Cook County<\/em> <\/a>the most important Second Amendment case since <em>NYSRPA v. Bruen<\/em>. That is a bold assessment, but the potential stakes back it up. Depending on how broadly the justices rule, the case could determine the future of so-called \u201cassault weapons\u201d bans across the country.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">GOA and the Gun Owners Foundation recently filed a <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-238\/423106\/20260904132250217_Viramontes%20Amicus%20final.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"viramontes-cook-county-goa-ar15-brief\" title=\"GOA Files in Supreme Court\u2019s Big AR-15 Case: Why Viramontes Matters\">friend-of-the-court brief<\/a> supporting the challengers. Cook County maintains that it may legally prohibit them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seventh Circuit rejected the challenge by relying on its earlier decision in <em>Bevis v. City of Naperville<\/em>. In that case, the appeals court concluded that AR-15s were not materially different from M16 rifles and fell on the \u201cmilitary\u201d side of a line the court drew between civilian and military arms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court agreed to hear <em>Viramontes<\/em> on June 30. It also consolidated the case with <em>Grant v. Higgins<\/em>, a challenge to Connecticut\u2019s similar restrictions. According to the <a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/25-238.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"viramontes-cook-county-goa-ar15-brief\" title=\"GOA Files in Supreme Court\u2019s Big AR-15 Case: Why Viramontes Matters\">Supreme Court docket<\/a>, oral arguments are scheduled for December 2, 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The official question is refreshingly direct: \u201cWhether the Second and Fourteenth Amendments guarantee the right to possess AR-15 platform and similar semiautomatic rifles.\u201d<\/p>\n\n\n\n<h2 id=\"h-goa-s-common-use-argument\" class=\"wp-block-heading\">GOA\u2019s Common-Use Argument<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">GOA\u2019s first argument is the simplest: AR-15s and similar rifles are unquestionably in common use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>District of Columbia v. Heller<\/em>, the Supreme Court held that the government cannot ban firearms commonly possessed for lawful purposes. GOA argues that this principle should settle the case without a complicated historical detour.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The brief points to prior Supreme Court language describing semiautomatic rifles as widely accepted lawful possessions. It also notes that the Court unanimously described the AR-15 in <em>Smith &amp; Wesson Brands v. Mexico<\/em> as \u201cthe most popular rifle in the country.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tens of millions of these rifles are estimated to be in private hands. As GOA sees it, politicians and judges do not get to call such a widely owned firearm \u201cunusual\u201d simply because they dislike it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/uberti-1873-review-44-40-lever-action\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"viramontes-cook-county-goa-ar15-brief\" title=\"GOA Files in Supreme Court\u2019s Big AR-15 Case: Why Viramontes Matters\">Uberti 1873 Review: The .44-40 Legend Still Runs<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf this Court is satisfied that tens of millions (or more) AR-15s and other semiautomatic rifles constitute being in \u2018common use,\u2019 then nothing more is needed to strike the bans under review,\u201d the brief argues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the brass-tacks version of GOA\u2019s position: Americans already made their choice, and that choice was the AR-15.<\/p>\n\n\n\n<h2 id=\"h-what-does-dangerous-and-unusual-mean\" class=\"wp-block-heading\">What Does \u201cDangerous and Unusual\u201d Mean?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">GOA also wants the Court to clean up the phrase \u201cdangerous and unusual.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gun-control advocates frequently use that language to argue that certain firearms fall outside the Second Amendment. GOA counters that the historical regulations behind the phrase dealt with people carrying or displaying weapons in a threatening manner that disturbed the peace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In other words, those laws punished conduct. They did not outlaw merely possessing an entire class of arms at home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">GOA argues that stretching those old restrictions into support for a modern ban on ownership badly misses the mark. According to the brief, there is no comparable historical tradition of banning the purchase and possession of a firearm simply because the government considered it especially dangerous.<\/p>\n\n\n\n<h2 id=\"h-the-military-rifle-question\" class=\"wp-block-heading\">The Military-Rifle Question<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Then there is the M16 comparison.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An AR-15 fires one round with each pull of the trigger. An M16 can fire automatically. GOA argues that treating the two as interchangeable ignores an obvious mechanical and legal distinction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, the brief says that even if AR-15s shared more characteristics with military weapons, that would not automatically remove them from constitutional protection. GOA points to the Second Amendment\u2019s militia language and argues that the Founders expected citizens to possess arms suitable for militia service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Still, GOA urges the justices not to let this case wander into a broader debate about machine guns. The rifles directly before the Court are semiautomatic, and the organization believes the cleaner path is to recognize them as bearable arms in common lawful use.<\/p>\n\n\n\n<h2 id=\"h-why-this-case-matters\" class=\"wp-block-heading\">Why This Case Matters<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A narrow ruling could resolve only the Cook County and Connecticut disputes. A broader decision could establish a national test that knocks down similar bans in other states and cities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court could also finally tell lower courts whether they may uphold rifle bans by comparing semiautomatic firearms to military weapons, or by labeling commonly owned rifles \u201cdangerous and unusual.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nothing has been decided yet. GOA\u2019s brief is an argument supporting the challengers, not a ruling from the Court.
