Johnson Sr.\u2019s petition in <em><a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/26-255.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-leaves-concealed-carry-patchwork-intact\" title=\"SCOTUS Leaves Concealed Carry Patchwork Intact\">Johnson v. Jacobson<\/a><\/em> on October 5 without offering an explanation. The decision leaves the Eighth Circuit\u2019s ruling in place.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the denial does not mean the Supreme Court found Minnesota\u2019s law constitutional. He holds valid <a href=\"https:\/\/gunsamerica.com\/digest\/laugo-arms-alien-remus-shot-show-2026\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-leaves-concealed-carry-patchwork-intact\" title=\"SCOTUS Leaves Concealed Carry Patchwork Intact\" data-wpil-monitor-id=\"7777\">concealed carry<\/a> permits from Georgia and Florida, but Minnesota recognizes neither permit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Minnesota issues permits to residents and nonresidents. It also honors permits from states that meet its reciprocity standards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Johnson challenged the state\u2019s refusal to recognize his existing permits. He argued that requiring another permit placed an additional burden on his <a href=\"https:\/\/gunsamerica.com\/digest\/people-book-celebrates-gun-owners-across-america\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-leaves-concealed-carry-patchwork-intact\" title=\"SCOTUS Leaves Concealed Carry Patchwork Intact\" data-wpil-monitor-id=\"7778\">Second Amendment<\/a> rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/springfield-sa-35-4-polished-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-leaves-concealed-carry-patchwork-intact\" title=\"SCOTUS Leaves Concealed Carry Patchwork Intact\">Springfield SA-35 4\u2033 Polished Review: Beauty That Shoots<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Eighth Circuit rejected that argument in May. The court noted that Johnson did not challenge Minnesota\u2019s underlying shall-issue permitting system. Because of that concession, the court treated reciprocity as an exemption from Minnesota\u2019s permit requirement, not an independent Second Amendment right.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The panel acknowledged that a different constitutional issue could arise if a state refused to issue permits to nonresidents while also refusing to recognize permits from other states. Minnesota allows nonresidents to apply, so that question was not before the court.<\/p>\n\n\n\n<h2 id=\"h-safe-passage-does-not-mean-carry\" class=\"wp-block-heading\">Safe Passage Does Not Mean Carry<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Federal law already provides limited protections for firearm owners traveling across state lines.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the federal safe-passage law, qualified travelers may transport unloaded and inaccessible firearms between places where they may legally possess them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ATF proposed a rule in May clarifying that overnight lodging, fuel stops, repairs, medical treatment and other necessary travel activities can remain protected. However, the proposal deals with firearm transportation, not <a href=\"https:\/\/gunsamerica.com\/digest\/new-carry-contour-emp-springfields-ccw-9mm-1911-gets-even-better-full-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-leaves-concealed-carry-patchwork-intact\" title=\"SCOTUS Leaves Concealed Carry Patchwork Intact\" data-wpil-monitor-id=\"7779\">carrying a loaded handgun for self-defense<\/a>.<\/p>\n\n\n\n<h2 id=\"h-reciprocity-bills-remain-in-congress\" class=\"wp-block-heading\">Reciprocity Bills Remain in Congress<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">NSSF is calling for passage of the Constitutional Concealed Carry Reciprocity Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The House version, <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/38\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-leaves-concealed-carry-patchwork-intact\" title=\"SCOTUS Leaves Concealed Carry Patchwork Intact\">H.R. 38, <\/a>would generally allow qualified individuals to <a data-wpil-monitor-id=\"7775\" href=\"https:\/\/gunsamerica.com\/digest\/heizer-defense-pocket-ak-pocket-ar\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-leaves-concealed-carry-patchwork-intact\" title=\"SCOTUS Leaves Concealed Carry Patchwork Intact\">carry concealed handguns<\/a> in other states that permit concealed carry. Travelers would still need to follow the destination state\u2019s rules concerning where and how firearms may be carried.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The House Judiciary Committee approved an amended version in 2025. It was formally reported to the House on October 3, 2025, but has not received a floor vote. The Senate companion, S. 65, was introduced by Sen. John Cornyn of Texas but has not advanced beyond the Senate Judiciary Committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NSSF\u2019s position is straightforward: lawful carriers should not need several permits and a legal roadmap simply to cross state lines.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With the Supreme Court declining to take Johnson\u2019s case, any nationwide solution will likely have to come from Congress.
