The neighborhood sits just off Leroy Stevens Road.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"MPD: Homeowner shoots and kills man who broke in through window\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/gpFbEBhpXl4?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Officers found 37-year-old David Lee Jr. dead from a gunshot wound inside the home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Investigators say Lee broke a window and unlawfully entered the residence. Police say the male homeowner then shot and killed him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The homeowner\u2019s name has not been released. Police also have not provided details about what happened between the forced entry and the gunfire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Neighbors told <em>FOX 10<\/em> they did not hear the shots. One neighbor said it was sad that someone died but believed the homeowner did what was necessary to protect his family.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.mobilepd.org\/news\/calgary-drive-homicide-investigation\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"alabama-homeowner-shoots-intruder\" title=\"Alabama Homeowner Kills Intruder Who Broke Through Window, Police Say\">Mobile Police Department<\/a> has turned the case over to the Mobile County District Attorney\u2019s Office for review. State law generally does not require someone to retreat from an unlawful and forceful intruder inside an occupied home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Still, every defensive shooting receives its own investigation. Prosecutors will review the physical evidence, witness statements and everything the homeowner told police before deciding whether the shooting was legally justified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the surface, the known facts appear pretty straightforward: Police say a man smashed a window, entered an occupied home without permission and was shot by the homeowner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unless investigators uncover something that changes that timeline, this could end up being another example of an armed homeowner stopping a threat inside his own residence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For now, the case remains under review and the homeowner has not been charged.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong>Self-defense doesn\u2019t end when the threat goes down.
