{"id":25923,"date":"2014-10-10T13:49:07","date_gmt":"2014-10-10T17:49:07","guid":{"rendered":"http:\/\/www.gunsamerica.com\/blog\/?p=25923"},"modified":"2014-10-10T13:49:07","modified_gmt":"2023-08-18T03:01:41","slug":"tricky-cop-gets-caught-trying-profile-motorist-unlawful-search","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/tricky-cop-gets-caught-trying-profile-motorist-unlawful-search\/","title":{"rendered":"Tricky cop gets caught trying to profile motorist into unlawful search"},"content":{"rendered":"<p>After pulling over a motorist who was driving with his headlights off, an Ankeny, Iowa, police officer attempted to trick the man into allowing him to search his car for marijuana.<\/p>\n<p>The incident, which occurred earlier this month, was caught on video and shows how the officer tries to fool the motorist into incriminating himself.<\/p>\n<p>\u201cYou play frisbee golf?\u201d the officer asks.<\/p>\n<p>\u201cI do actually. I play out at Heritage (Park)\u201d replies the motorist.<\/p>\n<p>&#8220;OK. I need you to answer me a question. Why is it that everybody that plays Frisbee golf smokes weed?\u201d the officer continues.<\/p>\n<p>\u201cNo, it\u2019s not everybody,\u201d the motorist counters.<\/p>\n<p>\u201cIt\u2019s everybody, man. You can\u2019t tell me you never smoked weed,\u201d the officer says.<\/p>\n<p>The motorist responds, \u201cI\u2019m not gonna tell you one way or another.\u201d<\/p>\n<p>\u201cSee, there you go,&#8221; says the officer. &#8220;How much weed do you have in the car today?\u201d<\/p>\n<p>The driver insists that he doesn&#8217;t have marijuana in his vehicle. Nevertheless, the officer tries once again to get permission to search the vehicle.<\/p>\n<p>\u201cYou understand you\u2019re free to go and everything but you wouldn\u2019t have a problem with me looking through your car?\u201d<\/p>\n<p>Apparently frustrated, the driver takes a stand. &#8220;I actually would. Just because I have a disc golf bag doesn\u2019t mean that every disc golfer does have weed.\u201d<\/p>\n<p>&#8220;So you have weed in the car then is what you\u2019re saying?\u201d says the cop.<\/p>\n<p>\u201cNo I would say I have a problem with you searching my car because you\u2019re profiling me based on being a disc golfer,&#8221; says the driver.<\/p>\n<p>In an interview with a <a href=\"https:\/\/whotv.com\/2014\/10\/09\/ankeny-cop-tries-to-search-car-because-everybody-that-plays-frisbee-golf-smokes-weed\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"tricky-cop-gets-caught-trying-profile-motorist-unlawful-search\" title=\"Tricky cop gets caught trying to profile motorist into unlawful search\" target=\"_blank\" rel=\"noopener\">local NBC affiliate<\/a>, Drake Law Professor Robert Rigg explains why the officer&#8217;s request for a search would have been unlawful under the state&#8217;s Constitution.<\/p>\n<p>\u201cWhat the officer did after that was try to extend that stop into a general search of the defendant\u2019s car, or the individual\u2019s car. That\u2019s not permissible anymore,\u201d says Rigg.<\/p>\n<p>\u201cThe Iowa Supreme Court has held that under the Iowa constitution you can\u2019t convert an equipment violation stop into a general search,&#8221; he continued. &#8220;And any consent that would have been given would have been invalid in any event.\u201d<\/p>\n<p>Rigg, on the other hand, said that the motorist handled the situation well.<\/p>\n<p>\u201cI think the young man did exactly what he was supposed to do. He did not admit to smoking marijuana,&#8221; said Rigg. &#8220;He didn\u2019t answer that question at all and he has the right not to answer that question. And he has the right to say, look, if you want to ask me questions, why don\u2019t you call my lawyer.\u201d<\/p>\n<p>Since the video has gone viral, it prompted a response from the Ankeny Police Department, which admitted that the incident was &#8220;handled poorly by the officer.&#8221;<\/p>\n<p>\u201cIn the video taken by an occupant in the vehicle, the officer engages the driver in a line of questioning that is foolish and not representative of the Ankeny Police Dept.\u2019s training or interactions with the public,\u201d reads <a href=\"https:\/\/www.facebook.com\/cityofankeny\" target=\"_blank\" class=\"clickTracking\" campaign=\"tricky-cop-gets-caught-trying-profile-motorist-unlawful-search\" title=\"Tricky cop gets caught trying to profile motorist into unlawful search\" target=\"_blank\" rel=\"noopener\">the statement <\/a>that was posted on Facebook.<\/p>\n<p>\u201cThis verbal exchange did not meet the level of professionalism expected of Ankeny police officers.
