggest takeaway is that a criminal label alone is no longer the entire conversation in the Third Circuit. The nature of the offense, the historical record and the individual\u2019s current circumstances can all matter.<\/p>\n\n\n\n<p class=\"has-text-align-left wp-block-paragraph\"
