autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<h2 id=\"h-key-takeaways\" class=\"wp-block-heading\">Key Takeaways<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/gunsamerica.com\/digest\/50330\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-nfa-registration-guidance-goa-victory\" title=\"GOA Celebrates New ATF NFA Guidance, But Flags a Major Future Risk\"  data-wpil-monitor-id=\"7839\">ATF will not enforce federal NFA<\/a> registration and approval requirements for suppressors, SBRs, SBSs and AOWs.<\/li>\n\n\n\n<li>The nationwide policy took effect October 9, 2026.<\/li>\n\n\n\n<li>Dealers must still complete Form 4473s and conduct NICS checks.<\/li>\n\n\n\n<li>Machine guns and destructive devices remain fully regulated under the NFA.<\/li>\n\n\n\n<li>State and local restrictions still apply.<\/li>\n\n\n\n<li>ATF will continue accepting voluntary NFA registrations.<\/li>\n\n\n\n<li>The agency warns that a future administration or Congress could reverse course.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-how-goa-s-lawsuit-changed-the-nfa\" class=\"wp-block-heading\">How GOA\u2019s Lawsuit Changed the NFA<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Congress reduced the NFA making and transfer taxes on suppressors, SBRs, SBSs and AOWs to zero through the <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/1\/text\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-nfa-registration-guidance-goa-victory\" title=\"GOA Celebrates New ATF NFA Guidance, But Flags a Major Future Risk\">One Big Beautiful Bill Act.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">GOA, the Gun Owners Foundation, <a href=\"https:\/\/gunsamerica.com\/digest\/diligent-defense-dtf-sti-review-338-8-6-blk\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-nfa-registration-guidance-goa-victory\" title=\"GOA Celebrates New ATF NFA Guidance, But Flags a Major Future Risk\"  data-wpil-monitor-id=\"7838\">Silencer Shop<\/a> Foundation and other plaintiffs quickly challenged the remaining registration system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On August 5, U.S. District Judge James Wesley Hendrix ruled that the challenged requirements could no longer stand under Congress\u2019s taxing power. The court also rejected the government\u2019s attempt to defend the system under the Commerce Clause.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The resulting injunction blocked ATF from enforcing several NFA provisions against the plaintiffs and, where applicable, their members and customers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Justice Department did not appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the court\u2019s injunction was not nationwide. The broader change came when DOJ and ATF decided to extend the new enforcement policy to everyone.<\/p>\n\n\n\n<h2 id=\"h-what-atf-says-gun-owners-can-do\" class=\"wp-block-heading\">What ATF Says Gun Owners Can Do<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Under the new guidance, ATF will not require prior approval or NFA registration before covered individuals make or transfer suppressors, SBRs, SBSs or AOWs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means ATF will not enforce the traditional Form 1, Form 4, registration and tax-stamp requirements for those covered items.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unlicensed individuals may still submit a Form 1 voluntarily. Dealers and manufacturers may also continue using Forms 2, 3 and 4 if they want the item listed in the federal registry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Commercial purchases do not become paperwork-free, however.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Licensed dealers must still complete a Form 4473, conduct a <a href=\"https:\/\/gunsamerica.com\/digest\/g-jeff-sessions-orders-fbi-atf-review-nics\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-nfa-registration-guidance-goa-victory\" title=\"GOA Celebrates New ATF NFA Guidance, But Flags a Major Future Risk\"  data-wpil-monitor-id=\"7836\">NICS background check<\/a> and maintain transaction records. Buyers and sellers also remain subject to the <a href=\"https:\/\/gunsamerica.com\/digest\/olympian-kim-rhode-opposes-anti-gun-ballot-initiative-new-video\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-nfa-registration-guidance-goa-victory\" title=\"GOA Celebrates New ATF NFA Guidance, But Flags a Major Future Risk\"  data-wpil-monitor-id=\"7837\">Gun Control<\/a> Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Machine guns and destructive devices are not included. Their $200 taxes remain, along with the full NFA process.<\/p>\n\n\n\n<h2 id=\"h-some-important-limits-remain\" class=\"wp-block-heading\">Some Important Limits Remain<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Anyone transporting an SBR or SBS across state lines must still file a Form 20.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">State and local restrictions also remain in effect. Some states prohibit certain NFA items. Others require owners to comply with the federal registration system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ATF acknowledges that an unregistered item allowed under its federal policy might still create problems under state law. Dealers cannot complete transfers that violate the buyer\u2019s state or local laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ATF is also developing a separate process for dealer transfers of SBRs and SBSs. Until that system exists, the agency says it will temporarily decline to enforce the conflicting federal approval requirement.<\/p>\n\n\n\n<h2 id=\"h-goa-flags-the-future-risk-section\" class=\"wp-block-heading\">GOA Flags the \u2018Future Risk\u2019 Section<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">GOA focused much of its response on ATF\u2019s warning about what could happen later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ATF says enforcement could resume if Congress creates a new tax, a court overturns the injunction or DOJ rescinds the guidance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That matters because federal law does not automatically grandfather unregistered NFA items.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If enforcement returned, the government could once again treat those items as contraband. Owners could face felony penalties and forfeiture unless Congress, a court or the attorney general provided another solution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The attorney general could announce a temporary amnesty period for registration. However, federal law does not require one.<\/p>\n\n\n\n<h2 id=\"h-why-goa-membership-matters-in-its-view\" class=\"wp-block-heading\">Why GOA Membership Matters in Its View<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The nationwide policy rests on ATF\u2019s enforcement discretion. A future administration could rescind it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">GOA argues that its members have an additional layer of protection because they fall within the court\u2019s injunction, not merely the agency\u2019s voluntary policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction matters if a future administration changes ATF\u2019s position while the injunction remains active.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, even that protection is not unlimited. If another court dissolved or overturned the injunction, the legal situation could change for everyone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">GOA described the ATF\u2019s transparency as a step in the right direction. Its long-term goal remains eliminating the NFA and abolishing the agency itself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For now, the organization is taking a victory lap while warning gun owners not to confuse a major enforcement change with permanent legislative repeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anyone considering an unregistered suppressor, SBR, SBS or AOW should review the <a href=\"https:\/\/www.atf.gov\/firearms\/update-to-nfa-transfer-guidance\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-nfa-registration-guidance-goa-victory\" title=\"GOA Celebrates New ATF NFA Guidance, But Flags a Major Future Risk\">ATF guidance<\/a>, confirm state and local requirements and seek qualified legal advice when necessary.<\/p>\n\n\n\n<p class=\"has-text-align-left
